حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ أَخْبَرَنَا الْوَلِيدُ بْنُ مُسْلِمٍ عَنْ الْأَوْزَاعِيِّ عَنْ الزُّهْرِيِّ عَنْ سَالِمٍ عَنْ أَبِيهِ رَضِيَ اللَّهُ عَنْهُ قَالَ رَأَيْتُ الَّذِينَ يَشْتَرُونَ الطَّعَامَ مُجَازَفَةً يُضْرَبُونَ عَلَی عَهْدِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَبِيعُوهُ حَتَّی يُؤْوُوهُ إِلَی رِحَالِهِمْ

Narrated Salim: that his father said. "I saw those, who used to buy foodstuff without measuring or weighing in the life time of the Prophet being punished if they sold it before carrying it to their own houses."

حَدَّثَنَا مُوسَی بْنُ إِسْمَاعِيلَ حَدَّثَنَا وُهَيْبٌ عَنْ ابْنِ طَاوُسٍ عَنْ أَبِيهِ عَنْ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَی أَنْ يَبِيعَ الرَّجُلُ طَعَامًا حَتَّی يَسْتَوْفِيَهُ قُلْتُ لِابْنِ عَبَّاسٍ کَيْفَ ذَاکَ قَالَ ذَاکَ دَرَاهِمُ بِدَرَاهِمَ وَالطَّعَامُ مُرْجَأٌ قَالَ أَبُو عَبْد اللَّهِ مُرْجَئُونَ مُؤَخَّرُونَ

Narrated Tawus: Ibn `Abbas said, "Allah's Apostle forbade the selling of foodstuff before its measuring and transferring into one's possession." I asked Ibn `Abbas, "How is that?" Ibn `Abbas replied, "It will be just like selling money for money, as the foodstuff has not been handed over to the first purchaser who is the present seller."

حَدَّثَنَا عَلِيٌّ حَدَّثَنَا سُفْيَانُ کَانَ عَمْرُو بْنُ دِينَارٍ يُحَدِّثُهُ عَنْ الزُّهْرِيِّ عَنْ مَالِکِ بْنِ أَوْسٍ أَنَّهُ قَالَ مَنْ عِنْدَهُ صَرْفٌ فَقَالَ طَلْحَةُ أَنَا حَتَّی يَجِيئَ خَازِنُنَا مِنْ الْغَابَةِ قَالَ سُفْيَانُ هُوَ الَّذِي حَفِظْنَاهُ مِنْ الزُّهْرِيِّ لَيْسَ فِيهِ زِيَادَةٌ فَقَالَ أَخْبَرَنِي مَالِکُ بْنُ أَوْسِ بْنِ الْحَدَثَانِ سَمِعَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ يُخْبِرُ عَنْ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الذَّهَبُ بِالذَّهَبِ رِبًا إِلَّا هَائَ وَهَائَ وَالْبُرُّ بِالْبُرِّ رِبًا إِلَّا هَائَ وَهَائَ وَالتَّمْرُ بِالتَّمْرِ رِبًا إِلَّا هَائَ وَهَائَ وَالشَّعِيرُ بِالشَّعِيرِ رِبًا إِلَّا هَائَ وَهَائَ

Narrated Az-Zuhri from Malik bin Aus: that the latter said, "Who has change?" Talha said, "I (will have change) when our storekeeper comes from the forest." Narrated `Umar bin Al-Khattab: Allah's Apostle said, "The bartering of gold for silver is Riba, (usury), except if it is from hand to hand and equal in amount, and wheat grain for wheat grain is usury except if it is form hand to hand and equal in amount, and dates for dates is usury except if it is from hand to hand and equal in amount, and barley for barley is usury except if it is from hand to hand and equal in amount." حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا سُفْيَانُ قَالَ الَّذِي حَفِظْنَاهُ مِنْ عَمْرِو بْنِ دِينَارٍ سَمِعَ طَاوُسًا يَقُولُ سَمِعْتُ ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا يَقُولُ أَمَّا الَّذِي نَهَی عَنْهُ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَهُوَ الطَّعَامُ أَنْ يُبَاعَ حَتَّی يُقْبَضَ قَالَ ابْنُ عَبَّاسٍ وَلَا أَحْسِبُ کُلَّ شَيْئٍ إِلَّا مِثْلَهُ

Narrated Ibn `Abbas: The Prophet forbade the selling of foodstuff before receiving it. I consider that all types of sellings should be done similarly.

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ حَدَّثَنَا مَالِکٌ عَنْ نَافِعٍ عَنْ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّی يَسْتَوْفِيَهُ زَادَ إِسْمَاعِيلُ مَنْ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّی يَقْبِضَهُ

Narrated Ibn `Umar: The Prophet said, "The buyer of foodstuff should not sell it before it has been measured for him." Isma`il narrated instead, "He should not sell it before receiving it."

حَدَّثَنَا يَحْيَی بْنُ بُکَيْرٍ حَدَّثَنَا اللَّيْثُ عَنْ يُونُسَ عَنْ ابْنِ شِهَابٍ قَالَ أَخْبَرَنِي سَالِمُ بْنُ عَبْدِ اللَّهِ أَنَّ ابْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَ لَقَدْ رَأَيْتُ النَّاسَ فِي عَهْدِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يَبْتَاعُونَ جِزَافًا يَعْنِي الطَّعَامَ يُضْرَبُونَ أَنْ يَبِيعُوهُ فِي مَکَانِهِمْ حَتَّی يُؤْوُوهُ إِلَی رِحَالِهِمْ

Narrated Ibn `Umar: I saw the people buy foodstuff randomly (i.e. blindly without measuring it) in the lifetime of Allah's Apostle and they were punished (by beating), if they tried to sell it before carrying it to their own houses.

حَدَّثَنَا فَرْوَةُ بْنُ أَبِي الْمَغْرَائِ أَخْبَرَنَا عَلِيُّ بْنُ مُسْهِرٍ عَنْ هِشَامٍ عَنْ أَبِيهِ عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ لَقَلَّ يَوْمٌ کَانَ يَأْتِي عَلَی النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَّا يَأْتِي فِيهِ بَيْتَ أَبِي بَکْرٍ أَحَدَ طَرَفَيْ النَّهَارِ فَلَمَّا أُذِنَ لَهُ فِي الْخُرُوجِ إِلَی الْمَدِينَةِ لَمْ يَرُعْنَا إِلَّا وَقَدْ أَتَانَا ظُهْرًا فَخُبِّرَ بِهِ أَبُو بَکْرٍ فَقَالَ مَا جَائَنَا النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فِي هَذِهِ السَّاعَةِ إِلَّا لِأَمْرٍ حَدَثَ فَلَمَّا دَخَلَ عَلَيْهِ قَالَ لِأَبِي بَکْرٍ أَخْرِجْ مَنْ عِنْدَکَ قَالَ يَا رَسُولَ اللَّهِ إِنَّمَا هُمَا ابْنَتَايَ يَعْنِي عَائِشَةَ وَأَسْمَائَ قَالَ أَشَعَرْتَ أَنَّهُ قَدْ أُذِنَ لِي فِي الْخُرُوجِ قَالَ الصُّحْبَةَ يَا رَسُولَ اللَّهِ قَالَ الصُّحْبَةَ قَالَ يَا رَسُولَ اللَّهِ إِنَّ عِنْدِي نَاقَتَيْنِ أَعْدَدْتُهُمَا لِلْخُرُوجِ فَخُذْ إِحْدَاهُمَا قَالَ قَدْ أَخَذْتُهَا بِالثَّمَنِ

Narrated Aisha: Rarely did the Prophet fail to visit Abu Bakr's house everyday, either in the morning or in the evening. When the permission for migration to Medina was granted, all of a sudden the Prophet came to us at noon and Abu Bakr was informed, who said, "Certainly the Prophet has come for some urgent matter." The Prophet said to Abu Bark, when the latter entered "Let nobody stay in your home." Abu Bakr said, "O Allah's Apostle! There are only my two daughters (namely `Aisha and Asma') present." The Prophet said, "I feel (am informed) that I have been granted the permission for migration." Abu Bakr said, "I will accompany you, O Allah's Apostle!" The Prophet said, "You will accompany me." Abu Bakr then said "O Allah's Apostle! I have two she-camels I have prepared specially for migration, so I offer you one of them. The Prophet said, "I have accepted it on the condition that I will pay its price."

Narrated `Abdullah bin `Umar: Allah's Apostle said, "Do not urge somebody to return what he has already bought (i.e. in optional sale) from another seller so as to sell him your own goods."

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا سُفْيَانُ حَدَّثَنَا الزُّهْرِيُّ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ نَهَی رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَلَا تَنَاجَشُوا وَلَا يَبِيعُ الرَّجُلُ عَلَی بَيْعِ أَخِيهِ وَلَا يَخْطُبُ عَلَی خِطْبَةِ أَخِيهِ وَلَا تَسْأَلُ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَکْفَأَ مَا فِي إِنَائِهَا

Narrated Abu Huraira: Allah's Apostle forbade the selling of things by a town dweller on behalf of a desert dweller; and similarly Najsh was forbidden. And one should not urge somebody to return the goods to the seller so as to sell him his own goods; nor should one demand the hand of a girl who has already been engaged to someone else; and a woman should not try to cause some other woman to be divorced in order to take her place.

حَدَّثَنَا بِشْرُ بْنُ مُحَمَّدٍ أَخْبَرَنَا عَبْدُ اللَّهِ أَخْبَرَنَا الْحُسَيْنُ الْمُکْتِبُ عَنْ عَطَائِ بْنِ أَبِي رَبَاحٍ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا أَنَّ رَجُلًا أَعْتَقَ غُلَامًا لَهُ عَنْ دُبُرٍ فَاحْتَاجَ فَأَخَذَهُ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ مَنْ يَشْتَرِيهِ مِنِّي فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللَّهِ بِکَذَا وَکَذَا فَدَفَعَهُ إِلَيْهِ

Narrated Jabir bin `Abdullah: A man decided that a slave of his would be manumitted after his death and later on he was in need of money, so the Prophet took the slave and said, "Who will buy this slave from me?" Nu'aim bin `Abdullah bought him for such and such price and the Prophet gave him the slave.
