حَدَّثَنَا مُوسَی بْنُ إِسْمَاعِيلَ حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُسْلِمٍ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ دِينَارٍ قَالَ سَمِعْتُ ابْنَ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا يَقُولُ بَيْنَا النَّاسُ فِي الصُّبْحِ بِقُبَائٍ إِذْ جَائَهُمْ رَجُلٌ فَقَالَ أُنْزِلَ اللَّيْلَةَ قُرْآنٌ فَأُمِرَ أَنْ يَسْتَقْبِلَ الْکَعْبَةَ فَاسْتَقْبِلُوهَا وَاسْتَدَارُوا کَهَيْئَتِهِمْ فَتَوَجَّهُوا إِلَی الْکَعْبَةِ وَکَانَ وَجْهُ النَّاس إِلَی الشَّأْمِ

Narrated `Urwa: I said to `Aisha, the wife of the Prophet, and I was at that time a young boy, "How do you interpret the Statement of Allah: "Verily, Safa and Marwa (i.e. two mountains at Mecca) are among the Symbols of Allah." So it is not harmful of those who perform the Hajj to the House of Allah) or perform the Umra, to ambulate (Tawaf) between them. In my opinion it is not sinful for one not to ambulate (Tawaf) between them." `Aisha said, "Your interpretation is wrong for as you say, the Verse should have been: "So it is not harmful of those who perform the Hajj or Umra to the House, not to ambulate (Tawaf) between them.' This Verse was revealed in connection with the Ansar who (during the Pre-Islamic Period) used to visit Manat (i.e. an idol) after assuming their Ihram, and it was situated near Qudaid (i.e. a place at Mecca), and they used to regard it sinful to ambulate between Safa and Marwa after embracing Islam. When Islam came, they asked Allah's Messenger about it, whereupon Allah revealed:-- "Verily, Safa and Marwa (i.e. two mountains at Mecca) are among the Symbols of Allah. So it is not harmful of those who perform the Hajj of the House (of Allah) or perform the Umra, to ambulate (Tawaf) between them." (2.158)

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ عَنْ مَالِکٍ عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ عَنْ ابْنِ عُمَرَ قَالَ بَيْنَمَا النَّاسُ فِي صَلَاةِ الصُّبْحِ بِقُبَائٍ إِذْ جَائَهُمْ آتٍ فَقَالَ إِنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ أُنْزِلَ عَلَيْهِ اللَّيْلَةَ وَقَدْ أُمِرَ أَنْ يَسْتَقْبِلَ الْکَعْبَةَ فَاسْتَقْبِلُوهَا وَکَانَتْ وُجُوهُهُمْ إِلَی الشَّأْمِ فَاسْتَدَارُوا إِلَی الْقِبْلَةِ

Narrated `Asim bin Sulaiman: I asked Anas bin Malik about Safa and Marwa. Anas replied, "We used to consider (i.e. going around) them a custom of the Pre-islamic period of Ignorance, so when Islam came, we gave up going around them. Then Allah revealed" "Verily, Safa and Marwa (i.e. two mountains at Mecca) are among the Symbols of Allah. So it is not harmful of those who perform the Hajj of the House (of Allah) or perform the Umra to ambulate (Tawaf) between them." (2.158)

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ أَخْبَرَنَا مَالِکٌ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ أَنَّهُ قَالَ قُلْتُ لِعَائِشَةَ زَوْجِ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَنَا يَوْمَئِذٍ حَدِيثُ السِّنِّ أَرَأَيْتِ قَوْلَ اللَّهِ تَبَارَکَ وَتَعَالَی إِنَّ الصَّفَا وَالْمَرْوَةَ مِنْ شَعَائِرِ اللَّهِ فَمَنْ حَجَّ الْبَيْتَ أَوْ اعْتَمَرَ فَلَا جُنَاحَ عَلَيْهِ أَنْ يَطَّوَّفَ بِهِمَا فَمَا أُرَی عَلَی أَحَدٍ شَيْئًا أَنْ لَا يَطَّوَّفَ بِهِمَا فَقَالَتْ عَائِشَةُ کَلَّا لَوْ کَانَتْ کَمَا تَقُولُ کَانَتْ فَلَا جُنَاحَ عَلَيْهِ أَنْ لَا يَطَّوَّفَ بِهِمَا إِنَّمَا أُنْزِلَتْ هَذِهِ الْآيَةُ فِي الْأَنْصَارِ کَانُوا يُهِلُّونَ لِمَنَاةَ وَکَانَتْ مَنَاةُ حَذْوَ قُدَيْدٍ وَکَانُوا يَتَحَرَّجُونَ أَنْ يَطُوفُوا بَيْنَ الصَّفَا وَالْمَرْوَةِ فَلَمَّا جَائَ الْإِسْلَامُ سَأَلُوا رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِکَ فَأَنْزَلَ اللَّهُ إِنَّ الصَّفَا وَالْمَرْوَةَ مِنْ شَعَائِرِ اللَّهِ فَمَنْ حَجَّ الْبَيْتَ أَوْ اعْتَمَرَ فَلَا جُنَاحَ عَلَيْهِ أَنْ يَطَّوَّفَ بِهِمَا

Narrated `Abdullah: The Prophet said one statement and I said another. The Prophet said "Whoever dies while still invoking anything other than Allah as a rival to Allah, will enter Hell (Fire)." And I said, "Whoever dies without invoking anything as a rival to Allah, will enter Paradise."

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ عَاصِمِ بْنِ سُلَيْمَانَ قَالَ سَأَلْتُ أَنَسَ بْنَ مَالِکٍ رَضِيَ اللَّهُ عَنْهُ عَنْ الصَّفَا وَالْمَرْوَةِ فَقَالَ کُنَّا نَرَی أَنَّهُمَا مِنْ أَمْرِ الْجَاهِلِيَّةِ فَلَمَّا کَانَ الْإِسْلَامُ أَمْسَکْنَا عَنْهُمَا فَأَنْزَلَ اللَّهُ تَعَالَی إِنَّ الصَّفَا وَالْمَرْوَةَ مِنْ شَعَائِرِ اللَّهِ فَمَنْ حَجَّ الْبَيْتَ أَوْ اعْتَمَرَ فَلَا جُنَاحَ عَلَيْهِ أَنْ يَطَّوَّفَ بِهِمَا

Narrated Ibn `Abbas: The law of Qisas (i.e. equality in punishment) was prescribed for the children of Israel, but the Diya (i.e. blood money was not ordained for them). So Allah said to this Nation (i.e. Muslims): "O you who believe! The law of Al-Qisas (i.e. equality in punishment) is prescribed for you in cases of murder: The free for the free, the slave for the slave, and the female for the female. But if the relatives (or one of them) of the killed (person) forgive their brother (i.e. the killers something of Qisas (i.e. not to kill the killer by accepting blood money in the case of intentional murder)----then the relatives (of the killed person) should demand blood-money in a reasonable manner and the killer must pay with handsome gratitude. This is an allevitation and a Mercy from your Lord, (in comparison to what was prescribed for the nations before you). So after this, whoever transgresses the limits (i.e. to kill the killer after taking the blood-money) shall have a painful torment." (2.178)

حَدَّثَنَا عَبْدَانُ عَنْ أَبِي حَمْزَةَ عَنْ الْأَعْمَشِ عَنْ شَقِيقٍ عَنْ عَبْدِ اللَّهِ قَالَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کَلِمَةً وَقُلْتُ أُخْرَی قَالَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ مَاتَ وَهْوَ يَدْعُو مِنْ دُونِ اللَّهِ نِدًّا دَخَلَ النَّارَ وَقُلْتُ أَنَا مَنْ مَاتَ وَهْوَ لَا يَدْعُو لِلَّهِ نِدًّا دَخَلَ الْجَنَّةَ

Narrated Anas: The Prophet said, "The prescribed Law of Allah is the equality in punishment (i.e. Al-Qisas)." (In cases of murders, etc.)

حَدَّثَنَا الْحُمَيْدِيُّ حَدَّثَنَا سُفْيَانُ حَدَّثَنَا عَمْرٌو قَالَ سَمِعْتُ مُجَاهِدًا قَالَ سَمِعْتُ ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا يَقُولُ کَانَ فِي بَنِي إِسْرَائِيلَ الْقِصَاصُ وَلَمْ تَکُنْ فِيهِمْ الدِّيَةُ فَقَالَ اللَّهُ تَعَالَی لِهَذِهِ الْأُمَّةِ کُتِبَ عَلَيْکُمْ الْقِصَاصُ فِي الْقَتْلَی الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ وَالْأُنْثَی بِالْأُنْثَی فَمَنْ عُفِيَ لَهُ مِنْ أَخِيهِ شَيْئٌ فَالْعَفْوُ أَنْ يَقْبَلَ الدِّيَةَ فِي الْعَمْدِ فَاتِّبَاعٌ بِالْمَعْرُوفِ وَأَدَائٌ إِلَيْهِ بِإِحْسَانٍ يَتَّبِعُ بِالْمَعْرُوفِ وَيُؤَدِّي بِإِحْسَانٍ ذَلِکَ تَخْفِيفٌ مِنْ رَبِّکُمْ وَرَحْمَةٌ مِمَّا کُتِبَ عَلَی مَنْ کَانَ قَبْلَکُمْ فَمَنْ اعْتَدَی بَعْدَ ذَلِکَ فَلَهُ عَذَابٌ أَلِيمٌ قَتَلَ بَعْدَ قَبُولِ الدِّيَةِ

Narrated Anas: That his aunt, Ar-Rubai' broke an incisor tooth of a girl. My aunt's family requested the girl's relatives for forgiveness but they refused; then they proposed a compensation, but they refused. Then they went to Allah's Messenger and refused everything except Al-Qisas (i.e. equality in punishment). So Allah's Apostle passed the judgment of Al-Qisas (i.e. equality of punishment). Anas bin Al-Nadr said, "O Allah's Messenger ! Will the incisor tooth of Ar-Rubai be broken? No, by Him Who sent you with the Truth, her incisor tooth will not be broken." Allah's Messenger said, "O Anas! The prescribed law of Allah is equality in punishment (i.e. Al-Qisas.)" Thereupon those people became satisfied and forgave her. Then Allah's Messenger said, "Among Allah's Worshippers there are some who, if they took Allah's Oath (for something), Allah fulfill their oaths."

Narrated Ibn `Umar: Fasting was observed on the day of 'Ashura' (i.e. 10th of Muharram) by the people of the Pre-lslamic Period. But when (the order of compulsory fasting) in the month of Ramadan was revealed, the Prophet said, "It is up to one to fast on it (i.e. day of 'Ashura') or not."

حَدَّثَنِي عَبْدُ اللَّهِ بْنُ مُنِيرٍ سَمِعَ عَبْدَ اللَّهِ بْنَ بَکْرٍ السَّهْمِيَّ حَدَّثَنَا حُمَيْدٌ عَنْ أَنَسٍ أَنَّ الرُّبَيِّعَ عَمَّتَهُ کَسَرَتْ ثَنِيَّةَ جَارِيَةٍ فَطَلَبُوا إِلَيْهَا الْعَفْوَ فَأَبَوْا فَعَرَضُوا الْأَرْشَ فَأَبَوْا فَأَتَوْا رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَبَوْا إِلَّا الْقِصَاصَ فَأَمَرَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ بِالْقِصَاصِ فَقَالَ أَنَسُ بْنُ النَّضْرِ يَا رَسُولَ اللَّهِ أَتُکْسَرُ ثَنِيَّةُ الرُّبَيِّعِ لَا وَالَّذِي بَعَثَکَ بِالْحَقِّ لَا تُکْسَرُ ثَنِيَّتُهَا فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ يَا أَنَسُ کِتَابُ اللَّهِ الْقِصَاصُ فَرَضِيَ الْقَوْمُ فَعَفَوْا فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّ مِنْ عِبَادِ اللَّهِ مَنْ لَوْ أَقْسَمَ عَلَی اللَّهِ لَأَبَرَّهُ

Narrated `Aisha: The people used to fast on the day of 'Ashura' before fasting in Ramadan was prescribed but when (the order of compulsory fasting in) Ramadan was revealed, it was up to one to fast on it (i.e. 'Ashura') or not.

حَدَّثَنَا الْحُمَيْدِيُّ حَدَّثَنَا سُفْيَانُ حَدَّثَنَا هِشَامٌ عَنْ أَبِيهِ عَنْ زَيْنَبَ عَنْ أُمِّ حَبِيبَةَ قَالَتْ قُلْتُ يَا رَسُولَ اللَّهِ هَلْ لَکَ فِي بِنْتِ أَبِي سُفْيَانَ قَالَ فَأَفْعَلُ مَاذَا قُلْتُ تَنْکِحُ قَالَ أَتُحِبِّينَ قُلْتُ لَسْتُ لَکَ بِمُخْلِيَةٍ وَأَحَبُّ مَنْ شَرِکَنِي فِيکَ أُخْتِي قَالَ إِنَّهَا لَا تَحِلُّ لِي قُلْتُ بَلَغَنِي أَنَّکَ تَخْطُبُ قَالَ ابْنَةَ أُمِّ سَلَمَةَ قُلْتُ نَعَمْ قَالَ لَوْ لَمْ تَکُنْ رَبِيبَتِي مَا حَلَّتْ لِي أَرْضَعَتْنِي وَأَبَاهَا ثُوَيْبَةُ فَلَا تَعْرِضْنَ عَلَيَّ بَنَاتِکُنَّ وَلَا أَخَوَاتِکُنَّ وَقَالَ اللَّيْثُ حَدَّثَنَا هِشَامٌ دُرَّةُ بِنْتُ أَبِي سَلَمَةَ

Narrated Um Habiba: I said, "O Allah's Apostle! Marry my sister, the daughter of Abu Sufyan." He said, "Do you like that?" I said, "Yes, for even now I am not your only wife; and the most beloved person to share the good with me is my sister." The Prophet said, "But that is not lawful for me (i.e., to be married to two sisters at a time.)" I said, "O Allah's Apostle! By Allah, we have heard that you want to marry Durra, the daughter of Abu Salama." He said, "You mean the daughter of Um Salama?" I said, "Yes." He said, "By Allah ! Even if she were not my stepdaughter, she would not be lawful for me to marry, for she is my foster niece, for Thuwaiba has suckled me and Abu Salama; so you should neither present your daughters, nor your sisters to me."

بَاب وَرَبَائِبُكُمْ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمْ اللَّاتِي دَخَلْتُمْ بِهِنَّ وَقَالَ ابْنُ عَبَّاسٍ الدُّخُولُ وَالْمَسِيسُ وَاللِّمَاسُ هُوَ الْجِمَاعُ وَمَنْ قَالَ بَنَاتُ وَلَدِهَا مِنْ بَنَاتِهِ فِي التَّحْرِيمِ لِقَوْلِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِأُمِّ حَبِيبَةَ لَا تَعْرِضْنَ عَلَيَّ بَنَاتِكُنَّ وَلَا أَخَوَاتِكُنَّ وَكَذَلِكَ حَلَائِلُ وَلَدِ الْأَبْنَاءِ هُنَّ حَلَائِلُ الْأَبْنَاءِ وَهَلْ تُسَمَّى الرَّبِيبَةَ وَإِنْ لَمْ تَكُنْ فِي حَجْرِهِ وَدَفَعَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَبِيبَةً لَهُ إِلَى مَنْ يَكْفُلُهَا وَسَمَّى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ابْنَ ابْنَتِهِ ابْنًا

Narrated Jabir: Allah's Apostle forbade that a woman should be married to man along with her paternal or maternal aunt.

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ حَدَّثَنَا اللَّيْثُ عَنْ عُقَيْلٍ عَنْ ابْنِ شِهَابٍ أَنَّ عُرْوَةَ بْنَ الزُّبَيْرِ أَخْبَرَهُ أَنَّ زَيْنَبَ بِنْتَ أَبِي سَلَمَةَ أَخْبَرَتْهُ أَنَّ أُمَّ حَبِيبَةَ قَالَتْ قُلْتُ يَا رَسُولَ اللَّهِ انْکِحْ أُخْتِي بِنْتَ أَبِي سُفْيَانَ قَالَ وَتُحِبِّينَ قُلْتُ نَعَمْ لَسْتُ لَکَ بِمُخْلِيَةٍ وَأَحَبُّ مَنْ شَارَکَنِي فِي خَيْرٍ أُخْتِي فَقَالَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّ ذَلِکِ لَا يَحِلُّ لِي قُلْتُ يَا رَسُولَ اللَّهِ فَوَاللَّهِ إِنَّا لَنَتَحَدَّثُ أَنَّکَ تُرِيدُ أَنْ تَنْکِحَ دُرَّةَ بِنْتَ أَبِي سَلَمَةَ قَالَ بِنْتَ أُمِّ سَلَمَةَ فَقُلْتُ نَعَمْ قَالَ فَوَاللَّهِ لَوْ لَمْ تَکُنْ فِي حَجْرِي مَا حَلَّتْ لِي إِنَّهَا لَابْنَةُ أَخِي مِنْ الرَّضَاعَةِ أَرْضَعَتْنِي وَأَبَا سَلَمَةَ ثُوَيْبَةُ فَلَا تَعْرِضْنَ عَلَيَّ بَنَاتِکُنَّ وَلَا أَخَوَاتِکُنَّ

Narrated Abu Huraira: Allah's Apostle said, "A woman and her paternal aunt should not be married to the same man; and similarly, a woman and her maternal aunt should not be married to the same man."

حَدَّثَنَا عَبْدَانُ أَخْبَرَنَا عَبْدُ اللَّهِ أَخْبَرَنَا عَاصِمٌ عَنْ الشَّعْبِيِّ سَمِعَ جَابِرًا رَضِيَ اللَّهُ عَنْهُ قَالَ نَهَی رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ تُنْکَحَ الْمَرْأَةُ عَلَی عَمَّتِهَا أَوْ خَالَتِهَا وَقَالَ دَاوُدُ وَابْنُ عَوْنٍ عَنْ الشَّعْبِيِّ عَنْ أَبِي هُرَيْرَةَ

Narrated Abu Huraira: The Prophet forbade that a woman should be married to a man along with her paternal aunt or with her maternal aunt (at the same time). Az-Zuhri (the sub-narrator) said: There is a similar order for the paternal aunt of the father of one's wife, for 'Urwa told me that `Aisha said, "What is unlawful because of blood relations, is also unlawful because of the corresponding foster suckling relations."
