[ 15153 ] أخبرنا أبو سعيد بن أبي عمرو نا أبو العباس الأصم أنا الربيع قال قلت للشافعي رضى الله تعالى عنه فهل خالفك في هذا غيرنا قال نعم بعض المشرقيين قلت فما كانت حجتهم قال كانت حجتهم أن قالوا انتفى عمر رضى الله تعالى عنه من ولد جارية له وانتفى زيد بن ثابت رضى الله تعالى عنه من ولد جارية له وانتفى بن عباس رضى الله تعالى عنهما من ولد جارية قلت فما كانت حجتك عليهم يعني جوابك قال أما عمر رضى الله تعالى عنه فروي عنه أنه أنكر حمل جارية له أقرت بالمكروه وأما زيد بن ثابت وابن عباس رضى الله تعالى عنهما فإنهما أنكرا إن كانا فعلا ولد جاريتين عرفا ان ليس منهما فحلال لهما وكذلك لزوج الحرة إذ علم أنها حبلت من الزنا أن يدفع ولدها ولا يلحق بنسبه من ليس منه فيما بينه وبين الله عز وجل وتكلم عليه بما يطول ذكره ههنا

[ 15154 ] أخبرنا أبو حازم الحافظ أنا أبو الحسن بن حمزة الهروي أنا أحمد بن نجدة نا سعيد بن منصور نا هشيم عن الشيباني أخبرني عمران بن كثير النخعي أن عبيد الله بن الحر تزوج جارية من قومه يقال لها الدرداء زوجها إياه أبوه فانطلق عبيد الله فلحق بمعاوية فأطال الغيبة على امرأته ومات أبو الجارية فزوجها أهلها من رجل منهم يقال له عكرمة فبلغ ذلك عبيد الله فقدم فخاصمهم إلى علي رضى الله تعالى عنه فرد عليه المرأة وكانت حاملا من عكرمة فوضعها على يدي عدل فقالت المرأة لعلي رضى الله تعالى عنه أنا أحق بمالي أو عبيد الله بن الحر فقال بل أنت أحق بذلك قالت فأشهدك أن كل ما كان لي على عكرمة من شيء من صداق فهو له فلما وضعت ما في بطنها ردها إلى عبيد الله بن الحر وألحق الوليد با بیہ واللہ اعلم
