أَخْبَرَنَا عَلِيُّ بْنُ حُجْرٍ قَالَ أَنْبَأَنَا يَزِيدُ بْنُ هَارُونَ عَنْ هَمَّامٍ عَنْ قَتَادَةَ عَنْ أَنَسِ بْنِ مَالِکٍ قَالَ خَرَجَتْ جَارِيَةٌ عَلَيْهَا أَوْضَاحٌ فَأَخَذَهَا يَهُودِيٌّ فَرَضَخَ رَأْسَهَا وَأَخَذَ مَا عَلَيْهَا مِنْ الْحُلِيِّ فَأُدْرِکَتْ وَبِهَا رَمَقٌ فَأُتِيَ بِهَا رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ مَنْ قَتَلَکِ فُلَانٌ قَالَتْ بِرَأْسِهَا لَا قَالَ فُلَانٌ قَالَ حَتَّی سَمَّی الْيَهُودِيَّ قَالَتْ بِرَأْسِهَا نَعَمْ فَأُخِذَ فَاعْتَرَفَ فَأَمَرَ بِهِ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَرُضِخَ رَأْسُهُ بَيْنَ حَجَرَيْنِ

It was narrated that Anas bin Malik said: “A girl went out wearing some jewelry and a Jew caught her, crushed her head between two rocks and took the jewelry that she was wearing. She was found as she was breathing her last, and she was brought to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم who said: ‘Who killed you? Was it so and so? and he continued asking until he named the Jew, and she gestured yes with her head. He was caught and he confessed (to his crime) then the Messenger of Allah صلی اللہ علیہ وآلہ وسلم ordered that his head be crushed between two rocks.”(Sahih)

أَخْبَرَنَا أَحْمَدُ بْنُ حَفْصِ بْنِ عَبْدِ اللَّهِ قَالَ حَدَّثَنِي أَبِي قَالَ حَدَّثَنِي إِبْرَاهِيمُ عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ عَنْ عُبَيْدِ بْنِ عُمَيْرٍ عَنْ عَائِشَةَ أُمِّ الْمُؤْمِنِينَ عَنْ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ لَا يَحِلُّ قَتْلُ مُسْلِمٍ إِلَّا فِي إِحْدَی ثَلَاثِ خِصَالٍ زَانٍ مُحْصَنٌ فَيُرْجَمُ وَرَجُلٌ يَقْتُلُ مُسْلِمًا مُتَعَمِّدًا وَرَجُلٌ يَخْرُجُ مِنْ الْإِسْلَامِ فَيُحَارِبُ اللَّهَ عَزَّ وَجَلَّ وَرَسُولَهُ فَيُقْتَلُ أَوْ يُصَلَّبُ أَوْ يُنْفَی مِنْ الْأَرْضِ

It was narrated from ‘Aishah, the Mother of the Believers, that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “It is not permissible to kill a Muslim except in one of three cases: A adulterer who has been married, who is to be stoned; a man who kills a Muslim deliberately; and a man who leaves Islam and wages war against Allah, the Mighty and Sublime, and His Messenger, who is to be killed, crucified or banished from the land.” (Sahih)

أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ مُطَرِّفِ بْنِ طَرِيفٍ عَنْ الشَّعْبِيِّ قَالَ سَمِعْتُ أَبَا جُحَيْفَةَ يَقُولُ سَأَلْنَا عَلِيًّا فَقُلْنَا هَلْ عِنْدَکُمْ مِنْ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ شَيْئٌ سِوَی الْقُرْآنِ فَقَالَ لَا وَالَّذِي فَلَقَ الْحَبَّةَ وَبَرَأَ النَّسَمَةَ إِلَّا أَنْ يُعْطِيَ اللَّهُ عَزَّ وَجَلَّ عَبْدًا فَهْمًا فِي کِتَابِهِ أَوْ مَا فِي هَذِهِ الصَّحِيفَةِ قُلْتُ وَمَا فِي الصَّحِيفَةِ قَالَ فِيهَا الْعَقْلُ وَفِکَاکُ الْأَسِيرِ وَأَنْ لَا يُقْتَلَ مُسْلِمٌ بِکَافِرٍ

It was narrated that Ash-Sha’bi said: “I heard Abu Juhaifah say: ‘We asked ‘All: “Do you have anything from the Messenger of Allah صلی اللہ علیہ وآلہ وسلم apart from the Qur’an?” He said: “No, by the One who splits the seeds and creates the soul, unless Allah gives a slave understanding of His Book, or except this sheet.” I said: “What is in the sheet?” He said: “In it are (the regulations concerning) blood money and the freeing of captives, and (the rule) that no Muslim should be killed for killing a disbeliever.” (Sahih)

أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا الْحَجَّاجُ بْنُ مِنْهَالٍ قَالَ حَدَّثَنَا هَمَّامٌ عَنْ قَتَادَةَ عَنْ أَبِي حَسَّانَ قَالَ قَالَ عَلِيٌّ مَا عَهِدَ إِلَيَّ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ بِشَيْئٍ دُونَ النَّاسِ إِلَّا فِي صَحِيفَةٍ فِي قِرَابِ سَيْفِي فَلَمْ يَزَالُوا بِهِ حَتَّی أَخْرَجَ الصَّحِيفَةَ فَإِذَا فِيهَا الْمُؤْمِنُونَ تَکَافَأُ دِمَاؤُهُمْ يَسْعَی بِذِمَّتِهِمْ أَدْنَاهُمْ وَهُمْ يَدٌ عَلَی مَنْ سِوَاهُمْ لَا يُقْتَلُ مُؤْمِنٌ بِکَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِهِ

It was narrated that Abu Hassan said: “Ali said: ‘The Messenger of Allah صلی اللہ علیہ وآلہ وسلم did not tell me anything that he did not tell the peoPle except what is in a sheet in the sheath of my sword.’ They did ot leave him alone until he brought out the sheet, and in it (were the words): ‘The lives of the believers are equal in value, and they hasten to support the asylum granted by the least of them, and they are one against others. But no believer may be killed in return for a disbeliever, nor one with a covenant while his covenant is in effect.” (Sahih)

أَخْبَرَنَا أَحْمَدُ بْنُ حَفْصٍ قَالَ حَدَّثَنِي أَبِي قَالَ حَدَّثَنِي إِبْرَاهِيمُ بْنُ طَهْمَانَ عَنْ الْحَجَّاجِ بْنِ الْحَجَّاجِ عَنْ قَتَادَةَ عَنْ أَبِي حَسَّانَ الْأَعْرَجِ عَنْ الْأَشْتَرِ أَنَّهُ قَالَ لِعَلِيٍّ إِنَّ النَّاسَ قَدْ تَفَشَّغَ بِهِمْ مَا يَسْمَعُونَ فَإِنْ کَانَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ عَهِدَ إِلَيْکَ عَهْدًا فَحَدِّثْنَا بِهِ قَالَ مَا عَهِدَ إِلَيَّ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ عَهْدًا لَمْ يَعْهَدْهُ إِلَی النَّاسِ غَيْرَ أَنَّ فِي قِرَابِ سَيْفِي صَحِيفَةً فَإِذَا فِيهَا الْمُؤْمِنُونَ تَتَکَافَأُ دِمَاؤُهُمْ يَسْعَی بِذِمَّتِهِمْ أَدْنَاهُمْ لَا يُقْتَلُ مُؤْمِنٌ بِکَافِرٍ وَلَا ذُو عَهْدٍ فِي عَهْدِهِ مُخْتَصَرٌ

It was narrated from Al Ashtar that he said to ‘Ali: “What the people have been hearing from you has become widespread. If the Messenger of Allah صلی اللہ علیہ وآلہ وسلم told you anything, then tell us.” He said: “The Messenger of Allah صلی اللہ علیہ وآلہ وسلم did not tell me anything that he did not tell the people, except that in the sheath of my sword there is a sheet, in which it says: ‘The lives of the believers are equal in value, and they hasten to support the asylum granted by the least of them. But no believer may be killed in return for a disbeliever, nor one with a covenant while his covenant is in effect.” It is an abridgement of it. (Sahih).

أَخْبَرَنَا إِسْمَعِيلُ بْنُ مَسْعُودٍ قَالَ حَدَّثَنَا خَالِدٌ عَنْ عُيَيْنَةَ قَالَ أَخْبَرَنِي أَبِي قَالَ قَالَ أَبُو بَکْرَةَ قَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ قَتَلَ مُعَاهِدًا فِي غَيْرِ کُنْهِهِ حَرَّمَ اللَّهُ عَلَيْهِ الْجَنَّةَ

Abb Bakrah said: “The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: ‘Whoever kills a Mu‘ahad with no justification, Allah will forbid Paradise to him.” (Sahih)

أَخْبَرَنَا الْحُسَيْنُ بْنُ حُرَيْثٍ قَالَ حَدَّثَنَا إِسْمَعِيلُ عَنْ يُونُسَ عَنْ الْحَکَمِ بْنِ الْأَعْرَجِ عَنْ الْأَشْعَثِ بْنِ ثُرْمُلَةَ عَنْ أَبِي بَکْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ قَتَلَ نَفْسًا مُعَاهِدَةً بِغَيْرِ حِلِّهَا حَرَّمَ اللَّهُ عَلَيْهِ الْجَنَّةَ أَنْ يَشُمَّ رِيحَهَا

It was narrated that Abu Bakrah said: The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Whoever kills a Mu’ahad with no justification, Allah will forbid Paradise to him and he will not even smell its fragrance.” (Sahih)

أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلَانَ قَالَ حَدَّثَنَا النَّضْرُ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ مَنْصُورٍ عَنْ هِلَالِ بْنِ يَسَافٍ عَنْ الْقَاسِمِ بْنِ مُخَيْمِرَةَ عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قَتَلَ رَجُلًا مِنْ أَهْلِ الذِّمَّةِ لَمْ يَجِدْ رِيحَ الْجَنَّةِ وَإِنَّ رِيحَهَا لَيُوجَدُ مِنْ مَسِيرَةِ سَبْعِينَ عَامًا

It was narrated from Al Qasim bin Al-Mukhaimirah, from a man among the Companions of the Prophet صلی اللہ علیہ وآلہ وسلم , that the Prophet صلی اللہ علیہ وآلہ وسلم said: “Whoever kills a man from among Ahi Adh-Dhjmmaht he will not smell the fragrance of Paradise, and its fragrance may be detected from a distance of seventy years.” (Sahih)

It was narrated that ‘Abdullah bin ‘Amr said: “The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: ‘Whoever kills a person from among Ahi Adh-Dhimmah, he will not smell the fragrance of Paradise, and its fragrance may be detected from a distance of forty years.” (Sahih)

أَخْبَرَنَا إِسْحَقُ بْنُ إِبْرَاهِيمَ قَالَ أَنْبَأَنَا مُعَاذُ بْنُ هِشَامٍ قَالَ حَدَّثَنِي أَبِي عَنْ قَتَادَةَ عَنْ أَبِي نَضْرَةَ عَنْ عِمْرَانَ بْنِ حُصَيْنٍ أَنَّ غُلَامًا لِأُنَاسٍ فُقَرَائَ قَطَعَ أُذُنَ غُلَامٍ لِأُنَاسٍ أَغْنِيَائَ فَأَتَوْا النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَمْ يَجْعَلْ لَهُمْ شَيْئًا

It was narrated from ‘Imran bin Husain that a slave belonging to some poor people cut off the ear of a slave belonging to some rich people. They came to the Prophet صلی اللہ علیہ وآلہ وسلم but he did not give them anything. (Da’if)

أَخْبَرَنَا إِسْحَقُ بْنُ إِبْرَاهِيمَ قَالَ أَنْبَأَنَا أَبُو خَالِدٍ سُلَيْمَانُ بْنُ حَيَّانَ قَالَ حَدَّثَنَا حُمَيْدٌ عَنْ أَنَسٍ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَی بِالْقِصَاصِ فِي السِّنِّ وَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کِتَابُ اللَّهِ الْقِصَاصُ

It was narrated from Anas that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم ruled that Qisas should be given for a tooth. The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “What Allah has decreed is retaliation.” (Sahlh)

أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّی قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ قَتَادَةَ عَنْ الْحَسَنِ عَنْ سَمُرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَ عَبْدَهُ جَدَعْنَاهُ

It was narrated from Samurah that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Whoever kills his slave, we will kill him, and whoever mutilates his slave, we will mutilate him.” (Hasan)
