[5495] أخبرنا أبو سعيد محمد بن موسى بن الفضل الصيرفي من أصل سماعه، ثنا أبو عبد الله الصفار، ثنا أحمد بن مهران الأصفهاني، ثنا أبو نعيم - يعني عبد الرحمن بن هانئ النخعي - أنا العلاء بن كثير، عن مكحول، عن أبي الدرداء، وعن واثلة، وعن أبي أمامة؛ كلهم يقول: سمعنا رسول الله - صلى الله عليه وسلم - وهو على المنبر يقول: "جنبوا مساجدكم صبيانكم، ومجانينكم، وخصوماتكم، ورفع أصواتكم، وسل سيوفكم، وإقامة حدودكم، وأجمروها (1) في الجمع، واتخذوا على أبواب مساجدكم مطاهر (2) " (3).تابعه عثمان بن عبد الرحمن عن مكحول، عن أبي أمامة، في بعض هذه الألفاظ.

[5496] أخبرنا الأستاذ أبو بكر محمد بن الحسن بن فورك الشهيد - رحمه الله -، أنا عبد الله بن جعفر، ثنا يونس بن حبيب، ثنا أبو داود الطيالسي، ثنا شعبة، أخبرني أبو عون الثقفي قال: سمعت الحارث بن عمرو يحدث عن أصحاب معاذ من أهل حمص، قال: - وقال مرة: عن معاذ - إن رسول الله - صلى الله عليه وسلم - لما بعث معاذا إلى اليمن قال له: "كيف تقضي إذا عرض لك قضاء؟ ".قال: أقضي بكتاب الله. قال: "فإن لم تجده في كتاب الله؟ ". قال: أقضي بسنة رسول الله - صلى الله عليه وسلم -. قال: "فإن لم تجده في سنة رسول الله - صلى الله عليه وسلم -؟ ". قال: أجتهد رأيي لا آلو. قال: فضرب بيده في صدره، وقال: "الحمد لله الذي وفق رسول رسول الله (1) - صلى الله عليه وسلم - لما يرضي رسول الله" (2).تابعه يحيى بن سعيد القطان الإمام - رحمه الله -، عن شعبة، وقال: عن ناس من أصحاب معاذ، عن معاذ - رضي الله عنه - (3).

[5497] أخبرنا أبو علي الحسين بن محمد الروذباري، أنا محمد بن بكر، ثنا أبو داود السجستاني، ثنا عمرو بن عون (4)، أنا شريك، عن سماك، عن حنش، عن علي - رضي الله عنه - قال: بعثني رسول الله - صلى الله عليه وسلم - إلى اليمن قاضيا، فقلت: يا رسول الله، ترسلني وأنا حديث السن ولا علم لي بالقضاء؟ فقال: "إن الله - عز وجل - ثناؤه - سيهدي قلبك ويثبت لسانك، فإذا جلس بين يديك الخصمان فلا تقضين حتى تسمع من الآخر كما سمعت من الأول؛ فإنه أحرى أن يتبين لك القضاء". قال: فما زلت قاضيا، أو ما (5) شككت في قضاء بعد (6). لو (1) جاز الحكم بالتقليد لأخبره بذلك، وإحالته إياه على اجتهاده دون تقليد غيره فيما أشكل عليه دليل امتناع جواز الحكم بالتقليد، والله أعلم.

[5498] أخبرنا أبو عبد الله محمد بن عبد الله الحافظ - رحمه الله -، أنا أبو عبد الله محمد بن عبد الله بن دينار، ثنا محمد بن أحمد بن أنس القرشي، ثنا عبد الله بن يزيد المقرئ، ثنا حيوة، حدثني يزيد بن عبد الله بن الهاد، عن محمد بن إبراهيم بن الحارث، عن بسر بن سعيد (2)، عن أبي قيس مولى عمرو بن العاص - رضي الله عنه -، [عن عمرو بن العاص] (3) أنه سمع رسول الله - صلى الله عليه وسلم - يقول: "إذا حكم الحاكم فاجتهد فأصاب فله أجران (4)، وإذا حكم الحاكم فاجتهد فأخطأ فله أجر".قال (5): فحدثت بهذا الحديث أبا بكر بن عمرو بن حزم، فقال: هكذا حدثني أبو سلمة بن عبد الرحمن عن أبي هريرة، عن النبي - صلى الله عليه وسلم -.أخرجه البخاري في الصحيح عن عبد الله بن يزيد المقرئ (6). وأخرجه مسلم من حديث الليث وعبد [العزيز] (7) بن محمد، عن ابن الهاد (8).

[5499] أخبرنا الحسين بن محمد بن علي (1) الروذباري، أنا أبو بكر بن داسة، ثنا أبو داود، ثنا محمد بن حسان السمتي، ثنا خلف بن خليفة، عن أبي هاشم، عن ابن بريدة، عن أبيه، عن النبي - صلى الله عليه وسلم - قال:"القضاة ثلاثة: واحد في الجنة، واثنان في النار؛ فأما الذي في الجنة؛ فرجل عرف الحق فقضى به، ورجل عرف الحق فجار في الحكم، ورجل قضى للناس على جهل؛ فهما في النار" (2).

[5500] حدثنا الشريف أبو الحسن العلوي، أنا أبو الطيب محمد بن علي بن الحسين (3) الصوفي الزاهد، ثنا سهل بن (4) عمار، ثنا معلى بن منصور، ثنا خلف، عن أبي هاشم - وهو الرماني - عن ابن بريدة، عن أبيه قال: قال رسول الله - صلى الله عليه وسلم -: "القضاة ثلاثة: اثنان في النار وواحد في الجنة؛ رجل علم فقضى بما علم (5) فهو في الجنة، ورجل علم فقضى بغير ما علم فهو في النار، ورجل جهل فقضى بالجهل فهو في النار" (6). وروي عن سعد (1) بن عبيدة عن ابن بريدة (2).

[5501] أخبرنا عبد الله بن يوسف، أنا أبو بكر عثمان بن محمد البغدادي، ثنا أبو عثمان الكرخي، ثنا عبد الرحمن بن عمر بن رسته، ثنا معاوية بن صالح، عن أشياخهم أن عمر بن الخطاب - رضي الله عنه - رأى رجلا فقيل: هذا قاضي كذا وكذا، قال: هذا؟ قالوا: نعم. قال: كيف تقضي؟ قال: أقضي بما أعلم وأسأل عما جهلت. فقال عمر: أنت قاض (3).

[5502] أخبرنا محمد بن عبد الله الحافظ، أنا أبو بكر محمد بن عبد الله الشافعي، ثنا إسحاق بن الحسن الحربي، ثنا عثمان بن الهيثم، ثنا عوف، عن الحسن، عن أبي بكرة - رضي الله عنه -، قال: لقد نفعني الله بكلمة سمعتها من رسول الله - صلى الله عليه وسلم - بعدما كدت أن ألحق بأصحاب الجمل فأقاتل معهم، بلغ رسول الله - صلى الله عليه وسلم - أن أهل فارس قد ملكوا عليهم بنت كسرى، فقال: "لن يفلح قوم ولوا أمرهم امرأة".أخرجه البخاري في الصحيح عن عثمان بن الهيثم (4).

[5503] أخبرنا محمد بن عبد الله بن محمد الضبي، ثنا أبو أحمد بكر بن محمد (5) بن حمدان الصيرفي بمرو، ثنا عبد الصمد بن الفضل البلخي، ثنا عبد الله بن عبد الحكم المصري، ثنا بكر بن مضر، عن ابن الهاد، عن عبد الله بن دينار، عن ابن عمر، عن رسول الله - صلى الله عليه وسلم - أنه قال: "يا معشر النساء، أكثرن الاستغفار؛ فإني رأيتكن أكثر أهل النار". فقالت امرأة منهن: فما لنا يا رسول الله أكثر أهل النار؟ قال: "بكثرة اللعن وكفر العشير (1)، وما من (2) ناقصات عقل ودين أغلب لذي اللب منكن". قالت: يا رسول الله، وما نقصان العقل والدين؟ قال: "أما نقصان العقل؛ فشهادة امرأتين تعدل (3) شهادة رجل، فهذا من نقصان العقل، وتمكث (4) الليالي لا تصلي وتفطر في رمضان، فهذا نقصان الدين".أخرجه مسلم في الصحيح عن أبي الطاهر عن ابن وهب، عن بكر بن مضر (5). وأخرجه البخاري من حديث أبي سعيد الخدري - رضي الله عنه - (6).

[5504] أخبرنا أبو عبد الله محمد بن عبد الله الحافظ، أخبرني أبو النضر الفقيه، ثنا عثمان بن سعيد الدارمي، ثنا محمد بن كثير العبدي، أنا سفيان، عن هشام، عن أبيه، عن عائشة - رضي الله عنها -؛ أن هندا قالت للنبي - صلى الله عليه وسلم -: إن أبا سفيان رجل شحيح، أعلي جناح أن آخذ ماله؟ قال: "خذي ما يكفيك وولدك بالمعروف".أخرجه البخاري في الصحيح عن محمد بن كثير (3)، وأخرجه مسلم من أوجه عن هشام (4).

[5505] أخبرناه أبو بكر أحمد بن الحسن (5) الحرشي، ثنا أبو العباس محمد بن يعقوب، أنا الربيع بن سليمان، أنا الشافعي - رحمه الله -، أنا أنس بن عياض، عن هشام بن عروة، عن أبيه، عن عائشة - رضي الله عنها - أنها حدثته؛ أن هندا أم معاوية جاءت إلى النبي - صلى الله عليه وسلم - فقالت: يا رسول الله، إن أبا سفيان رجل شحيح، وإنه لا يعطيني ما يكفيني وولدي إلا ما أخذت منه سرا وهو لا يعلم، فهل علي [في] ذلك من شيء؟ فقال النبي - صلى الله عليه وسلم -: "خذي ما يكفيك وولدك بالمعروف" (1).

عائشة أنها حدثته؛ أن هندا أم معاوية جاءت إلى النبي فقالت: ← أَبِيهِ ← هِشَامُ بْنُ عُرْوَةَ، ← أَنَسَ بْنَ عِيَاضٍ ← الشَّافِعِیُّ ← الرَّبِيعُ بْنُ سُلَيْمَانَ، ← أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ← أبو بكر أحمد بن الحسن الحرشي،

[5506] أخبرنا أبو عبد الله محمد بن عبد الله الحافظ - رحمه الله -، أخبرني أبو النضر الفقيه، ثنا عثمان بن سعيد الدارمي (ح) وأخبرنا أبو عبد الله، أنا بكر بن محمد بن حمدان الصيرفي، ثنا إسماعيل بن إسحاق القاضي، قالا: ثنا سليمان بن حرب، ثنا حماد بن زيد، عن أيوب (2)، عن أبي رجاء مولى أبي قلابة، قال: كان أبو قلابة عند عمر بن عبد العزيز فسألهم عن القسامة، فقالوا: أقاد بها رسول الله - صلى الله عليه وسلم - وأبو بكر والخلفاء - رضي الله عنهم -.فقال: ما تقول يا أبا قلابة؟ قال: كان عندك رءوس الأجناد وأشراف العرب، يشهد رجلان من أهل حمص على رجل من أهل دمشق أنه سرق ولم يروه، أكنت تقطعه؟ قال:لا (3). [قال] (4): فشهد أربعة من أهل دمشق على رجل من أهل حمص أنه زنى ولم يروه، أكنت ترجمه؟ قال: لا. قال: فهذا أشبه (5)، والله ما علمنا رسول الله - صلى الله عليه وسلم - قتل أحدا، إلا أن يقتل رجل رجلا فيقتل به.فقال عنبسة بن سعيد: وأين حديث العرنيين؟ فقال أبو قلابة: إياي حدثه أنس بن مالك؛ حدثنا أنس بن مالك أن قوما من عكل أو عرينة قدموا على رسول الله - صلى الله عليه وسلم - فاجتووا (1) المدينة، فأمر لهم رسول الله - صلى الله عليه وسلم - بلقاح وأمرهم أن يشربوا من أبوالها وألبانها، فانطلقوا، فلما صحوا قتلوا راعي رسول الله - صلى الله عليه وسلم - واستاقوا النعم، فبلغ رسول الله - صلى الله عليه وسلم - خبرهم من أول النهار، فبعث في آثارهم، فما ارتفع النهار حتى جيء بهم، فأمر بهم رسول الله - صلى الله عليه وسلم - فقطعت أيديهم وأرجلهم (2) وسمرت (3) أعينهم، وألقوا في الحرة يستسقون فلا يسقون حتى ماتوا، فهؤلاء قوم قتلوا وسرقوا وكفروا بعد إيمانهم.فقال عنبسة:سبحان الله! فقال أبو قلابة: أتتهمني يا عنبسة؟ ! قال: لا والله، ولكن هذا الجند لا يزال بخير ما أبقاك الله بين أظهرهم.لفظ حديث القاضي.أخرجه مسلم في الصحيح عن هارون الحمال، أن (4) سليمان بن حرب (5). وأخرجه البخاري عن سليمان بن حرب، وقال: عن أيوب عن أبي قلابة، بحديث العرنيين (6). حديث عمر - رضي الله عنه - في أسيفع جهينة قد سبق في كتاب الحجر ذكره.
