أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ زَيْدٍ مَوْلَى الْمُنْبَعِثِ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، أَنَّهُ قَالَ: جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَهُ عَنِ اللُّقَطَةِ، فَقَالَ: «اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ عَرِّفْهَا سَنَةً، فَإِنْ جَاءَ صَاحِبُهَا وَإِلا فَشَأْنُكَ بِهَا» .

Tell us Shafei may Allah be pleased with him, said: Tell us Malik from Rabia ibn Abi Abd al-Rahman, Zayd sire emitted from Zayd ibn Khalid Juhani, he said: A man came to the Messenger of Allah peace be upon him, and asks him about the snapshot, he said: «I know He defied her and her worms, then defines them for a year. أَخْبَرَنَا مَالِكٌ، عَنْ أَيُّوبَ بْنِ مُوسَى، عَنْ مُعَاوِيَةَ بْنِ عُبَيْدِ اللَّهِ بْنِ بَدْرٍ: أَنَّ أَبَاهُ أَخْبَرَهُ أَنَّهُ نَزَلَ مَنْزِلا بِطَرِيقِ الشَّامِ، فَوَجَدَ صُرَّةً فِيهَا ثَمَانُونَ دِينَارًا، فَذَكَرَ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ عُمَرُ: عَرِّفْهَا عَلَى أَبْوَابِ الْمَسْجِدِ، وَاذْكُرْهَا لِمَنْ يَقْدَمُ مِنَ الشَّامِ سَنَةً، فَإِذَا مَضَتِ السَّنَةُ فَشَأْنُكَ بِهَا.

Tell us Malik from Ayyub ibn Musa, from Sid bin Obeid-Allah ibn Badr: that his father told him that he came down a house by way of the Levant, and found a hub where eighty dinars, stated that Omar ibn al-Khattab may Allah be pleased with him, Umar said: known at the gates of the mosque, and mention them to those who He offers a year from the Levant, so if the year has passed, He will give you the pleasure of it.

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ: أَنَّ رَجُلا وَجَدَ لَقُطَةً، فَجَاءَ إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، فَقَالَ: إِنِّي وَجَدْتُ لُقَطَةً، فَمَاذَا تَرَى؟ فَقَالَ لَهُ ابْنُ عُمَرَ: عَرِّفْهَا. قَالَ: قَدْ فَعَلْتُ. قَالَ: زِدْ. قَالَ: قَدْ فَعَلْتُ. قَالَ: لا آمُرُكَ أَنْ تَأْكُلَهَا، وَلَوْ شِئْتَ لَمْ تَأْخُذْهَا. أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.س

Malik told us, on the authority of Nafi`, that a man found a cat, so he came to Abd Allah ibn Umar, and he said: “I found it, and found it, then?” Ibn Omar said to him: Introduce her. He said: I did. He said: increase. He said: I did. He said: I do not command you to eat it, and if you wish you would not take it. He included the three hadiths in the book of the difference of Malik and Shafi’i.
