أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ أَبِي يَحْيَى، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ قَالَ: الْمُولِي الَّذِي يَحْلِفُ لا يَقْرَبُ امْرَأَتَهُ أَبَدًا.

Tell us Shafei may Allah be pleased with him, said: Tell us Sufian bin appointment, Amr ibn Dinar from Abu Yahya, from Ibn Abbas, may Allah be pleased with him, he said: Mawla, who does not swear almost never his wife.

أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، قَالَ: أَدْرَكْتُ بِضْعَةَ عَشَرَ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كُلُّهُمْ يُوقِفُ الْمُولِي. قَالَ الشَّافِعِيُّ: فَأَقَلُّ بِضْعَةَ عَشَرَ أَنْ يَكُونُوا ثَلاثَةَ عَشَرَ، وَهُوَ يَقُولُ: مِنَ الأَنْصَارِ.

Tell us Sufian bin appointment, Yahya ibn Said from Sulayman ibn Yasar, he said: I realized a few ten of the companions of the Prophet peace be upon him, all stop molar. Al-Shafi’i said: So few fewer than ten to be thirteen, and he says: Al-Ansar.

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، قَالَ: أَدْرَكْتُ بِضْعَةَ عَشَرَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، كُلُّهُمْ يُوقِفُ الْمُولِي.

Ibn 'Uainah told us about Yahya bin Said, about Solomon bin Yasar, who said: I realized a few ten companions of his companions.

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ أَبِي إِسْحَاقَ الشَّيْبَانِيِّ، عَنِ الشَّعْبِيِّ، عَنْ عَمْرِو بْنِ سَلَمَةَ، قَالَ: شَهِدْتُ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ أَوْقَفَ الْمُولِيَ.

Ibn Aainah told us, on the authority of Abi Ishaq Al-Shaybani, on the authority of Al-Sha'bi, on the authority of Amr ibn Salamah, who said: I witnessed it against God.

Ibn 'Uainah, on the authority of Laith, on the authority of Mujahid, told us about Marawan ibn al-Hakam: that Ali, may God be pleased with him, had stopped the money.

أَخْبَرَنَا سُفْيَانُ، عَنْ أَبِي الزِّنَادِ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، قَالَ: كَانَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا، إِذَا ذُكِرَ لَهَا الرَّجُلُ يَحْلِفُ أَنْ لا يَأْتِيَ امْرَأَتَهُ فَيَدَعَهَا خَمْسَةَ أَشْهُرٍ لا تَرَى ذَلِكَ شَيْئًا حَتَّى يُوقِفَ. وَتَقُولُ: كَيْفَ قَالَ اللَّهُ تَعَالَى: {فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة: 229] .

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ أَنَّهُ قَالَ: إِذَا آلَى الرَّجُلُ مِنَ امْرَأَتِهِ لَمْ يَقَعْ عَلَيْهَا طَلاقٌ، وَإِنْ مَضَتْ أَرْبَعَةُ أَشْهُرٍ حَتَّى يُوقِفَ، فَإِمَّا أَنْ يُطَلِّقَ وَإِمَّا أَنْ يَفِيءَ.

Tell us Malik from Nafi from Ibn 'Umar said: If a man to his wife did not divorce it is located, and four months ago even stop, either to release or to Eve.

أَخْبَرَنَا مَالِكٌ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ: أَنَّ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ كَانَ يُوقِفُ الْمُولِي. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْيَمِينِ مَعَ الشَّاهِدِ، وَإِلَى آخِرِ الثَّامِنِ مِنْ كِتَابِ الصَّدَاقِ وَالإِيلاءِ وَهِيَ آخِرُ مَا فِيهِ.

Malik, on the authority of Jaafar bin Muhammad, told us about his father: that Ali, may God be pleased with him, was stopping the Mawlis. Take the two hadiths from the Book of Right Hand with the Witness, and to the end of the eighth from the Book of Dowry and Elijah, which is the last of it.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرَةَ أَخْبَرَتْهُ: أَنَّ حَبِيبَةَ بِنْتَ سَهْلٍ أَخْبَرَتْهَا: أَنَّهَا كَانَتْ عِنْدَ ثَابِتِ بْنِ قَيْسِ بْنِ شَمَّاسٍ وَأَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ إِلَى صَلاةِ الصُّبْحِ، فَوَجَدَ حَبِيبَةَ بِنْتَ سَهْلٍ عِنْدَ بَابِهِ فِي الْغَلَسِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ هَذِهِ» ؟ فَقَالَتْ: أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ يَا رَسُولَ اللَّهِ، فَقَالَ: «مَا شَأْنُكِ» ؟ قَالَتْ: لا أَنَا وَلا ثَابِتٌ لِزَوْجِهَا، فَلَمَّا جَاءَ ثَابِتُ بْنُ قَيْسٍ قَالَ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «هَذِهِ حَبِيبَةُ بِنْتُ سَهْلٍ، قَدْ ذَكَرَتْ مَا شَاءَ اللَّهُ أَنْ تَذْكُرَ» . فَقَالَتْ حَبِيبَةُ: يَا رَسُولَ اللَّهِ، كُلُّ مَا أَعْطَانِي عِنْدِي. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «خُذْ مِنْهَا» فَأَخَذَ مِنْهَا وَجَلَسَتْ فِي أَهْلِهَا.

Tell us Shafei may Allah be pleased with him, he said: Tell us the owner, Yahya ibn Said from Amra told him: that Habiba girl plain told her: it was when bin Qais bin deacon fixed and that the Messenger of Allah peace be upon him came to the morning prayer, and found Habiba girl easy When he was sitting at his door, the Messenger of God, may God’s prayers and peace be upon him, said: “Who is this?” She said: I am Habiba, an easy girl, O Messenger of God. He said: "What do you want?" She said: No I'm not fixed to her husband, when he fixed bin Qais came to him, said the Messenger of Allah peace be upon him: «This plain girl Habiba, has said God willing, to remember». Habiba said: O Messenger of God, all that He has given me. And the Messenger of God, may God bless him and grant him peace, said: “Take it from her.” So he took it from her and sat in her family.

أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرَةَ، عَنْ حَبِيبَةَ بِنْتِ سَهْلٍ: أَنَّهَا أَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْغَلَسِ وَهِيَ تَشْكُو شَيْئًا بِيَدَيْهَا وَهِيَ تَقُولُ: لا أَنَا وَلا ثَابِتُ بْنُ قَيْسٍ، فَقَالَتْ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «يَا ثَابِتُ خُذْ مِنْهَا» . فَأَخَذَ مِنْهَا وَجَلَسَتْ.

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ مَوْلاةٍ لِصَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا بِكُلِّ شَيْءٍ لَهَا، فَلَمْ يُنْكِرْ ذَلِكَ عَبْدُ اللَّهِ بْنُ عُمَرَ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْخُلْعِ وَالنُّشُوزِ، وَالثَّالِثَ مِنْ كِتَابِ الأَشْرِبَةِ.

Malik told us, on the authority of Nafia, on the authority of Safiya, the daughter of Abi Ubayd, that she had been stripped of her husband with everything, for what you did. Take the two hadiths out of the Book of Khula` and Al-Nushush, and the third from the Book of Shariba.
