أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ، قَالَ: سَمِعْتُ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ وَرَجُلٌ يَسْأَلُهُ عَنْ رَجُلٍ سَلَّفَ فِي سَبَائِكَ، قَالَ الرَّبِيعُ: سَبَائِكَ، فَأَرَادَ أَنْ يَبِيعَهَا قَبْلَ أَنْ يَقْبِضَهَا. قَالَ ابْنُ عَبَّاسٍ: تِلْكَ الْوَرِقُ بِالْوَرِقِ، وَكَرِهَ ذَلِكَ. وَقَالَ مَالِكٌ: وَذَلِكَ فِيمَا نَرَى لأَنَّهُ أَرَادَ أَنْ يَبِيعَهَا مِنْ صَاحِبِهِ الَّذِي اشْتَرَاهُ بِأَكْثَرَ مِنَ الثَّمَنِ الَّذِي ابْتَاعَهَا مِنْهُ، وَلَوْ بَاعَهَا مِنْ غَيْرِ الَّذِي اشْتَرَاهَا مِنْهُ لَمْ يَكُنْ بِبَيْعِهِ بَأْسٌ.

أَخْبَرَنَا سَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ دِينَارٍ: أَنَّ ابْنَ عُمَرَ كَانَ يُجِيزُهُ. أَخْرَجَ الأَوَّلَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَالثَّانِيَ وَالثَّالِثَ مِنْ كِتَابِ الْبُيُوعِ.

أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ مَوْلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: اسْتَسْلَفَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَكْرًا فَجَاءَتْهُ إِبِلُ الصَّدَقَةِ، قَالَ أَبُو رَافِعٍ: فَأَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ، فَقُلْتُ: يَا رَسُولَ اللَّهِ، إِنِّي لَمْ أَجِدْ فِي الإِبِلِ إِلا جَمَلا خِيَارًا رَبَاعِيًّا. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَعْطِهِ إِيَّاهُ، فَإِنَّ خِيَارَ النَّاسِ أَحْسَنُهُمْ قَضَاءً» .

أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَبْدِ الْكَرِيمِ الْجَزَرِيِّ أَخْبَرَهُ، أَنَّ زِيَادَ بْنَ أَبِي تَمِيمٍ مَوْلَى عُثْمَانَ بْنِ عَفَّانَ أَخْبَرَهُ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَ مُصَدِّقًا لَهُ فَجَاءَ بِظَهْرٍ مُسِنَّاتٍ، فَلَمَّا رَآهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «هَلَكْتَ وَأَهْلَكْتَ» . فَقَالَ: يَا رَسُولَ اللَّهِ، إِنِّي قَدْ كُنْتُ أَبِيعُ الْبَكْرَيْنِ وَالثَّلاثَ بِالْبَعِيرِ الْمُسِنِّ يَدًا بِيَدٍ، وَعَلِمْتُ مِنْ حَاجَةِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى الظَّهْرِ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَذَلِكَ إِذَنْ» .
