1805 - (خ، م) - حدثنا محمد بن علي العميري، قال: ثنا علي ابن محمد بن أحمد، قال: أنا أبو علي، قال: ثنا بشر بن موسى، قال: ثنا الحميدي، قال: ثنا سفيان، قال: ثنا عمرو بن دينار: عن سالم، عن أبيه: أن رسول الله صلى الله عليه وسلم قال: ((أيما عبد كان بين اثنين، فأعتق أحدهما نصيبه؛ فإن كان موسرا فإنه يقوم عليه بأغلى القيمة -أو قال: قيمة- لا وكس ولا شطط، ثم يغرم لصاحبه حصته، ثم يعتق))، قال سفيان: كان عمرو يشك فيه هكذا. وفي رواية مالك عن نافع: ((قيمة العدل))، فلم يشك، وكذلك في رواية جرير والليث وعبيد الله، عن نافع. وقال ابن أبي ذئب: عن نافع: ((إن كان موسرا فقد عتق كله)).

1806 - (خ، م) - حدثنا سليمان، قال: ثنا الحسن بن أحمد، قال: ثنا أحمد بن محمد بن زياد، قال: ثنا إسماعيل بن إسحاق، قال: ثنا إسماعيل بن أبي أويس، قال: ثنا مالك، عن هشام بن عروة، عن أبيه: عن عائشة أنها قالت: جاءت بريرة فقالت: إني كاتبت أهلي على تسع أواق؛ كل عام أوقية، فأعينيني، فقالت عائشة: إن أحب أهلك أن أعدها لهم ويكون ولاؤك لي فعلت، فذهبت بريرة إلى أهلها فقالت لهم ذلك، فأبوا عليها، فجاءت من عند أهلها، ورسول الله صلى الله عليه وسلم جالس، فقالت: إني عرضت عليهم ذلك فأبوا إلا أن يكون الولاء لهم، سمع بذلك رسول الله صلى الله عليه وسلم، أو فأخبرت عائشة رسول الله صلى الله عليه وسلم، فقال: ((خذيها، واشترطي لهم الولاء؛ فإن الولاء لمن أعتق))، ففعلت عائشة، ثم قام رسول الله صلى الله عليه وسلم في الناس، فحمد الله وأثنى عليه، ثم قال: ((ما بال رجال يشترطون شروطا ليست في كتاب الله؟! ما كان من شرط ليس في كتاب الله فهو باطل، وإن كان مئة شرط؛ قضاء الله أحق، وشرط الله #524# أوثق؛ إنما الولاء لمن أعتق)). وفي رواية مالك، عن الزهري، عن عروة: ولم تكن قضت من كتابتها شيئا. وفي رواية الأسود، عن عائشة: ((الولاء لمن أعطى الورق وولي النعمة)).

1807 - (خ) - حدثنا محمد بن أحمد بن علي، قال: ثنا أحمد ابن موسى، قال: ثنا أبو القاسم، قال: ثنا علي بن عبد العزيز، قال: ثنا أبو نعيم، قال: ثنا عبد الواحد بن أيمن، قال: حدثني أبي قال: دخلت على عائشة -وكان لعتبة بن أبي لهب، فمات عنه فورثه بنوه، فاشتراه ابن أبي عمرو فأعتقه، واشترط بنو عتبة الولاء- فدخل على عائشة، فذكر ذلك لها، فقالت عائشة: دخلت علي بريرة وهي مكاتبة، فقالت: اشتريني فأعتقيني، فقلت: نعم، فقالت بريرة: إن أهلي لا يبيعونني حتى يشترطوا ولائي، فقالت عائشة: لا حاجة لي بذا، فسمع بذلك رسول الله صلى الله عليه وسلم -أو بلغه-، فذكر ذلك لعائشة، فذكرت عائشة ما قالوا، فقال: ((اشتريها، وأعتقيها ودعيهم فليشترطوا ما شاؤوا))، فاشترتها عائشة وأعتقتها، واشترط أهلها الولاء، فقال رسول الله صلى الله عليه وسلم: ((الولاء لمن أعتق؛ وإن اشترطوا مئة شرط)). في الباب: عن ابن عمر، وأبي هريرة.

1809 - (م) - حدثنا أحمد بن محمد بن عبد الله، قال: ثنا الحسن ابن علي، قال: ثنا عبد الله بن محمد بن جعفر، قال: أنا أبو يعلى، قال: ثنا أبو خيثمة، قال: ثنا روح، قال: ثنا ابن جريج، قال: أنا أبو الزبير: أنه سمع جابرا يقول: كتب النبي صلى الله عليه وسلم أن على كل بطن عقوله، ثم كتب أنه لا يحل أن يتولى مولى رجل مسلم بغير إذنه.

1811 - (خ، م) - حدثنا سليمان، قال: ثنا عثمان بن أحمد بن إسحاق، قال: ثنا محمد بن عمر بن حفص، قال: ثنا إسحاق بن إبراهيم، قال: ثنا محمد بن عبد الله الأنصاري، قال: أنا ابن عوف، عن نافع: عن ابن عمر قال: أصاب عمر أرضا بخيبر، فأتى النبي صلى الله عليه وسلم يستأمره فيها، فقال: يا رسول الله! إني أصبت أرضا بخيبر، ولم أصب مالا قط هو أنفس عندي منه، فما ترى؟ قال: ((إن شئت حبست أهلها وتصدقت بها)). قال: فتصدق بها عمر أنه لا يباع أصلها ولا يوهب ولا يورث، فتصدق بها في الفقراء وفي القربى وفي الرقاب وفي سبيل الله وابن السبيل والضيف؛ لا جناح على من وليها أن يأكل منها بالمعروف، أو يطعم صديقا منه غير متمول فيه. قال ابن عون: فحدثت به ابن سيرين، فقال: (غير متأثل مالا).

1814 - (خ، م) - حدثنا علي بن عبد الرحمن بن عليك، قال: أنا أبو عبد الله، قال: ثنا أحمد بن سليمان الموصلي ببغداد، قال: ثنا علي بن حرب، قال: ثنا سفيان، عن الزهري: عن عامر بن سعد، عن أبيه قال: مرضت عام الفتح مرضا أشرفت منه على الموت، فأتاني رسول الله صلى الله عليه وسلم يعودني، فقلت: يا رسول الله! #529# إن لي مالا كثيرا، وليس يرثني إلا ابنة لي؛ أفأتصدق بثلثي مالي؟ قال: ((لا))، قلت فالشطر؟ قال: لا، قلت: فالثلث، قال: ((الثلث، والثلث كثير؛ إنك إن تترك ورثتك أغنياء، خير من أن تدعهم عالة يتكففون الناس، وإنك لن تنفق نفقة إلا أجرت عليها، حتى اللقمة ترفعها إلى في امرأتك))، قلت: يا رسول الله! أتخلف عن هجرتي، قال: ((إنك لن تخلف بعدي فتعمل عملا تريد به وجه الله إلا ازددت به رفعة ودرجة، ولعلك أن تخلف بعدي حتى ينتفع بك أقوام أو يضر بك أقوام، اللهم أمض لأصحابي هجرتهم، ولا تردهم على أعقابهم، لكن البائس سعد ابن خولة)) يرثي له إن مات بمكة. وفي رواية معمر ومالك ويونس بن يزيد كلهم عن الزهري، قالوا: عام حجة الوداع، بدل قوله: عام الفتح.

1815 - (خ، م) - حدثنا علي بن عبد الرحمن بن الحسن، قال: أنا أبو نعيم الأزهري، قال: أنا أبو عوانة، قال: ثنا موسى بن إسحاق القواس، قال: ثنا وكيع، قال: ثنا هشام بن عروة، عن أبيه: عن ابن عباس رضي الله عنه قال: وددت أن الناس غضوا من الثلث إلى الربع في الوصية؛ فإن رسول الله صلى الله عليه وسلم قال: ((الثلث، والثلث كثير -أو كبير-)).

1816 - (م) - حدثنا عبد الوهاب بن محمد بن إسحاق، قال: أنا أبي، قال: ثنا أحمد بن زكريا المقدسي بها قال: ثنا محمد بن #530# سليمان بن هشام البصري، قال: ثنا إسماعيل بن علية، عن أيوب السختياني، عن أبي قلابة، عن أبي المهلب: عن عمران بن حصين: أن رجلا أعتق ستة مملوكين له عند موته، ولم يكن له مال غيرهم، فجزأهم النبي صلى الله عليه وسلم؛ فأقرع بينهم، فأعتق اثنين وأرق أربعة. وفي رواية أخرى: وقال له قولا شديدا.
