[1728] أخبرنا بصحة ما قال أبو الحسين علي بن محمد بن بشران، أنا علي بن محمد المصري، ثنا محمد بن نافع، ثنا عبد الله بن المغيرة، ثنا مسعر بن كدام. (ح) وأخبرنا الأستاذ أبو طاهر محمد بن محمد بن محمش الفقيه، أنا أبو بكر محمد بن الحسين القطان، ثنا أحمد بن يوسف السلمي، ثنا عبيد الله بن موسى، أنا مسعر، عن عبيد الله بن القبطية، حدثني جابر بن سمرة قال: كنا إذا صلينا خلف النبي - صلى الله عليه وسلم - قلنا بأيدينا السلام عليكم، السلام عليكم، فقال رسول الله - صلى الله عليه وسلم -: "ما هؤلاء الذين يرمون بأيديهم كأنها أذناب الخيل الشمس! أما يكفي أحدكم أن يضع يده على فخذه ثم يسلم على أخيه عن يمينه وعن شماله". لفظ حديث عبيد الله (3) بن موسى. أخرجه مسلم في الصحيح من حديث مسعر هكذا (4). ذكر خبر خامس:

[1732] وعن ابن أبي ليلى، عن الحكم، عن مقسم، عن ابن عباس، قالا: ترفع الأيدي في سبع (7) مواطن: في افتتاح الصلاة، وفي استقبال الكعبة، وعلى الصفا والمروة، وبعرفات، وبجمع، وفي المقامين، وعند الجمرتين. قال الحاكم أبو عبد الله - رحمه الله -: هذا حديث واه (1) من أوجه كثيرة (2): أولها: تفرد ابن أبي ليلى بروايته، وقد اتفق أئمة الحديث على ترك الاحتجاج بروايته. والثاني: رواية وكيع بن الجراح عن ابن أبي ليلى موقوفا على ابن عباس وابن عمر - رضي الله عنهما -، ووكيع أثبت من كل من روى هذا الحديث عن ابن أبي ليلى. والثالث: رواية جماعة من التابعين بالأسانيد الصحيحة المأثورة عن عبد الله بن عمر وعبد الله بن عباس أنهما كانا يرفعان أيديهما عند الركوع وبعد رفع الرأس منه (3)، كما قدمنا ذكره وقد أسنداه عن رسول الله - صلى الله عليه وسلم -. والوجه الرابع: لوهن هذا الحديث: أن شعبة بن الحجاج - رحمه الله - قال: لم يسمع الحكم من مقسم إلا أربعة أحاديث، وليس هذا الحديث منها. والوجه الخامس: أن في جميع هذ الروايات: "ترفع الأيدي في سبع (4) مواطن"، وليس في رواية منها: لا ترفع (5) الأيدي إلا في سبع (6) مواطن، ويستحيل (7) أن يكون: لا ترفع (8) الأيدي إلا في سبع (9) مواطن، وقد تواترت الأخبار المأثورة بأن الأيدي ترفع في مواطن كثيرة غير المواطن السبعة، فمنها الاستسقاء، ودعاء رسول الله - صلى الله عليه وسلم - لدوس، ورفع رسول الله - صلى الله عليه وسلم - يديه في الدعاء في الصلوات وأمره به، ورفع اليدين في القنوت في صلاة الصبح والوتر. قال الإمام أحمد - رحمه الله -: ورواه ابن جريج فقال: حدثت عن مقسم. وبذلك لا تثبت الحجة. ذكر خبر سادس:

[1733] أخبرنا أبو عبد الله الحافظ، أنا أحمد بن محمد بن عبدوس العنزي، ثنا عثمان بن سعيد الدارمي، ثنا يحيى بن يحيى ومسدد والحماني، عن حماد بن زيد، عن بشر بن حرب، عن ابن عمر قال: أرأيتم رفعكم أيديكم في الصلاة هكذا، إنها لبدعة؛ ما زاد رسول الله - صلى الله عليه وسلم - على هذا. ورفع حماد يديه حذو المنكبين أو نحو ذلك (1). قال عثمان بن سعيد: هذا عندهم في الدعاء والوتر، وفي غير ذلك كيف يرفع الأيدي، ولو كان في الصلاة عند الركوع وبعد ما يرفع رأسه من الركوع لكان بخلافه؛ لأنه في صفة الرفع؛ فكيف يرفع؟ وإلى أين يبلغ به؟ وإنما قال: رفعكم أيديكم هكذا في السماء بدعة إلا نحو المنكبين. وقد رواه حماد بن سلمة مفسرا، ووضعه في باب رفع اليدين في الدعاء، لا في باب رفع اليدين في الركوع.

[1734] أخبرنا أبو عبد الله، ثنا أحمد، ثنا عثمان، ثنا أبو سلمة، عن حماد بن سلمة، عن بشر بن حرب، قال: سمعت ابن عمر يقول: والله إن رفعكم أيديكم في السماء لبدعة - يحلف عليها ثلاثا - ما زاد رسول الله - صلى الله عليه وسلم - على هذا. ورفع يديه حذو ثدييه وجعل بطونهما (1) مما يلي الأرض (2). قال عثمان: فهذا دليل على ما ذكرنا أنه في الدعاء، لا في التكبير عند الركوع وما بعد يرفع منه؛ فإن أبيت إلا أن تحتج به كان عليك ولنا؛ لأنه قد أباح رفعهما إلى المنكبين على كل حال، ولو صح هذا عن بشر بن حرب، عن ابن عمر كما رويت عند الركوع لم يكن لك فيه كبير راحة؛ لأن بشر بن حرب ليس له من التقدم في الرواية ما يدفع (3) بروايته رواية الزهري عن سالم، عن أبيه، عن النبي - صلى الله عليه وسلم -، ثم رواية بضعة عشر رجلا عن النبي - صلى الله عليه وسلم -، وفعل أمة من أصحاب محمد - صلى الله عليه وسلم - والتابعين.

[1736] أخبرنا أبو سهل المهراني، أنا أبو الحسين العطار، أخبرني أبو عبد الله النحوي، قال: سمعت محمد بن إسماعيل يقول: بشر بن حرب أبو عمرو الندبي رأيت علي بن المديني يضعفه، يروي عن ابن عمر، يتكلمون فيه، قال علي: كان يحيى لا يروي عنه. هو بصري (4). والذي يدل على أنه ورد في الدعاء ما:

[1737] أخبرنا أبو عبد الله الحافظ، أنا أبو أحمد بكر بن محمد بن حمدان الصيرفي بمرو، ثنا إبراهيم بن هلال البوزنجردي، ثنا علي بن الحسن بن شقيق، ثنا الحسين بن واقد، عن أبي عمرو الندبي بشر بن حرب، قال: حدثني ابن عمر قال: والله ما رفع رسول الله - صلى الله عليه وسلم - يديه فوق صدره في الدعاء. قال أبو عبد الله - رحمه الله -: فهذا الحسين بن واقد على صدقه وإتقانه قد أتى بالمعنى الذي أشرنا إليه، نصا، وفيه غنية عن كل ما يذكر من معنى هذا الحديث. ذكر خبر سابع:

[1739] أخبرنا أبو عبد الله الحافظ، أنا أحمد بن محمد بن موسى البخاري، ثنا محمود بن إسحاق، ثنا محمد بن إسماعيل البخاري، قال: والذي قال أبو بكر بن عياش، عن حصين، عن مجاهد: ما رأيت ابن عمر رافعا يديه في شيء من الصلاة إلا في الافتتاح (1). [1740] أخبرنا أبو عبد الله الحافظ، أنا أحمد بن محمد بن موسى البخاري، ثنا محمود بن إسحاق، ثنا محمد بن إسماعيل البخاري، قال: والذي قال أبو بكر بن عياش، عن حصين، عن مجاهد: ما رأيت ابن عمر يرفع يديه في شيء من الصلاة إلا في التكبيرة الأولى. فقد خولف في ذلك عن مجاهد. قال وكيع: عن الربيع بن صبيح: رأيت مجاهدا يرفع يديه. وقال عبد الرحمن بن مهدي: عن الربيع بن صبيح، قال: رأيت مجاهدا يرفع يديه إذا ركع، وإذا رفع رأسه من الركوع. وقال جرير عن ليث عن مجاهد إنه كان يرفع يديه. وهذا أحفظ عند أهل العلم. وقال صدقة: إن الذي روى حديث مجاهد أنه لم يرفع يديه إلا في أول التكبيرة كان صاحبه قد تغير بأخرة. قال محمد بن إسماعيل البخاري - رحمه الله -: والذي رواه الربيع وليث أولى مع رواية طاوس، وسالم، ونافع، وأبي الزبير، ومحارب بن دثار، وغيرهم، قالوا: رأينا ابن عمر يرفع يديه إذا كبر، وإذا ركع، وإذا رفع (1).

Question (18): And whoever sleeps in the heart and eye, he has to perform his ablution, whether he is standing, lying down, or lying down (1).19. Question (19): A man’s contact with a woman requires ablution (1).20. Question (20): Touching the vulva in the abdomen of the palm invalidates wudoo '(1).
21. Issue (21): vomiting, bleeding, and blood that comes out other than the outcome of the event does not invalidate the ablution (1).
22. Question (22): Laughing does not erode the ablution, whether it is during prayer or outside of prayer (1).
23. Question (23): The emission of the semen necessitates washing, whether it came out in a stream (1) or came out of a stream (2) due to weakness in the body (3).
24. Issue (24): If a person performs ablution before washing it, then it is Sunnah to complete his ablution before doing his ablution. (1)

30. Rule (30): It is not permissible to do tayammum except after the time for prayer begins (1).
31. Rule (31): He should not do tayammum due to severe cold and fear of sickness from using water in Egypt (1).
32. Problem (32): A patient who is not afraid of damage by using water does not do tayammum (1).
33. Rule (33): If some of its members were injured, it should be washed as much as it was able to and performed for the rest (1).
34. Problem (34): There are two sayings regarding wiping over casts (1):
35. Rule (35): There is no valid tayammum in Egypt when there is water for a funeral prayer or for any other purpose, even if one fears missing it (1).
36. Rule (36): To hasten prayer at the beginning of the time with tayammum is better - according to one of the two sayings - than delaying it until the end of the time in the hope of having water (1).
