أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ: أَنَّ يَحْيَى بْنَ حَاطِبٍ حَدَّثَهُ قَالَ: تُوُفِّيَ حَاطِبٌ، فَأَعْتَقَ مَنْ صَلَّى مِنْ رَقِيقِهِ وَصَامَ، وَكَانَتْ لَهُ أَمَةٌ نُوبِيَّةٌ قَدْ صَلَّتْ وَصَامَتْ وَهِيَ أَعْجَمِيَّةٌ، فَلَمْ تَرُعْهُ إِلا بِحَبَلِهَا، وَكَانَتْ ثَيِّبًا، فَذَهَبَ إِلَى عُمَرَ، فَحَدَّثَهُ، فَقَالَ عُمَرُ: لأَنْتَ الرَّجُلُ لا يَأْتِي بِخَيْرٍ، وَأَفْزَعَهُ ذَلِكَ، فَأَرْسَلَ إِلَيْهَا عُمَرُ، فَقَالَ: أَحَبِلْتِ؟ فَقَالَتْ: نَعَمْ مِنْ مَرْعُوشٍ بِدِرْهَمَيْنِ، فَإِذَا هِيَ تَسْتَهِلُّ بِذَلِكَ لا تَكْتُمُهُ. قَالَ: وَصَادَفَهُ عَلِيٌّ وَعُثْمَانُ وَعَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ رَضِيَ اللَّهُ عَنْهُمْ، فَقَالَ: أَشِيرُوا عَلَيَّ، فَكَانَ عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ جَالِسًا فَاضْطَجَعَ، فَقَالَ عَلِيٌّ وَعَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ رَضِيَ اللَّهُ عَنْهُمَا: قَدْ وَقَعَ عَلَيْهَا الْحَدُّ. فَقَالَ: أَشِرْ عَلَيَّ يَا عُثْمَانُ، فَقَالَ: قَدْ أَشَارَ عَلَيْكَ أَخَوَاكَ. فَقَالَ: أَشِرْ عَلَيَّ أَنْتَ. فَقَالَ: أَرَاهَا تَسْتَهِلُّ بِهِ كَأَنَّهَا لا تَعْلَمُهُ، وَلَيْسَ الْحَدُّ إِلا عَلَى مَنْ عَلِمَهُ. فَقَالَ: صَدَقْتَ وَالَّذِي نَفْسِي بِيَدِهِ مَا الْحَدُّ إِلا عَلَى مَنْ عَلِمَهُ، فَجَلَدَهَا عُمَرُ رَضِيَ اللَّهُ عَنْهُ مِائَةً وَغَرَّبَهَا عَامًا. أَخْرَجَهُ مِنْ كِتَابِ اخْتِلافِ الْحَدِيثِ.
