وَعَنْ عَمْرِو بْنِ دِينَارٍ، قَالَ: كُلُّ شَيْءٍ فِي الْقُرْآنِ أَوْ لَهُ كَيْفَ شَاءَ، قَالَ ابْنُ جُرَيْجٍ: إِلا قَوْلَ اللَّهِ تَعَالَى: {إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ} [المائدة: 33] . فَلَيْسَ بِمُخَيَّرٍ فِيهَا. قَالَ الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ: كَمَا قَالَ ابْنُ جُرَيْجٍ وَغَيْرُهُ: {إِنَّمَا جَزَاءُ الَّذِينَ يُحَارِبُونَ اللَّهَ وَرَسُولَهُ} [المائدة: 33] .فِي الْمُحَارِبِ فِي هَذِهِ الْمَسْأَلَةِ أَقُولُ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ قِتَالِ الْمُشْرِكِينَ، وَالثَّانِيَ مِنْ كِتَابِ الْقَطْعِ فِي السَّرِقَةِ، وَالثَّالِثَ مِنْ كِتَابِ الْمَنَاسِكِ.

مسند امام شافی · Hadith 1600

Amr ibn Dinar, said everything in the Koran or him how willing, son Greg said, but the words of God Almighty: but reward those who fight Allah and His Messenger} [table: 33]. There is no choice in it. Al-Shafi’i, may God be pleased with him, said: As Ibn Jarij and others said: {It is only the reward for those who fight against God and His Messenger. ”[33] Take out the first from the book of the fighting of the idolaters, the second from the book of cutting in the theft, and the third from the book of the rituals.
