أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ، قَالَ: أَنْبَأَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ: أَنَّ رَجُلا مِنَ الْمُسْلِمِينَ قَتَلَ رَجُلا مِنْ أَهْلِ الذِّمَّةِ، فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «أَنَا أَحَقُّ مَنْ وَفَّى بِذِمَّتِهِ» ، ثُمَّ أَمَرَ بِهِ فَقُتِلَ. قَالَ: لا، وَلَكِنَّ قَتْلَهُ لا يَرُدُّ عَلَيَّ أَخِي، وَعَوَّضَنِي فَرَضِيتُ، قَالَ: أَنْتَ أَعْلَمُ. مَنْ كَانَ لَهُ ذِمَّتُنَا فَدَمُهُ كَدَمِنَا وَدِيَتُهُ كَدِيَتِنَا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الدِّيَاتِ وَالْقِصَاصِ.
مسند امام شافی · Hadith 1623
Tell us Shafei may Allah be pleased with him, said: Tell us Mohammed bin Hassan, said: told us Ibrahim bin Mohammed, Mohammed bin Munkadir, Abd al-Rahman bin Albilmana: that a man of Muslims killed a man from the dhimmis, he raised it to the Messenger of Allah, peace be upon him He said: “I am more deserving of those who fulfill his obligation.” Then he commanded him, and he was killed. He said: No, but his killing does not return to my brother, and he compensated me, so I accepted. He said: You know. He who has our defamation, his blood is our blood, and his blood is our blood. Take the two hadiths out of the Diyat book and the qisas.
