أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، وَابْنِ طَاوُسٍ، عَنْ طَاوُسٍ: أَنَّ عُمَرَ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أُذَكِّرُ اللَّهَ امْرَأً سَمِعَ مِنَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْجَنِينِ شَيْئًا، فَقَامَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ فَقَالَ: كُنْتُ بَيْنَ جَارَتَيْنِ لِي، يَعْنِي: بَيْنَ ضَرَّتَيْنِ، فَضَرَبَتْ إِحْدَاهُمَا الأُخْرَى بِمِسْطَحٍ فَأَلْقَتْ جَنِينًا مَيِّتًا فَقَضَى فِيهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِغُرَّةٍ، فَقَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: لَوْ لَمْ نَسْمَعْ هَذَا لَقَضَيْنَا فِيهِ بِغَيْرِ هَذَا. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ، وَالثَّانِيَ مِنْ كِتَابِ الدِّيَاتِ وَالْقِصَاصِ، وَالثَّالِثَ وَالرَّابِعَ مِنْ كِتَابِ جِرَاحِ الْخَطَأِ، وَالْخَامِسَ مِنْ كِتَابِ الرِّسَالَةِ.
