أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سُنَيْنِ بْنِ أَبِي جَمِيلَةَ رَجُلٍ مِنْ بَنِي سُلَيْمٍ: أَنَّهُ وَجَدَ مَنْبُوذًا فِي زَمَانِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَجَاءَ بِهِ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: مَا حَمَلَكَ عَلَى أَخْذِ هَذِهِ النَّسَمَةِ؟ قَالَ: وَجَدْتُهَا ضَائِعَةً فَأَخَذْتُهَا، فَقَالَ لَهُ عَرِيفِي: يَا أَمِيرَ الْمُؤْمِنِينَ، إِنَّهُ رَجُلٌ صَالِحٌ، قَالَ: أَكَذَلِكَ؟ قَالَ: نَعَمْ، قَالَ عُمَرُ: اذْهَبْ فَهُوَ حُرٌّ وَلَكَ وَلاؤُهُ وَعَلَيْنَا نَفَقَتُهُ.أَخْرَجَهُ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.
مسند امام شافی · Hadith 1082
Tell us Shafei may Allah be pleased with him, said: Tell us Malik from Ibn Shihab from years ibn Abi beautiful man from Bani Salim: that he found an outcast at the time of 'Umar ibn al-Khattab may Allah be pleased with him, he brought him to Omar ibn al-Khattab may Allah be pleased with him, he said: What Did you get this breath? He said: I found her lost, so I took it, and my master told him: O Commander of the Faithful, he is a righteous man. He said: What did you say? He said: Yes, Omar said: Go, it is free, and you have loyalty, and we have spent it. Bring it out in the book of disagreement and money.
