أَخْبَرَنَا سَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ دِينَارٍ: أَنَّهُ سَمِعَ عِكْرِمَةَ بْنَ خَالِدٍ يَقُولُ: أَرَادَ عَبْدُ الرَّحْمَنِ ابْنُ أُمِّ الْحَكَمِ فِي شَكْوَاهُ أَنْ يُخْرِجَ امْرَأَةً مِنْ مِيرَاثِهَا فَأَبَتْ فَنَكَحَ عَلَيْهَا ثَلاثَ نِسْوَةٍ وَأَصْدَقَهُنَّ أَلْفَ دِينَارٍ كُلَّ امْرَأَةٍ مِنْهُنَّ، فَأَجَازَ ذَلِكَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ وَشَرَّكَ بَيْنَهُنَّ فِي الثُّمُنِ.قَالَ الرَّبِيعُ: هَذَا قَوْلُ الشَّافِعِيِّ نَصٌّ، قَالَ الشَّافِعِيُّ: أَرَى ذَلِكَ صَدَاقَ مِثْلِهِنَّ وَلَوْ كَانَ أَكْثَرَ مِنْ صَدَاقِ مِثْلِهِنَّ جَازَ النِّكَاحُ، وَبَطَلَ مَا زَادَ عَلَى صَدَاقِ مثِلْهِنَّ إِنْ مَاتَ مِنْ مَرَضِهِ ذَلِكَ؛ لأَنَّهُ فِي حُكْمِ الْوَصِيَّةِ وَالْوَصِيَّةُ لا تَجُوزُ لِوَارِثٍ.
