2776 - أخبرنا أحمد بن عبد الله الصالحي ، أنا أبو بكر أحمد بن الحسين الحيري ، أنا حاجب بن أحمد الطوسي ، أنا عبد الرحيم بن منيب ، نا النضر بن شميل ، أنا عوف ، عن الحسن عن عبد الله بن مغفل قال : قال رسول الله ( صلى الله عليه وسلم ) : " من اتخذ كلبا إلا كلب صيد ، أو كلب غنم ، أو كلب زرع ، فإنه ينقص من عمله كل يوم قيراطان ".

2777 - أخبرنا أحمد بن عبد الله الصالحي ، أنا أبو الحسين علي بن محمد بن عبد الله بن بشران ، أنا إسماعيل بن محمد الصفار ، أنا أحمد بن منصور الرمادي ، نا عبد الرزاق ، نا معمر ، عن الزهري ، عن أبي سلمة عن أبي هريرة أن النبي ( صلى الله عليه وسلم ) قال : " من اتخذ كلبا إلا كلب ماشية ، أو صيد ، أو زرع ، انتقص من أجره كل يوم قيراط ". قال الزهري : فذكر لابن عمر قول أبي هريرة ، فقال : يرحم الله أبا هريرة كان صاحب زرع. هذا حديث متفق على صحته أخرجه مسلم عن عبد بن حميد ، عن عبد الرزاق ، وأخرجه محمد من طرق عند أبي سلمة. قال الخطابي : في قول ابن عمر : يرحم الله أبا هريرة كان صاحب زرع. قال : أراد تصديق أبي هريرة ، وتوكيد قوله ، وجعل حاجته إلى ذلك شاهدا له على علمه ، لأن من صدقت حاجته إلى شيء ، كثرت صفحة رقم 210 مسألته عنه حتى يحكمه ، وقد رواه عبد الله بن مغفل المزني ، وسفيان بن أبي زهير عن النبي ( صلى الله عليه وسلم ) ، فذكرا فيه الزرع كما ذكره أبو هريرة. وعبد الله بن مغفل كنيته أبو سعيد ، ويقال : أبو زياد نزل البصرة.

2778 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد أنا أبو إسحاق الهاشمي ، أخبرنا أبو مصعب ، عن مالك ، عن نافع عن عبد الله بن عمر أن رسول الله ( صلى الله عليه وسلم ) أمر بقتل الكلاب. هذا حديث متفق على صحته أخرجه محمد عن عبد الله بن يوسف ، وأخرجه مسلم عن يحيى بن يحيى ، كلاهما عن مالك.

2779 - أخبرنا أحمد بن عبد الله الصالحي ، أنا أبو الحسين بن بشران ، أنا إسماعيل بن محمد الصفار ، نا أحمد بن منصور الرمادي ، صفحة رقم 211 نا عبد الرزاق ، أنا معمر ، عن أيوب ، عن نافع عن ابن عمر أن النبي ( صلى الله عليه وسلم ) أمر بقتل الكلاب بالمدينة ، فأخبر بامرأة لها كلب في ناحية المدينة ، فأرسل إليها ، فقتل. هذا حديث متفق على صحته أخرجاه من أوجه عن نافع.

2780 - أخبرنا عبد الواحد بن أحمد المليحي ، أنا أبو محمد عبد الرحمن بن أبي شريح ، أنا أبو القاسم عبد الله بن محمد بن عبد العزيز البغوي ، نا علي بن الجعد ، أنا المبارك هو ابن فضالة ، عن الحسن عن عبد الله بن مغفل ، عن النبي ( صلى الله عليه وسلم ) قال : " لولا أن الكلاب أمة ، لأمرت بقتلها ، فاقتلوا كل أسود بهيم ". هذا حديث حسن صحيح. قيل : الأسود البهيم : الذي لا يكون فيه شيء من البياض. قال أبو سليمان الخطابي : معنى هذا الكلام أن النبي ( صلى الله عليه وسلم ) كره إفناء أمة من الأمم ، وإعدام جيل من الخلق ، لأنه صفحة رقم 212 ما من خلق لله عز وجل إلا فيه نوع من الحكمة ، وضرب من المصلحة. يقول : إذا كان الأمر على هذا ، ولا سبيل إلى قتلهن كلهن ، فاقتلوا شرارهن وهي السود البهم ، وأبقوا ما سواها ، لتنتفعوا بهن في الحراسة. قال الإمام : وروي في الحديث " إن الكلب الأسود شيطان ". وحكي عن أحمد وإسحاق أنهما قالا : لا يحل صيد الكلب الأسود ، قال الإمام : قيل جعل الأسود منها شيطانا لخبثها ، لأن الأسود البهيم أضرها وأعقرها ، والكلب أسرع إليه منه إلى جميعها وهي مع هذا أقلها نفعا ، وأسوؤها حراسة ، وأبعدها من الصيد ، وأكثرها نعاسا. وقيل في تخصيص كلاب المدينة بالقتل من حيث إن المدينة كانت مهبط الملائكة بالوحي ، وهم لا يدخلون بيتا فيه كلب. وروي عن عمرو بن دينار ، عن ابن عمر أن رسول الله ( صلى الله عليه وسلم ) أمر بقتل الكلاب إلا كلب صيد ، أو كلب غنم ، أو ماشية.

2781 - أخبرنا أبو طاهر عمر بن عبد العزيز الفاشاني ، أنا الشريف أبو عمرو القاسم بن جعفر بن عبد الواحد الهاشمي ، أنا أبو علي محمد بن أحمد بن عمرو اللؤلؤي ، نا أبو داود سليمان بن الأشعث ، نا أحمد بن حنبل ، نا يحيى بن سعيد ، عن شعبة ، نا أبو التياح ، عن مطرف عن ابن مغفل أن رسول الله ( صلى الله عليه وسلم ) أمر بقتل الكلاب ثم قال : " ما لهم ولها " فرخص في كلب الصيد ، وفي كلب الغنم. وقال : " إذا ولغ الكلب في الإناء ، فاغسلوه سبع مرار ، والثامنة عفروه بالتراب ". هذا حديث صحيح أخرجه مسلم عن عبيد الله بن معاذ عن أبيه ، عن شعبة.

2782 - أخبرنا عبد الواحد بن أحمد المليحي ، أنا أحمد بن عبد الله النعيمي ، أنا محمد بن يوسف ، نا محمد بن إسماعيل ، نا موسى بن إسماعيل ، نا أبو عوانة ، عن سعيد بن مسروق ، عن عباية بن رفاعة عن جده رافع بن خديج قال : كنا مع النبي ( صلى الله عليه وسلم ) بذي الحليفة ، فأصاب الناس جوع ، وأصبنا إبلا وغنما وكان النبي في أخريات الناس ، فعجلوا فنصبوا القدور ، فدفع النبي ( صلى الله عليه وسلم ) إليهم ، فأمر بالقدور ، فأكفئت ، ثم قسم فعدل عشرة من الغنم ببعير ، فند منها بعير ، وكان في القوم خيل بسيرة ، فطلبوه ، فأعياهم ، فأهوى إليه رجل بسهم ، فحبسه الله ، فقال النبي ( صلى الله عليه وسلم ) : " إن لهذه البهائم أوابد كأوابد الوحوش ، فما ند عليكم ، فاصنعوا به هكذا " قال : وقال جدي : إنا لنرجو ، أو نخاف أن نلقى العدو غدا وليس معنا مدى ، أفنذبح بالقصب ؟ فقال : ما أنهر الدم ، وذكر اسم الله عليه ، فكل ليس السن والظفر ، وسأحدثكم عن ذلك : " أما السن فعظم ، وأما الظفر فمدى الحبشة ". صفحة رقم 215 هذا حديث متفق على صحته أخرجه مسلم عن القاسم بن زكريا ، عن حسين بن علي ، عن زائدة ، عن سعيد بن مسروق. قوله : " أوابد " فالأوابد : هي التي قد توحشت ونفرت ، يقال : أبد الرجل يأبد أبودا : إذا توحش وتخلى ، وتأبدت الديار : إذا توحشت ، وهذه آبدة من الأوابد ، أي : نادرة في بابها لا نظير لها. وجاء فلان بآبدة ، أي : بخصلة يستوحش منها. والمدى : جمع مدية وهي السكين. وقوله : " ما أنهر الدم ، أي : أساله وأجراه ، ومنه سمي النهر ، لأنه يجري فيه الماء ". وفي الحديث من الفقه جواز قسمة الحيوان ، ومعادلة العدد بالواحد عند تفاوت القيمة. وأما أمره بإكفاء القدور ، فقد قال قوم : إن القوم أصابوا غنيمة فذبح بعضهم منها شيئا من النعم بغير إذن الباقين لا يؤكل ، وقال طاووس وعكرمة في ذبيحة السارق : اطرحوه. قال الإمام : وعند صفحة رقم 216 الأكثرين : اللحم حلال مملوك للشركاء ، ولعله أمر به زجرا وردعا ، لأنهم ذبحوها قبل القسمة على سبيل النهب ، فلم يطب لهم. وفي دليل على أن الحيوان الإنسي إذا توحش ونفر ، فلم يقدر على قطع مذبحه ، يصير جميع بدنه في حكم المذبح ، كالصيد الذي لا يقدر عليه ، وكذلك لو وقع بعير في بئر منكوسا ، فلم يقدر على قطع حلقه فطعن في موضع من بدنه فمات ، كان حلالا ، روي عن أبي العشراء عن أبيه قال : قلت يا رسول الله : أما تكون الذكاة إلا في الحلق واللبة ؟ قال : " لو طعنت في فخذها لأجزأ عنك " وأراد به في غير المقدور عليه. قال أبو عيسى : ولا يعرف لأبي العشراء عن أبيه غير هذا الحديث. واختلفوا في اسم أبي العشراء ، قيل : اسمه أسامة بن مالك بن قهطم الدارمي ، ويقال : يسار بن برز ، وقيل : اسمه عطارد. وذهب ربيعة ومالك إلى أن الإنسي إذا توحش ، فلا يحل إلا بقطع مذبحه ، ولا يتغير حكمه بالتوحش ، وأكثر العلماء على خلافه. وعلى عكسه لو استأنس الصيد ، وصار مقدورا عليه لا يحل إلا بقطع مذبحه باتفاق أهل العلم حتى لو رمى إلى صيد ، فأزال امتناعه بأن كانت دابة ، فأعجزها عن العدو ، أو طائرا ، فأعجزه عن الطيران والعدو ، ملكه صفحة رقم 217 بهذا الإزمان ، ثم إن صيرته الجراحة إلى حالة المذبوح ، فمات منها ، فهو حلال ، وإن لم يصيره إلى حالة المذبوح ، فلا يحل إلا بقطع المذبح إذا وصل إليه وهو حي ، ولو سار إليه ، فقبل أن وصل إليه ، مات من جرحه ، أو وصل إليه حيا وتهيأ لذبحه ، ففارقه الروح قبل أن ذبحه ، فهو حلال. ولو توانى في ذبحه ، أو اشتغل بطلب آلة الذبح ، أو بتحديد السكين ، أو تعلق سكينه بغمد ، فمات ، فحرام. وفي الحديث بيان أن كل محدد يجرح يحصل به الذبح ، سواء كان حديدا ، أو قصبا ، أو خشبا ، أو زجاجا ، أو حجرا سوى السن والظفر. وروي عن كعب بن مالك أنه كانت لهم غنم ترعى بسلع فأبصرت جارية بشاة موتا ، فكسرت حجرا ، فذبحتها به ، فسأل النبي [ ] عن ذلك ، فأمره بأكلها. وقوله : " ليس السن والظفر " بمعنى الاستثناء ، وإعرابه النصب. قال رحمه الله : أما السن والظفر ، فلا يقع بها الذكاة ، وفي تعليله ( صلى الله عليه وسلم ) السن بأنه عظم دليل على أن القوم كان متقررا عندهم أن الذكاة لا تحصل بشيء من العظام ، وهو قول أكثر أهل العلم ، سواء كان العظم والسن بائنين عن الإنسان ، أو غير بائنين ، وإليه ذهب الشافعي وذهب بعض أصحابه إلى أن الذبح يحصل بعظم ما يؤكل لحمه ، وعامة أصحابه على خلافه. وقال مالك : إن ذكي بالعظم ، فمر مرا ، أجزأه ، صفحة رقم 218 والنهي عنه لما أن الغالب من أمر العظم أنه لا يقطع المذابح ، ولا يمور فيها مور الحديد. وذهب أصحاب الرأي إلى أن السن والعظم إن كانا بائنين عن الإنسان تحصل بها الذكاة ، وإن كانا غير منزوعين عن مكانهما ، فلا تحصل ، لأن ذلك بمنزلة ما يعالجه الإنسان بيده وأنامله ، فأشبه الخنق ، ثم هذا الاختلاف بين العلماء فيما إذا ذبح مقدورا عليه بعظم ، أو رمى عظما إلى صيد ، فأما إذا جرح الكلب الصيد بسنه أو ظفره ، فقتله فحلال بالاتفاق. وذكر الخطابي أنه إذا اتخذ الرامي نصلا من عظم فأصاب به صيدا جاز ، قال الإمام : والقياس أن لا يجوز كما لو ذبح المقدور عليه بالعظم بخلاف سن الجارحة ومخلبها ، لأنه لا يمكن الاحتراز عنه. وقوله : " أما الظفر فمدى الحبشة " معناه : أن الحبشة يدمون مذابح الشاة بأظفارهم ، ويجرحونها ، فيحلونها محل المدى التي يستعملها المسلمون ، ولا خلاف أن المدى التي يقطع بها يحصل بها الذكاة وإن كان الكفار يستعملونها. قال الحسن وإبراهيم : لا بأس بذبيحة الأقلف ، وهو قول أهل العلم ، وذبيحة الأمة حلال ، وكذا الصبي ، وفي المجنون اختلاف. قال الحكم : إني لأذبح وإني لجنب.

2783 - أخبرنا عبد الواحد بن أحمد المليحي ، أنا أبو محمد عبد الرحمن بن أبي شريح ، أنا أبو القاسم عبد الله بن محمد بن عبد العزيز البغوي ، نا علي بن الجعد ، أنا شعبة ، عن خالد الحذاء ، عن أبي قلابة ، عن أبي الأشعث الصنعاني عن شداد بن أوس ، عن النبي ( صلى الله عليه وسلم ) قال : إن الله كتب الإحسان على كل شيء ، فإذا ذبحتم فأحسنوا الذبح ، وإذا قتلتم ، فأحسنوا القتلة ، وليحد أحدكم شفرته ، وليرح ذبيحته ". هذا حديث صحيح أخرجه مسلم عن أبي بكر بن نافع عن غندر عن شعبة. قال الإمام : الإحسان في القتل والذبح مكتوب على الإنسان كما نطق به الحديث ، فمن ذلك تحديد الشفرة ، ليكون أيسر على الذبيحة ، وقد روي في حديث رافع بن خديج حين قال : إنا لاقوا العدو غدا وليست معنا مدى ، أفنذبح بالقصب ؟ فقال النبي ( صلى الله عليه وسلم ) : " أعجل وأرن " معناه : خف واعجل ، لأن الذبح إذا كان بغير الحديد صفحة رقم 220 احتاج صاحبه إلى خفة يد ، وسرعة في إمرارها على الحلق حتى لا تختنق الذبيحة بما ينالها من ألم الضغط. روي أن رجلا أحدّ شفرته وقد أخذ شاة ليذبحها ، فضربه عمر بالدرة فقال : أتعذب الروح ألا فعلت هذا قبل أن تأخذها. والاختيار في الإبل النحر ، وهو أن يقطع اللبة ، وفي البقر والغنم الذبح ، وهو قطع أعلى العنق ، لأن عنق البعير طويل ، فإذا قطع صفحة رقم 221 أسفله يكون أعجل لزهوق الروح ، فلو نحر البقر والغنم ، أو ذبح البعير فجائز ، وقال مالك : لو ذبح البعير ، أو نحر الشاة ، فلا يحل وفي البقر يتخير بين الذبح والنحر ، وقال عمر وابن عباس : الذكاة في الحلق واللبة ، وزاد عمر : ولا تعجلوا الأنفس أن تزهق أراد بقوله : لا تعجلوا الأنفس أن تزهق ، أي : لا يسلخها بعد قطع مذبحها ما لم يفارقها الروح. ونهى ابن عمر عن النخع ، والنخع : هو القتل الشديد ، وهو أن يبالغ في قطع حلقها حتى يبلغ النخاع وهو خيط الرقبة ، والبخع بالباء أيضا : القتل الشديد ، ومنه قوله سبحانه وتعالى : ) فلعلك باخع نفسك ( [ الكهف : 6 ] أي : قاتلها ومهلكها مبالغا فيها حرصا على إسلامهم ، وأقل الذبح : قطع المري والحلقوم ، وكماله أن يقطع الودجين معهما.

2784 - أخبرنا عبد الواحد بن أحمد المليحي ، أنا أبو محمد عبد الرحمن بن أبي شريح ، أنا أبو القاسم عبد الله بن محمد بن عبد العزيز البغوي ، نا علي بن الجعد ، أنا شعبة ، عن عدي بن ثابت ، قال : سمعت سعيد بن جبير يحدث عن ابن عباس ، عن النبي ( صلى الله عليه وسلم ) قال : " لا تتخذوا شيئا فيه الروح غرضا ". هذا حديث صحيح أخرجه مسلم عن عبيد الله بن معاذ ، عن أبيه ، عن شعبة.

2785 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، أنا أبو بكر محمد بن سهل القهستاني ، نا إسحاق بن الحسن ، نا عبد الله بن صالح ، حدثني الليث ، حدثني ابن وهب ، عن ابن جريج ، عن أبي الزبير عن جابر بن عبد الله ، عن رسول الله ( صلى الله عليه وسلم ) أنه نهى أن يقتل شيء من الدواب صبرا. صفحة رقم 223 هذا حديث متفق على صحته أخرجه مسلم عن هارون بن عبد الله عن حجاج بن محمد ، عن ابن جريج ، وأخرجه محمد من رواية ابن عمر قال : سمعت النبي ( صلى الله عليه وسلم ) ينهى أن تصبر بهيمة أو غيرها للقتل.

2786 - أخبرنا محمد بن الحسن ، أنا أبو العباس الطحان ، أنا أبو أحمد محمد بن قريش ، أنا علي بن عبد العزيز ، أنا أبو عبيد ، نا هشيم عن أبي بشر ، عن سعيد بن جبير عن ابن عمر ، عن النبي ( صلى الله عليه وسلم ) أنه نهى عن قتل كل شيء من الدواب صبرا. هذا حديث متفق على صحته أخرجه محمد عن أبي النعمان ، وأخرجه مسلم عن أبي كامل الجحدري ، كلاهما عن أبي عوانة ، عن أبي بشر. قوله : " أن تصبر بهيمة " أراد به أن يحبس الحيوان ، فيرمى صفحة رقم 224 إليه حتى يموت ، وأصل الصبر : الحبس. وروي عن ابن تعلي قال : غزونا مع عبد الرحمن بن خالد بن الوليد ، فأتي بأربعة أعلاج من العدو ، فأمر بهم ، فقتلوا بالنبل صبرا ، فبلغ ذلك أبا أيوب الأنصاري ، قال : سمعت رسول الله ( صلى الله عليه وسلم ) ينهى عن قتل الصبر ، فبلغ ذلك عبد الرحمن بن خالد ، فأعتق أربع رقاب. وروي عن عكرمة ، عن ابن عباس أن النبي ( صلى الله عليه وسلم ) نهى عن المجثمة ، وعن لبن الجلالة ، وعن الشرب من في السقاء والمراد من المجثمة : المصبورة ، لأنها قد جثمت على الموت ، أي : حبست عليه.

2787 - أخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز ابن أحمد الخلال ، نا أبو العباس الأصم ( ح ) وأخبرنا أحمد بن عبد الله الصالحي ، ومحمد بن أحمد العارف ، قالا : أنا أبو بكر الحيري ، نا أبو العباس الأصم ، أنا الربيع ، أنا الشافعي ، أنا ابن عيينة ، عن عمرو ابن دينار ، عن صهيب مولى عبد الله بن عامر عن عبد الله بن عمرو بن العاص أن رسول الله ( صلى الله عليه وسلم ) قال : " من قتل عصفورا فما فوقها بغير حقها ، سأله الله عن قتله " قيل : يا رسول الله وما حقها ؟ قال : " أن يذبحها فيأكلها ، ولا يقطع رأسها ، فيرمي بها ". صفحة رقم 226 قال الإمام : فيه كراهية ذبح الحيوان لغير الأكل ، وقد روي عن ابن عباس قال : نهى رسول الله ( صلى الله عليه وسلم ) عن معاقرة الأعراب. وأراد بمعاقرة الأعراب : أن يتبارى الرجلان ، فيعقر هذا عددا من إبله ، ويعقر صاحبه ، فأيهما كان أكثر عقرا ، غلب صاحبه ، كره لحومها لئلا يكون مما أهل به لغير الله سبحانه وتعالى. قال الخطابي رحمه الله : وفي معناه ما جرت به عادة الناس من ذبح الحيوان عند قدوم الملوك والرؤساء ، وأوان حدوث نعمة تتجدد لهم في نحو ذلك من الأمور.
