أَخْبَرَنَا مَالِكٌ، عَنْ حُمَيْدٍ الطَّوِيلِ، عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ الثِّمَارِ حَتَّى تُزْهِيَ، قِيلَ: يَا رَسُولَ اللَّهِ، وَمَا تُزْهِي؟ قَالَ: «حَتَّى تَحْمَرَّ» . وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَرَأَيْتُمْ إِذَا مَنَعَ اللَّهُ الثَّمَرَةَ فَبِمَ يَأْخُذُ أَحَدُكُمْ مَالَ أَخِيهِ» ؟ .

أَخْبَرَنَا مَالِكٌ، عَنْ أَبِي الرِّجَالِ، عَنْ أُمِّهِ عَمْرَةَ أَنَّهُ سَمِعَهَا تَقُولُ: ابْتَاعَ رَجُلٌ تَمْرَ حَائِطٍ فِي زَمَانِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَعَالَجَهُ وَأَقَامَ عَلَيْهِ حَتَّى تَبَيَّنَ لَهُ النُّقْصَانُ، فَسَأَلَ رَبَّ الْحَائِطِ أَنْ يَضَعَ فَحَلَفَ أَنْ لا يَفْعَلَ، فَذَهَبَتْ أُمُّ الْمُشْتَرِي إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «تَأَلَّى أَنْ لا يَفْعَلَ خَيْرًا؟» فَسَمِعَ بِذَلِكَ رَبُّ الْمَالِ فَأَتَى إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: يَا رَسُولَ اللَّهِ، هُوَ لَهُ. أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنْ كِتَابِ الْبُيُوعِ.
