2099 - حدثنا الإمام أبو الطيب سهل بن محمد بن سليمان إملاء وأبو عبد الله الحافظ ، وأبو زكريا بن أبي إسحاق ، وغيرهم ، قالوا : ثنا أبو العباس محمد بن يعقوب ، أنا الربيع بن سليمان ، أنا الشافعي ، أنا عمي محمد بن علي بن شافع ، عن عبد الله بن علي بن السائب ، عن نافع بن عجير بن عبد يزيد ، أن ركانة بن عبد يزيد ، طلق امرأته سهيمة المزنية البتة ، ثم أتى رسول الله صلى الله عليه وسلم فقال : يا رسول الله ، إني طلقت امرأتي سهيمة البتة ، والله ما أردت إلا واحدة ، فقال رسول الله صلى الله عليه وسلم لركانة : « والله ما أردت إلا واحدة ؟ » فقال ركانة : « والله ما أردت إلا واحدة » فردها إليه رسول الله صلى الله عليه وسلم فطلقها الثانية في زمن عمر ، والثالثة في زمن عثمان

2100 -أخبرنا أبو علي الروذباري ، أنا أبو بكر بن داسة ، ثنا أبو داود ، ثنا محمد بن يونس النسائي ، أن عبد الله بن الزبير حدثهم ، عن محمد بن إدريس الشافعي ، حدثني عمي محمد بن علي ، عن ابن السائب ، عن نافع بن عجير ، عن ركانة بن عبد يزيد ، عن النبي صلى الله عليه وسلم بهذا الحديث وروينا عن عمر بن الخطاب رضي الله عنه أنه قال في البتة (1) بنحو من هذا ، وروي عنه أيضا في الخلية (2) ، والبرية (3) ، والبتة ، والبائنة واحدة ، وهو أحق بها وكذلك في حبلها على غاربها ، إذا قال : « أردت فيها الفراق أو الطلاق »

2101 - أخبرنا أبو محمد بن يوسف ، أنا أبو سعيد بن الأعرابي ، ثنا الحسن بن محمد الزعفراني ، ثنا أبو عباد ، ثنا جرير بن حازم ، ثنا عيسى بن عاصم ، عن زاذان ، قال : كنا عند علي رضي الله عنه فذكر الخيار فقال : إن « أمير المؤمنين يعني عمر قد سألني عن الخيار » فقلت : إن اختارت نفسها فواحدة بائنة ، وإن اختارت زوجها فواحدة وهو أحق بها ، فقال عمر : « ليس كذلك ، ولكنها اختارت زوجها فليس بشيء ، وإن اختارت نفسها فواحدة وهو أحق بها ، فلم أستطع إلا متابعة أمير المؤمنين عمر رضي الله عنه فلما خلص الأمر إلي ، وعلمت أني مسئول عن الفروج أخذت بالذي كنت أرى » فقالوا : والله لئن جامعت عليه أمير المؤمنين عمر ، وتركت رأيك الذي رأيت إنه لأحب إلينا من أمر تفردت به بعده ، قال : « فضحك » ثم قال : أما إنه قد أرسل إلى زيد بن ثابت ، فسأل زيدا فخالفني ، وإياه فقال زيد : « إن اختارت نفسها فثلاث ، وإن اختارت زوجها فواحدة وهو أحق بها » قلت : وروينا عن عبد الله بن مسعود ، وعبد الله بن عباس ، أنهما قالا في الخيار نحو قول عمر وروينا عن أبي إسحاق ، عن أبي جعفر ، نحو قول عمر قيل له : « فإن أناسا يروون عن علي خلاف هذا ؟ » قال : « هكذا وجدوه في الصحف »
