2084 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، أنا أبو إسحاق الهاشمي ، أنا أبو مصعب ، عن مالك ، عن نافع عن عبد الله بن عمر أن رسول الله ( صلى الله عليه وسلم ) قال : من باع نخلا قد أبرت ، فثمرها للبائع إلا أن يشترطه المبتاع ". هذا حديث متفق على صحته أخرجه محمد عن عبد الله بن يوسف وأخرجه مسلم عن يحيى بن يحيى ، كلاهما عن مالك. وتأبير النخل ، هو أن الطلع إذا انشق يوضع فيه شيء من طلع فحال النخل ، فيكون ذلك لقاحا وصلاحا للثمر بإذن الله تعالى ، والعمل على هذا عند أكثر أهل العلم أنه إذا باع نخلة قد أبرت لا تدخل الثمرة في مطلق بيع النخلة ، إلا أن يبيع الثمرة معها وإن كان عليها طلع لم يتشقق ، فيدخل في مطلق البيع ، كالأغصان ، وهو قول مالك ، والشافعي ، وأحمد ، وإسحاق وإن كان بعد تشقق الطلع قبل التأبير ، فلا يدخل أيضا في مطلق بيعها كالمؤبر ، لأن الثمرة قد ظهرت بالتشقق ، كما لو باع جارية حاملا يدخل الحمل في البيع ، وإن كان بعد انفصال الولد عنها لا يدخل في مطلق بيع الأم. صفحة رقم 102 ولو باع نخيله وبعض ثمرها مؤبر ، والبعض طلع فالكل يبقى للبائع. وكرسف الحجاز كالنخل إذا بيع أصله ، لأنه شجر يحمل سنين ، فإن كان بعد ما تشقق جوزه يبقى للبائع ، وإن كان قبل تشققه يدخل في البيع. أما كرسف خراسان فزرع ، لأنه لا يبقى أكثر من عام واحد فإن باعه قبل خروج الجوزق ، أو بعد خروجه قبل أن يتكامل فيه القطن لا يجوز إلا بشرط القطع ، وإن كان بعد ما تكامل فيه القطن قبل التشقق ، لا يصح البيع ، كبيع الجوز في القشرة العليا ، وإن كان بعد التشقق يصح مطلقا ، ويدخل الجوزق في البيع ، لأنه المقصود من شرائه بخلاف ثمر النخل بعد التأبير لا يدخل في البيع ، لأن الشجرة ثم مقصودة لثمر العام المقبل. وحكم شجر الورد حكم النخل إن باعه قبل تفتق كمامه ، يدخل في البيع وإن كان بعد التفتق ، لا يدخل في البيع إلا بالشرط ، وإن كان قد تفتق بعضه ، فما لم يتفتق ، دخل في البيع ، وما تفتق يبقى للبائع بخلاف ثمر النخل ، إذا كان بعضه مؤبرا يبقى الكل للبائع ، لأن ما تفتق من الورد ، لا يترك إلى إدراك الباقي ، أما سائر الثمار إذا بيع شجرها ، فإن كان بعد انعقاد الثمرة ، فالثمرة للبائع ، إلا أن يبيع معها ، وإن كان قبل انعقادها فللمشتري ، ولا عبرة بخروج النور. وذهب أصحاب الرأي إلى أنه لو باع نخلة مطلقا ، لا يدخل الطلع في البيع إلا بالشرط ، كالزرع لا يدخل في مطلق بيع الأرض ، وذهب بعض أهل العلم إلى أن المؤبرة تدخل في مطلق البيع ، وهو قول ابن صفحة رقم 103 أبي ليلى. والحديث حجة على من قال : تدخل الثمرة المؤبرة في مطلق بيع الشجرة ، ومفهومه حجة على من قال : لا يدخل الطلع فبه. ولو باع أرضا ، فيدخل في مطلق بيعها كل ما هو مثبت فيها للتأبيد كالبناء والأشجار إلا أن يستثنيها لنفسه ، فيبقى له ما استثناه ، ولا يدخل في البيع ما هو مودع فيها من الكنوز والدفائن والمنقولات ، وكذلك الزرع ، لأنها ليست للتأبيد ، وإن كان زرعا يجز ما ظهر منه ، ثم ينبت مثل القت والكراث ونحوها ، فالجزة الظاهرة منها تبقى للبائع ، وأصلها يدخل في مطلق بيع الأرض

2085 - أخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز بن أحمد الخلال ، أنا أبو العباس الأصم ( ح ) وأنا أحمد بن عبد الله الصالحي ومحمد بن أحمد العارف ، قالا : أنا أبو بكر الحيري ، أنا أبو العباس الأصم ، أنا الربيع ، أنا الشافعي ، أنا ابن عيينة ، عن ابن شهاب ، عن سالم عن أبيه أن رسول الله ( صلى الله عليه وسلم ) قال : " من باع عبدا وله مال ، فماله للبائع ، إلا أن يشترط المبتاع ".

2086 - أخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز بن أحمد الخلال ، أنا أبو العباس ، أنا الربيع ، أنا الشافعي ، أنا سفيان ، عن الزهري ، عن سالم صفحة رقم 104 عن أبيه أن رسول الله ( صلى الله عليه وسلم ) قال : " من باع نخلا بعد أن تؤبر ، فثمرتها للبائع إلا أن يشترط المبتاع ". هذان الحديثان متفق على صحتهما أخرجهما محمد عن عبد الله بن يوسف وأخرجه مسلم عن قتيبة ، كلاهما عن الليث ، عن ابن شهاب بهذا الإسناد ، وأخرجهما مسلم عن يحيى بن يحيى وغيره عن ابن عيينة. قال الإمام رحمه الله : في هذا الحديث بيان أن العبد لا ملك له بحال وأن السيد لو ملكه لا يملك ، لأنه مملوك ، فلا يجوز أن يكون مالكا كالبهائم. وقوله : " وله مال " هذه إضافة مجاز ، لا إضافة ملك ، كما يضاف السرج إلى الفرس ، والإكاف إلى الحمار ، والغنم إلى الراعي يدل عليه أنه قال : " فماله للبائع " أضاف المال إليه وإلى البائع في حالة واحدة ولا يجوز أن يكون الشيء الواحد كله ملكا لاثنين في حالة واحدة ، فثبت أن إضافته إلى العبد مجاز ، وإلى المولى حقيقة ، وهذا قول الشافعي وأصحاب الرأي. وذهب مالك إلى أن المولى إذا ملك عبده مالا ، فقبل العبد يملك ، ويحكى ذلك عن الحسن البصري وعلى المذهبين جميعا لو باعه المولى وباسمه مال لا يدخل ماله في البيع إلا أن يبيعه معه ، ثم إذا باع المال معه ، فعند الشافعي يشترط أن يكون المال الذي باسمه عينا معلومة صفحة رقم 105 وعند مالك يصح بيع المال معه ، وإن كان مجهولا أو دينا على الغير لأنه تبع لرقبة العبد ، فهو بمنزلة حمل الشاة ولبنها ، ولو كان كالحمل واللبن ، لدخل في مطلق بيع الأصل ، فلما لم يدخل ثبت أنه ليس بتبع بل هو مقصود ، فيشترط أن يكون معلوما. وقال الحسن والنخعي : من باع وليدة قد زينت ، فما عليها للمشتري ، إلا أن يستثنيه البائع ، ولو أعتق عبدا وله مال ، فالمال يكون للمولى ، وذهب النخعي إلى أن المال للعبد إذا أعتقه المولى ، وهو قول الزهري ومالك ، وإن لم يشترط ، واحتجوا بما روي عن ابن عمر قال : قال رسول الله ( صلى الله عليه وسلم ) " من أعتق عبدا وله مال ، فمال العبد له إلا أن يشترط السيد ". وذهب الأكثرون إلى أن المال للمولى ، كما في البيع لا يتبعه المال وحملوا الحديث في العتق على الندب والاستحباب ، فكما أن العتق كان إنعاما منه عليه ، ومعروفا اصطنعه إليه ، ندبه إلى مسامحته فيما بيده من المال إتماما للصنيعة ، وقد جرت العادة من السادة بالإحسان إلى مماليكهم إذا أرادوا إعتاقهم ، والتجافي لهم عما في أيديهم أقرب إلى البر ، ولا يجوز للعبد التسري على مذهب من يقول : لا ملك له ، وعلى مذهب مالك ، يجوز له التسري إذا ملكه المولى جارية ، واختلفت الرواية عن ابن عمر في تسري العبد ، ويروى عن سعيد بن المسيب ، وسليمان بن يسار ما يدل على جوازه.

2087 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، أنا أبو إسحاق الهاشمي ، أنا أبو مصعب عن مالك ، عن نافع عن عبد الله بن عمر أن رسول الله ( صلى الله عليه وسلم ) قال : " من ابتاع طعاما ، فلا يبعه حتى يستوفيه ". هذا حديث متفق على صحته أخرجه محمد عن عبد الله بن يوسف وأخرجه مسلم عن القعنبي ويحيى بن يحيى ، كل عن مالك. وبهذا الإسناد عن مالك عن عبد الله بن دينار ، عن عبد الله بن عمر أن رسول الله ( صلى الله عليه وسلم ) قال : " من ابتاع طعاما فلا يبعه حتى يقبضه ".

2088 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، أنا أبو إسحاق الهاشمي ، أنا أبو مصعب ، عن مالك ، عن نافع عن عبد الله بن عمر أنه قال : كنا في زمان رسول الله [ ] نبتاع الطعام ، فيبعث علينا من يأمرنا بنقله من المكان الذي ابتعنا فيه إلى مكان سواه قبل أن نبيعه. صفحة رقم 107 هذا حديث متفق على صحته أخرجه محمد عن إبراهيم بن المنذر ، عن أبي ضمرة ، عن موسى بن عقبة ، عن نافع ، وأخرجه مسلم ، عن يحيى بن يحيى ، عن مالك.

2089 - أخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز بن أحمد الخلال ، نا أبو العباس الأصم ( ح ) وأنا أحمد بن عبد الله الصالحي ومحمد بن أحمد العارف ، قالا : أنا أبو بكر أحمد بن الحسن الحيري ، أنا أبو العباس الأصم ، أنا الربيع ، أنا الشافعي ، أنا سفيان ، عن عمرو بن دينار ، عن طاووس عن ابن عباس قال : أما الذي نهى عنه رسول الله ( صلى الله عليه وسلم ) فهو الطعام أن يباع حتى يستوفى. وقال ابن عباس برأيه : ولا أحسب كل شيء إلا مثله. هذا حديث متفق على صحته أخرجه محمد عن علي بن عبد الله ، وأخرجه مسلم عن ابن أبي عمر ، كلاهما عن سفيان. قال الإمام : اتفق أهل العلم على أن من ابتاع طعاما لا يجوز له بيعه قبل القبض ، واختلفوا فيما سواه ، فذهب جماعة إلى أنه لا فرق بين الطعام والسلع والعقار في أن بيع شيء منها لا يجوز قبل القبض ، وهو قول ابن عباس ، وبه قال الشافعي ، ومحمد بن الحسن. وقال أبو حنيفة صفحة رقم 108 وأبو يوسف : يجوز بيع العقار قبل القبض ولا يجوز بيع المنقول ، وقال مالك : ما عدا المطعوم يجوز بيعه قبل القبض ، وذهب جماعة إلى أنه يجوز بيع ما سوى المكيل والموزون قبل القبض ، وذهب إليه سعيد ابن المسيب ، والحسن البصري ، والحكم ، وحماد ، وبه قال الأوزاعي وأحمد ، وإسحاق. قال الإمام : وكما لا يجوز بيع المبيع قبل القبض لا يجوز إجارته ، ولا فرق بين أن يبيعه من البائع ، أو من أجنبي في منع الجواز. ولو كانت أمة ، فزوجها قبل القبض ، فجائز ، وكذلك لو أعتق ينفذ عتقه وكان قبضا ، كما لو أتلفه ، لأن العتق إتلاف. واختلفوا في جواز الهبة والرهن قبل القبض ، فأجازه بعضهم لما

2090 - أخبرنا عبد الواحد بن أحمد المليحي ، أنا أحمد بن عبد الله النعيمي ، أنا محمد بن يوسف ، أنا محمد بن إسماعيل ، قال : وقال الحميدي : نا سفيان ، نا عمرو عن عبد الله بن عمر قال : كنا مع النبي ( صلى الله عليه وسلم ) في سفر فكنت على بكر صعب لعمر ، فكان يغلبني ، فيتقدم أمام القوم ، فيزجره عمر ، ويرده ، ثم يتقدم ، فيزجره عمر ، ويرده ، فقال النبي ( صلى الله عليه وسلم ) لعمر : " بعنيه " ، فقال : هو لك يا رسول الله ، قال : " بعنيه " فباعه ، فقال النبي ( صلى الله عليه وسلم ) " هو لك يا عبد الله بن عمر تصنع به ما شئت ". صفحة رقم 109 هذا حديث صحيح. وفيه دليل على جواز هبة المبيع قبل القبض ، ثم القبض يختلف باختلاف الأشياء ، فإن كان مما لا ينقل مثل أن اشترى أرضا أو دارا أو شجرة ثابتة ، فقبضها أن يخلي البائع بينها وبين المشتري فارغة بلا حائل وإن كان منقولا ، فإن كان شيئا خفيفا ، أخذه بيده ، وإن كان حيوانا ساقه إليه ، وإن كان طعاما ، اشتراه جزافا ، نقله من مكان الشراء. قال ابن عمر : رأيت الناس في عهد رسول الله ( صلى الله عليه وسلم ) يبتاعون جزافا - يعني الطعام - يضربون أن يبيعوه في مكانهم حتى يؤوه إلى رحالهم. قال الإمام : إن اشتراه مكايلة أو موازنة ، فقبضه أن ينقله بالكيل الوزن ، فإن قبضه جزافا ، فقبضه فاسد ، وهو مضمون عليه ، ولا ينفذ تصرفه فيه حتى يكيل أو يزن عليه البائع ، وكذلك لو اشتراه كيلا ، فقبض بالوزن ، أو اشترى وزنا ، فقبض بالكيل ، فقبضه فاسد. ولو ابتاع طعاما كيلا وقبضه ، ثم باعه من غيره كيلا ، لم يجز تسليمه بالكيل الأول حتى يكيله على من اشتراه ثانيا ، لما روي عن صفحة رقم 110 عثمان أن النبي ( صلى الله عليه وسلم ) قال : " إذا بعت فكل ، وإذا ابتعت فاكتل " وروي عن النبي ( صلى الله عليه وسلم ) أنه نهى عن بيع الطعام حتى يجري فيه الصاعان صاع البائع وصاع المشتري وبه قال الحسن ، وابن سيرين ، والشعبي وإليه ذهب الشافعي وأحمد وإسحاق ، وأصحاب الرأي ، وجوز عطاء بيعه بالكيل الأول. وسواء باعه نسيئة أو نقدا ، وقال مالك : إن باعه نقدا يجوز بالكيل الأول ، وإن باعه نسيئة ، فلا يجوز. وعلى هذا لو أسلم إلى إنسان في طعام ، وقبل السلم عن غيره في مثله فأمر من قبل منه أن يأخذه ممن أسلم إليه لنفسه ، لا يجوز حتى يقبضه صاحب الحق لنفسه ، ثم يكيل على من قبل منه ثانيا. أما إذا اشترى موزونا وقبضه ، ثم باعه وزنا ، جاز للمشتري الثاني أن يأخذه بالوزن الأول ، لأن الوزن لا يتفاوت ، والكيل اجتهاد ، وقد يقع التفاوت صفحة رقم 111 بين الكيلين ، فإذا اشترى مكايلة وقبض ، ثم باعه مكايلة يحتاج أن يكيل ثانيا ، فإن فضل ، يكون الفضل للبائع الثاني ، وإن نقص ، فعليه إتمامه ، وروي عن سماك بن حرب ، عن سعيد بن جبير ، عن ابن عمر قال : كنت أبيع الإبل بالبقيع ، فأبيع بالدنانير ، وآخذ مكانها الدراهم وأبيع بالدراهم ، وآخذ مكانها الدنانير ، فأتيت رسول الله ( صلى الله عليه وسلم ) ، فذكرت ذلك له ، فقال : " لا بأس أن تأخذها بسعر يومها ما لم تفترقا وبينكما شيء ". هذا حديث لا يعرف مرفوعا إلا من حديث سماك بن حرب ، عن سعيد ، والعمل على هذا عند بعض أهل العلم ممن لا يجوز بيع ما اشترى قبل القبض قالوا : إذا باع شيئا بدراهم ، أو بدنانير في الذمة يجوز أن يستبدل عنها غيرها ، كما يجوز الاستبدال عن القرض ، وبدل الإتلاف ، وهو قول الشافعي وأحمد وإسحاق. ويشترط قبض ما يستبدل في المجلس ، سواء استبدل عنه ما يوافقه في علة الربا أو شيئا آخر ، وكذلك في القرض ، وبدل الإتلاف لقوله ( صلى الله عليه وسلم ) : " ما لم تفترقا وبينكما شيء " وقيل : إذا استبدل شيئا لا يوافقه في علة الربا لا يشترط قبضه في المجلس ، وإنما شرط النبي ( صلى الله عليه وسلم ) أن يتفرقا ولا شيء صفحة رقم 112 بينهما في اقتضاء أحد النقدين عن الآخر ، لأنه يستبدل منه ما يوافقه في علة الربا ، والتقابض في بيع أحد النقدين بالآخر شرط ، وذهب بعض أهل العلم إلى أنه لا يجوز الاستبدال عن الثمن بحال ، كما لا يجوز بيع المبيع قبل القبض ، وإليه ذهب أبو سلمة بن عبد الرحمن ، وابن شبرمة. وذهب قوم إلى أنه إنما يجوز اقتضاء أحد النقدين عن الآخر ، فأما إذا اقتضى عنهما شيئا آخر ، فلا يجوز ، لأن مقتضى الدراهم من الدنانير لا يقصد به الربح ، إنما يقصد به الاقتضاء والتقاص بالطريق الأسهل ، وإذا استبدل منهما شيئا آخر ، يقصد به طلب الربح ، وقد ورد النهي عن ربح ما لم يضمن. وقال ابن أبي ليلى : لا يجوز اقتضاء أحد النقدين عن الآخر إلا بسعر اليوم ، وهو الأصوب ، كما جاء في الحديث ، وجوزه غيره ، سواء كان بأغلى من سعر اليوم أو بأرخص ، وروي عن سعيد بن المسيب ، وسليمان ابن يسار أنهما كانا ينهيان أن يبيع الرجل حنطة بذهب إلى أجل ، ثم يشتري بالذهب تمرا قبل أن يقبض الثمن ، وروي عن أبي بكر بن محمد ابن عمرو بن حزم وابن شهاب مثل ذلك. قال مالك : هذا إذا اشترى ممن باع منه الحنطة ، فأما إذا اشترى من غيره ، ثم أحاله بالثمن على من باع منه الحنطة ، جاز ، فأما إذا ثبت في الذمة بطريق العقد غير النقدين هل يجوز الاستبدال عنه ؟ نظر إن ثبت سلما ، فلا يجوز ، لما روي عن أبي سعيد الخدري قال : قال رسول الله ( صلى الله عليه وسلم ) : " من أسلف في شيء فلا يصرفه إلى غيره " وجوز مالك بيع المسلم فيه من المسلم صفحة رقم 113 إليه ، ومن غيره إلا أن يكون طعاما ، فلم يجوز الاستبدال عنه. وإن ثبت في الذمة ثمنا ، فاختلف أصحاب الشافعي فيه ، فذهب أكثرهم إلى جواز الاستبدال عنه ، كأحد النقدين ، إذا ثبت في الذمة ثمنا ، ولم يجوزه بعضهم كالمسلم فيه وحكم الصداق وبدل الخلع في الذمة كالأثمان على الأصح. ويحتج بحديث سعيد بن جبير ، عن ابن عمر من يجوز بيع ما اشتراه قبل القبض سوى الطعام ، لأنه يجوز بيع الثمن الذي وقع عليه العقد قبل القبض ، فكذلك يجوز بيع المثمن إلا ما خصته السنة وهو الطعام. ولو باع شيئا بدراهم ، أو بدنانير بأعيانها ، فإنها تتعين حتى لا يجوز لبائعها أن يعطي غير عينها ، وذهب أصحاب الرأي إلى أنها لا تتعين حتى يجوز لبائعها أن يعطي مثله مكانها ، واتفقوا على أنها تتعين في الغصب والوديعة ، وما يتعين في الغصب والوديعة يتعين في العقد بالتعيين قياسا على السلع. ولو استبدل عن الدين شيئا مؤجلا لا يجوز لما

2091 - أخبرنا محمد بن الحسن الميربند كشائي ، أنا أبو العباس أحمد ابن محمد بن سراج الطحان ، أنا أبو أحمد محمد بن قريش بن سليمان ، أنا أبو الحسن علي بن عبد العزيز المكي ، أنا أبو عبيد القاسم بن سلام ، حدثني زيد بن الحباب العكلي ، عن موسى بن عبيدة ، عن عبد الله بن دينار عن ابن عمر عن النبي ( صلى الله عليه وسلم ) أنه نهى عن الكالئ بالكالئ. صفحة رقم 114 وموسى بن عبيدة بن نشيط الربذي أبو عبد العزيز كان من خيار عباد الله ، وتكلموا فيه من قبل حفظه. قال أبو عبيد : الكالئ بالكالئ : هو النسيئة بالنسيئة : بأن يسلم مائة درهم إلى سنة في كر طعام ، فإذا انقضت السنة ، قال الذي عليه الطعام للدافع : ليس عندي طعام ، ولكن بعني هذا الكر بمائتي درهم إلى شهر ، فهذا وكل ما أشبه هذا نسيئة انتقل إلى نسيئة. ولو قبض الطعام ، ثم باعه منه أو من غيره بنسيئة ، لم يكن كالئا بكالئ. ولو كان لرجل على آخر حق مؤجل ، فعجل بعضه ، ووضع عنه الباقي ، يجوز ، وروي عن ابن عمر أنه كره ذلك ، وعن زيد بن ثابت. ولم يجوزه مالك. كما لا يجوز لصاحب الحق أن يزيد في الحق والأجل ، ولا يجوز أن ينقص عن الحق والأجل ، فيكون نقصان الأجل بمقابلة ما نقص من الحق.

2092 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، نا أبو إسحاق الهاشمي ، أنا أبو مصعب ، عن مالك ، عن أبي الزناد ، عن الأعرج عن أبي هريرة أن رسول الله ( صلى الله عليه وسلم ) قال : " لا تلقوا الركبان للبيع ، ولا يبع بعضكم على بيع بعض ، ولا تناجشوا ، ولا يبع حاضر لباد ، ولا تصروا الإبل والغنم ، فمن ابتاعها بعد ذلك ، فهو بخير النظرين بعد أن يحلبها ، إن رضيها أمسكها ، وإن سخطها ردها وصاعا من تمر " صفحة رقم 116 هذا حديث متفق على صحته أخرجه محمد عن عبد الله بن يوسف وأخرجه مسلم عن يحيى بن يحيى ، كلاهما عن مالك. قال الإمام : هذا حديث يتضمن فوائد وأحكاما. فأما قوله : " لا تلقوا الركبان " فصورته : أن يقع الخبر بقدوم عير تحمل المتاع فيتلقاها رجل يشتري منهم شيئا قبل أن يقدموا السوق ، ويعرفوا سعر البلد بأرخص ، فهذا منهي عنه ، لما فيه من الخديعة ، وذهب إلى كراهيته أكثر أهل العلم من الصحابة فمن بعدهم ، روي فيه عن علي ، وابن عباس وابن مسعود ، وابن عمر ، وهو قول مالك والشافعي وأحمد وإسحاق ، ولم يقل أحد منهم بفساد البيع ، غير أن الشافعي أثبت للبائع الخيار إذا قدم السوق ، وعرف سعر البلد ، لما روي عن ابن سيرين عن أبي هريرة أن النبي ( صلى الله عليه وسلم ) " نهى أن يتلقى الجلب ، فإن تلقاه إنسان ، فابتاعه فصاحب السلعة فيها بالخيار إذا ورد السوق ". وقال أبو سعيد الإصطخري إنما يكون له الخيار إذا كان المتلقي صفحة رقم 117 قد ابتاعه بأقل من سعر البلد ، فإن ابتاعه بسعر البلد أو أكثر ، فلا خيار له ، وهذا هو الأقيس ، وبعضهم أثبت له الخيار على كل حال. ولم يكره أصحاب الرأي التلقي ولا جعلوا لصاحب السلعة الخيار إذا قدم السوق ، والحديث حجة عليهم. قوله : " ولا يبيع بعضكم على بيع بعض " يروى : " ولا يبع " على سبيل النهي وهو أن يشتري رجل شيئا وهما في مجلس العقد لم يتفرقا وخيارهما باق ، فيأتي الرجل ، ويعرض على المشتري سلعة مثل ما اشترى أو أجود بمثل ثمنها أو أرخص ، أو يجيء إلى البائع ، فيطلب ما باعه بأكثر من ثمنه الذي باعه من الأول حتى يندم ، فيفسخ العقد ، فيكون البيع بمعنى الاشتراء ، كما قال عليه السلام : " لا يخطب على خطبة أخيه " والمراد منه طلب ما طلبه أخوه ، كذلك هذا ثم هذا الطالب إن كان قصده رد عقدهما ، ولا يريد شراءه ، يكون عاصيا ، سواء كان عالما بالحديث أو لم يكن ، وإن قصد غبطة أحدهما ، فلا يعصي إلا أن يكون عالما بالحديث.

2095 - أخبرنا أبو عبد الله محمد بن الفضل الخرقي ، أنا أبو الحسن علي بن عبد الله الطيسفوني ، أنا عبد الله بن عمر الجوهري ، نا أحمد ابن علي الكشميهني ، نا علي بن حجر ، نا إسماعيل بن جعفر ، نا العلاء ابن عبد الرحمن ، عن أبيه صفحة رقم 119 عن أبي هريرة أن رسول الله ( صلى الله عليه وسلم ) قال : " لا يسم المسلم على سوم أخيه ، ولا يخطب على خطبته ". هذا حديث صحيح أخرجه مسلم عن علي بن حجر. وصورة السوم على سوم الآخر : أن يأخذ الرجل شيئا ليشتريه بثمن رضى به مالكه ، فجاء آخر ، وزاد عليه يريد شراءه ، فأما إذا لم يكن قد رضي به المالك ، أو كان الشيء يطاف به فيمن يزيد ، وبعض الناس يزيد في ثمنه على بعض ، فذلك غير داخل في النهي ، والدليل عليه ما روي عن أنس أن رسول الله ( صلى الله عليه وسلم ) باع حلسا وقدحا وقال : " من يشتري هذا الحلس والقدح ؟ " فقال رجل : أخذتهما بدرهم ، فقال النبي ( صلى الله عليه وسلم ) " من يزيد على درهم ؟ " فأعطاه رجل درهمين فباعهما منه. وقال عطاء : أدركت الناس لا يرون بأسا ببيع المغانم فيمن يزيد. وكذلك الخطبة على خطبة الآخر ، وهو أن يخطب الرجل امرأة ، فأجابته أو أجابه وليها إذا لم تكن المرأة ممن يعتبر إذنها ، فليس للغير أن يخطب على خطبته ، فإن لم يوجد منها ، ولا من وليها إجابة في حق الأول ، بل رده أو سكت عن جوابه ، فيجوز للغير أن صفحة رقم 120 يخطبها ، فإن فاطمة بنت قيس قالت : يا رسول الله إن معاوية وأبا جهم خطباني قال : " انكحي أسامة " وإنما أمرها بنكاح أسامة ، لأنه لم يكن وقع الركون منها إلى من خطبها. وفي الحديث دليل على أن الخاطب إذا كان كافرا ، جاز أن يخطب على خطبته ، لقطع الله الأخوة بين المسلمين وبين الكفار.
