301 - أخبرنا عمر بن عبد العزيز ، أنا القاسم بن جعفر الهاشمي ، أنا أبو علي اللؤلؤي ، نا أبو داود ، نا عبد الوهاب بن نجدة ، نا بقية وشعيب بن إسحاق ، عن الأوزاعي ، حدثني محمد بن الوليد ، عن سعيد ابن أبي سعيد ، عن أبيه. عن أبي هريرة ، عن رسول الله ( صلى الله عليه وسلم ) قال : " إذا صلى صفحة رقم 95 أحدكم فخلع نعليه ، فلا يؤذ بهما أحدا ليجعلهما بين رجليه أو ليصل فيهما ".

302 - وأخبرنا عمر بن عبد العزيز ، أنا القاسم بن جعفر ، أنا أبو علي اللؤلؤي ، نا أبو داود ، حدثنا الحسن بن علي ، نا عثمان بن عمر ، نا صالح بن رستم أبو عامر ، عن عبد الرحمن بن قيس ، عن يوسف بن ماهك. عن أبي هريرة أن رسول الله ( صلى الله عليه وسلم ) قال : " إذا صلى أحدكم ، فلا يضع نعليه عن يمينه ، ولا عن يساره ، فتكون عن يمين غيره ، إلا أن لا يكون على يساره أحد ، وليضعهما بين رجليه ". وفرع أبو سليمان الخطابي أن من خلع نعله ، فتركها من ورائه ، أو عن يمينه ، أو متباعدة عنه من بين يديه ، فتعقل بها إنسان ، فتلف أن عليه الضمان ، كمن وضع حجرا في غير ملكه. ويحتج بحديث أبي سعيد من يذهب إلى أنه لو صلى وعلى ثوبه أو صفحة رقم 96 بدنه نجاسة غير معفوة ، وهو لا يشعر ، ثم علم بها أن لا إعادة عليه ، لأن النبي ( صلى الله عليه وسلم ) خلع نعله في خلال الصلاة ، ولم يستأنفها ، وهو قول سعيد بن المسيب ، والشعبي ، كما لو صلى بالتيمم ، ثم وجد الماء لا تجب عليه الإعادة بالاتفاق. وذهب أكثر أهل العلم إلى وجوب الإعادة إذا علم أنه صلى مع النجاسة ، كما لو علم أنه صلى محدثا. وروي عن ابن عمر أنه كان يصلي ، فرأى على ثوبه دما ، فألقاه فأتي بثوب آخر ، فلبسه ، واعتد بما صلى.

303 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، أنا أبو إسحاق الهاشمي ، أنا أبو مصعب ، عن مالك ، عن يزيد بن أسلم عن ابن وعلة المصري. عن عبد الله بن عباس أن رسول الله ( صلى الله عليه وسلم ) قال : " إذا دبغ الإهاب فقد طهر ". وأخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز ابن أحمد الخلال ، نا أبو العباس الأصم ( ح ) وأخبرنا أحمد بن عبد الله الصالحي ، ومحمد بن أحمد العارف قالا : أنا أبو بكر أحمد بن الحسن الحيري ، نا أبو العباس الأصم ، أنا الربيع ، أنا الشافعي ، أنا سفيان ، عن زيد بن أسلم بهذا الإسناد ، وقال : " أيما إهاب دبغ ففد طهر ". هذا حديث صحيح ، أخرجه مسلم عن يحيى بن يحيى ، عن سليمان صفحة رقم 98 ابن بلال ، عن زيد بن أسلم ، عن عبد الرحمن بن وعلة السبئي.

304 - أخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز ابن أحمد الخلال ، نا أبو العباس الأصم ( ح ) ، وأخبرنا أحمد بن عبد الله الصالحي ، ومحمد بن أحمد العارف ، قالا : أنا أبو بكر أحمد ابن الحسن الحيري ، نا أبو العباس الأصم ، أنا الربيع ، أنا الشافعي أنا ابن عيينة ، عن الزهري ، عن عبيد الله بن عبد الله. عن ابن عباس ، عن النبي ( صلى الله عليه وسلم ) مر بشاة لمولاة ميمونة ميتة ، فقال النبي ( صلى الله عليه وسلم ) : " ما على أهل هذه لو أخذوا إهابها فدبغوه فانتفعوا به " قالوا : يا رسول الله إنها ميتة ؟ قال : " إنما حرم أكلها ". هذا حديث متفق على صحته أخرجاه من طرق عن الزهري. وروي عن ميمونة ، قال رسول الله ( صلى الله عليه وسلم ) : " يطهرها الماء والقرظ ". صفحة رقم 99 قال الإمام رضي الله عنه : اتفق أهل العلم من الصحابة والتابعين ، فمن بعدهم رضي الله عنهم أن كل حيوان يؤكل لحمه ، فإذا مات يطهر جلده بالدباغ ، إلا شيئا يحكى عن أحمد أنه كان يقول : لا يطهر ، لما روي عن عبد الله بن عكيم قال : أتانا كتاب رسول الله ( صلى الله عليه وسلم ) قبل وفاته بشهرين " أن لا تنتفعوا من الميتة بإهاب ولا عصب " فكان يقول : هذا الحديث صار ناسخا لما سواه ، ثم ترك القول به للاضطراب في إسناده ، فإنه يروى عن عبد الله بن عكيم ، عن أشياخ لهم. وتأوله الآخرون إن ثبت على الانتفاع به قبل الدباغ ، قال النضر بن شميل : يسمى إهابا ما لم يدبغ. فأما ما لا يؤكل لحمه ، فاختلفوا في طهارة جلده بالدباغ ، فذهب جماعة إلى أنه لا يطهر بالدباغ جلد غير المأكول ، يروى ذلك عن عمر ، وعبد الرحمن بن عوف ، وهو قول الأوزاعي ، وابن المبارك ، وإسحاق ، وأبي ثور ، لما روي عن أبي المليح أن النبي ( صلى الله عليه وسلم ) " نهى علن جلود السباع ". صفحة رقم 100 وعن أبي ريحانة أن النبي ( صلى الله عليه وسلم ) " نهى عن ركوب النمور ". وذهب قوم إلى أنه يطهر الكل بالدباغ ، إلا جلد الكلب والخنزير ، وهو قول علي وابن مسعود ، وإليه ذهب الشافعي. وذهب أصحاب الرأي إلى أن جلد الكلب يطهر بالدباغ ، وهؤلاء حملوا النهي في حديث أبي المليح على ما قبل الدباغ ، وكذلك حديث أبي ريحانة ، لوأن جلد النمر إنما يركب لشعره ، والشعر لا يقبل الدباغ ، أو إنما نهي عنه ، لما فيه من الزينة والخيلاء.

305 - أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، أخبرنا أبو إسحاق الهاشمي ، نا أبو مصعب ، عن مالك ، عن يزيد بن عبد الله ابن قسيط ، عن محمد بن عبد الرحمن بن ثوبان ، عن أمه. عن عائشة أن رسول الله ( صلى الله عليه وسلم ) أمر أن يستمتع بجلود الميتة إذا دبغت ". صفحة رقم 101 وفي الحديث دليل على أنه يطهر بالدباغ ظاهر الجلد وباطنه حتى يجوز استعماله في الأشياء الرطبة ، ويجوز الوضوء فيه ، والصلاة معه.

306 - أخبرنا عبد الواحد بن أحمد المليحي ، أنا أحمد بن عبد الله النعيمي ، أنا محمد بن يوسف ، نا محمد إسماعيل ، نا محمد بن مقاتل ، أنا عبد الله ، أنا إسماعيل بن أبي خالد ، عن الشعبي ، عن عكرمة ، عن ابن عباس. عن سودة زوج النبي ( صلى الله عليه وسلم ) قالت : ماتت لنا شاة فدبغنا مسكها ، ثم مازلنا ننبذ فيه حتى صار شنا. هذا حديث صحيح. وفي قوله : " إنما حرم أكلها " مستدل لمن ذهب إلى أن ما عدا المأكول من أجزاء الميتة غير محرم الانتفاع به ، كالشعر والسن والقرن ونحوها ، واختلف فيها أهل العلم ، فذهب قوم إلى أن هذه الأشياء فيها حياة تنجس بموت الحيوان كالجلد ، وإذا دبغ جلد الميتة وعليه شعر ، فالشعر لا يطهر بالدباغ ، وهو قول الشافعي. وذهب قوم إلى أنه لا حياة في الشعر والريش ، ولا ينجس بموت الحيوان ، وجوزوا الصلاة فيها ، وهو قول حماد ، ومالك ، وأصحاب الرأي. قال مالك : لا بأس بالصلاة في صوف الميتة وشعرها إذا غسل ، ولا خير صفحة رقم 102 في الصلاة على جلدها وإن دبغ ، ولم يجوز بيعها. وكل حيوان لا يؤكل لحمه ، فذكاته كموته عند بعض أهل العلم ، وبه قال الشافعي ، وذهب قوم إلى أن جلده بعد الذكاة طاهر ، وهو قول مالك ، وأصحاب الرأي. والعظم عند بعضهم فيه حياة يموت بموت الحيوان ، وينجس بنجاسة الأصل. فأما الحوت فميته حلال ، فعظمه يكون طاهرا بعد الموت. وذهب جماعة إلى أنه لا حياة في العظم ، ولا يحله الموت ، وهو قول أصحاب الرأي ، وجوزوا استعمال عظام الفيلة. قال الزهري في عظام الموتى : أدركت ناسا من سلف العلماء يمتشطون بها ، ويدهنون فيها ، لا يرون بأسا. قال ابن سيرين وإبراهيم : لا بأس بتجارة العاج ، واحتجوا بما روي عن ثوبان أن رسول الله ( صلى الله عليه وسلم ) قال له : اشتر لفاطمة سوارين من عاج. والمراد منه عند الآخرين : الذبل ، وهو عظم سلحفاة البحر ، لا عظام الفيلة. ولا تحريم في شيء من الأواني الطاهرة إلا الذهب والفضة ، فقد صح عن عبد الله بن زيد أن النبي ( صلى الله عليه وسلم ) توضأ من ماء في تور من صفر صفحة رقم 103 وعن عائشة : كنت أغتسل أنا و رسول الله ( صلى الله عليه وسلم ) في تور من شبه. وعن أنس : أتي النبي ( صلى الله عليه وسلم ) بمخضب من حجارة ، فوضع يده فيه حتى توضؤوا.

307 - أخبرنا الشيخ الإمام حفظه الله ، نا الإمام الحسين بن مسعود ، أخبرنا أبو الحسن الشيرزي ، أنا زاهر بن أحمد ، أنا أبو إسحاق الهاشمي ، أنا أبو مصعب عن مالك ، عن عبد الرحمن بن القاسم ، عن أبيه. عن عائشة زوج النبي ( صلى الله عليه وسلم ) أنها قالت : خرجنا مع صفحة رقم 105 رسول الله ( صلى الله عليه وسلم ) في بعض أسفاره ، حتى إذا كنا بالبيداء ، أو بذات الجيش انقطع عقد لي ، فأقام رسول الله ( صلى الله عليه وسلم ) على التماسه ، وأقام الناس معه ، وليسوا على ماء ، وليس معهم ماء ، فأتى الناس أبا بكر ، فقالوا : ألا ترى ما صنعت عائشة ، أقامت ب رسول الله ( صلى الله عليه وسلم ) وبالناس ، وليسوا على ماء ، وليس معهم ماء ، فجاء أبو بكر و رسول الله ( صلى الله عليه وسلم ) واضع رأسه على فخذي ، قد نام ، فقال : حبست رسول الله ( صلى الله عليه وسلم ) والناس وليسوا على ماء ، وليس معهم ماء قالت : فعاتبني أبو بكر ، وقال ما شاء الله أن يقول ، وجعل يطعن بيده في خاصرتي ، فلا يمنعني من التحرك إلا مكان صفحة رقم 106 رسول الله ( صلى الله عليه وسلم ) على فخذي ، فقام رسول الله ( صلى الله عليه وسلم ) حين أصبح على غير ماء ، فأنزل الله سبحانه وتعالى آية التيمم فتيمموا. فقال أسيد بن الحضير - وهو أحد النقباء - : ما هي بأول بركتكم يا آل أبي بكر ، قالت عائشة : فبعثنا البعير الذي كنت عليه ، فوجدنا العقد تحته. هذا حديث متفق على صحته أخرجه محمد عن عبد الله بن يوسف صفحة رقم 107 وغيره ، وأخرجه مسلم عن يحيى بن يحيى ، كل عن مالك. وفي الحديث دليل على تأديب الرجل أهله وولده ، وإن لم يكن سلطانا حيث طعن أبو بكر في خاصرة عائشة ، وفي رواية قالت عائشة : أقبل أبو بكر ولكزني لكزة شديدة ، وقال : حبست الناس في قلادة.

308 - أخبرنا عبد الواحد بن أحمد المليحي ، أنا أحمد بن عبد الله النعيمي ، أنا محمد بن يوسف ، نا محمد بن إسماعيل ، نا آدم ، نا شعبة ، نا الحكم ، عن ذر ، عن سعيد بن عبد الرحمن بن أبزى عن أبيه قال جاء رجل إلى عمر بن الخطاب ، فقال : إني أجنبت فلم أصب الماء ، فقال عمار بن ياسر لعمر بن الخطاب : أما تذكر أنا كنا في سفر أنا وأنت ، فأما أنت فلم تصل ، وأما أنا فتمعكت فصليت ، فذكرت لرسول الله ( صلى الله عليه وسلم ) ، فقال النبي ( صلى الله عليه وسلم ) : " إنما يكفيك هذا " فضرب النبي ( صلى الله عليه وسلم ) بكفيه الأرض ، ونفخ فيهما ، ثم مسح بهما وجهه وكفيه. وقال محمد بن إسماعيل : وقال سليمان بن حرب عن شعبة : كنا صفحة رقم 109 في سرية فأجنبنا. وقال محمد بن إسماعيل : نا محمد بن كثير ، أنا شعبة عن الحكم عن ذر ، عن ابن عبد الرحمن ، عن عبد الرحمن. قال عمار لعمر : تمعكت فأتيت النبي ( صلى الله عليه وسلم ) ، فقال : " يكفيك الوجه والكفين ". هذا حديث متفق على صحته أخرجه مسلم عن عبد الله بن هاشم ، عن يحيى بن سعيد القطان ، عن شعبة ، وزاد : فقال عمر : اتق الله يا عمار ، قال : إن شئت لم أحدث به. والحكم : هو الحكم بن عتيبة أبو محمد الكندي ، مات سنة خمس عشرة ومائة ، يروي عن ذر بن عبد الله الهمداني. قال الإمام : وفي الحديث فوائد ، منها : جواز التيمم للجنب إذا لم يجد الماء ، وهو قول عامة أهل العلم ، وكذلك الحائض والنفساء إذا صفحة رقم 110 طهرتا وعدمتا الماء ، صلتا بالتيمم ، وذهب عمر وابن مسعود إلى أن الجنب لا يصلي بالتيمم وإن لم يجد الماء شهرا ، وكان عمر بن الخطاب قد نسي ما ذكره له عمار ، فلم يقنع بقوله. وروي عن ابن مسعود أنه رجع عن قوله ، وجوز للجنب التيمم إذا عدم الماء.

309 - أخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز ابن أحمد الخلال ، نا أبو العباس الأصم ( ح ) وأخبرنا أحمد بن عبد الله الصالحي ، ومحمد بن أحمد العارف ، قالا : أنا أبو بكر أحمد ابن الحسن الحيري ، نا أبو العباس الأصم ، أنا الربيع ، أنا الشافعي أنا إبراهيم بن محمد ، عن عباد بن منصور ، عن أبي رجاء العطاردي صفحة رقم 111 عن عمران بن الحصين أن النبي ( صلى الله عليه وسلم ) أمر رجلا كان جنبا أن يتيمم ، ثم يصلي ، فإذا وجد الماء اغتسل. هذا حديث متفق على صحته أخرجه محمد عن أبي الوليد ، عن سلم بن زرير ، وأخرجه مسلم عن أحمد بن سعيد الدارمي ، عن عبيد الله بن عبد المجيد ، عن سلم بن زرير ، عن أبي رجاء. وعمران بن الحصين أبو نجيد الخزاعي الأزدي نزل البصرة. وأبو رجاء العطاردي : اسمه عمران بن ملحان ، ويقال : عمران بن عبد الله ويقال : عمران بن تيم البصري. وروي عن أبي ذر قال : كانت تصيبني الجنابة فأمكث الخمس والست ، فقال النبي ( صلى الله عليه وسلم ) : " إن الصعيد الطيب وضوء المسلم وإن لم يجد الماء عشر سنين ، وإذا وجد الماء فليمسه بشره ". صفحة رقم 112 قال الإمام رضي الله عنه : وفي حديث عمار دليل على أن مسح الوجه واليدين كاف للجنب كما يكفي للمحدث ، فمسح الوجه واليدين بالتراب تارة يكون بدلا عن غسل أعضاء الوضوء في حق المحدث ، وتارة يكون بدلا عن غسل جميع البدن في حق الجنب ، والحائض ، والميت عند العجز عن استعمال الماء لعدم أو مرض يخاف منه الهلاك أو زيادة المرض ، وتارة يكون بدلا عن غسل لمعه من بدنه بأن كان على عضو من أعضاء طهارته جرح يخاف من إيصال الماء إليه الهلاك ، أو تلف العضو ، أو زيادة الوجع ، فعليه أن يغسل الصحيح من أعضائه ، ويتيمم بالتراب على الوجه واليدين بدلا عن غسل موضع الجرح. وإذا ضرب يده على التراب ، فعلق بها تراب كثير ، فلا بأس أن ينفخ فيها حتى يخف ما عليها من التراب ، كما جاء في الحديث ، فلو أزال بالنفخ جميع ما عليها من التراب لم يصح تيممه عند بعض أهل العلم ، وهو قول الشافعي ، وذهب بعضهم إلى أنه يجوز ، وهو قول أصحاب الرأي ، حتى قالوا : لو ضرب يده على صخرة صماء لا غبار عليها ، فمسح وجهه ويديه جاز ، والأول أولى ، لقوله سبحانه وتعالى : صفحة رقم 113 ) فتيمموا صعيدا طيبا ( ، قال ابن عباس : الصعيد : هو التراب. وروي عن حذيفة قال : قال رسول الله ( صلى الله عليه وسلم ) : " جعلت لنا الأرض كلها مسجدا ، وجعلت تربتها لنا طهورا إذا لم نجد الماء ". خص التراب بكونه طهورا ، وعن هذا قال الشافعي : لا يصح التيمم بالزرنيخ والنورة والجص ونحوه ، إنما يجوز بما يقع عليه اسم التراب من كل أرض سبخها ومدرها وبطحائها وغيره مما يعلق باليد منه غبار. وجوز أصحاب الرأي التيمم بالزرنيخ والجص والنورة وغيرها من طبقات الأرض ، لما روي عن جابر أن النبي ( صلى الله عليه وسلم ) قال : " جعلت الأرض مسجدا وطهورا " ، وهذا الحديث مجمل ، وحديث حذيفة مفسر ، والمفسر من الحديث يقضي على المجمل. وفي حديث عمار دليل على أن التيمم ضربة واحدة للوجه والكفين ، صفحة رقم 114 وهو قول علي ، وابن عباس ، وعمار ، ومن التابعين قول الشعبي ، وعطاء ابن أبي رباح ، ومكحول ، وبه قال الأوزاعي ، وأحمد ، وإسحاق ، وجماعة من أصحاب الحديث. وما روي عن عمار أنه قال : تيممنا إلى المناكب ، فهو حكاية فعله لم ينقله عن رسول الله ( صلى الله عليه وسلم ) ، قال الإمام : كما حكى عن نفسه التمعك في حال الجنابة ، فلما سأل النبي ( صلى الله عليه وسلم ) ، وأمره بالوجه والكفين انتهى إليه ، وأعرض عن فعله. وذهب جماعة إلى أن التيمم ضربتان : ضربة للوجه ، وضربة لليدين إلى المرفقين ، وهو قول عبد الله بن عمر ، وجابر ، ومن التابعين قول سالم بن عبد الله بن عمر ، والحسن ، وإبراهيم النخعي ، وبه قال مالك ، وسفيان الثوري ، وابن المبارك والشافعي ، وأصحاب الرأي ، واحتجوا بحديث ابن الصمة ، وهو ما.

310 - أخبرنا عبد الوهاب بن محمد الكسائي ، أنا عبد العزيز بن أحمد الخلال ، نا أبو العباس الأصم ( ح ) وأخبرنا أحمد بن عبد الله الصالحي ، ومحمد بن أحمد العارف ، قالا : أخبرنا أبو بكر أحمد بن الحسن الحيري ، نا أبو العباس الأصم ، أنا الربيع ، أنا الشافعي ، أنا إبراهيم بن محمد ، عن أبي الحويرث ، عن الأعرج. صفحة رقم 115 عن ابن الصمة قال : مررت على النبي ( صلى الله عليه وسلم ) وهو يبول ، فسلمت عليه ، فلم يرد علي حتى قام إلى جدار فحته بعصا كانت معه ، ثم وضع يده على الجدار ، فمسح وجهه وذراعيه ثم رد علي. هذا حديث حسن. وفيه فوائد منها وجوب مسح اليدين إلى المرفقين ، وهذا أشبه بالأصول ، والأول أصح في الرواية ، وهو مسح الوجه والكفين. ومنها أن التيمم لا يصح ما لم يعلق باليد غبار التراب ، لأن النبي ( صلى الله عليه وسلم ) حت الجدار بالعصا ، ولو كان مجرد الضرب كافيا لكان لا يحته. ومنها استحباب الطهارة لذكر الله سبحانه وتعالى.

312 - أخبرنا عمر بن عبد العزيز ، أخبرنا القاسم بن جعفر الهاشمي ، أنا أبو علي اللؤلؤي ، نا أبو داود ، نا عبد الأعلى ، نا سعيد ، عن قتادة ، عن الحسن ، عن حضين بن المنذر. صفحة رقم 117 عن المهاجر بن قنفذ أنه أتى النبي ( صلى الله عليه وسلم ) وهو يبول ، فسلم عليه ، فلم يرد عليه حتى توضأ ، ثم اعتذر إليه ، وقال : " إني كرهت أن أذكر الله إلا على طهر ، أو قال : على طهارة ". وروي عن ابن عمر قال : مر رجل على رسول الله ( صلى الله عليه وسلم ) وهو يبول فسلم فلم يرد عليه. ففيه بيان أن رد السلام وإن كان فرضا واجبا ، فالمسلم على الرجل في مثل هذه الحالة مضيع حظ نفسه ، فلا يستحق الجواب. وفيه دليل على كراهية الكلام على قضاء الحاجة حيث لم يخبره ، ولم يعتذر إليه قبل الفراغ. وفي الحديث دليل على أن من أراد ذكر الله في الحضر وهو على غير طهارة ولا ماء معه أنه يتيمم. وقال الأوزاعي في الجنب إذا خاف طلوع الشمس : لو اغتسل صلى بالتيمم. صفحة رقم 118 وقال أصحاب الرأي : إذا خاف فوت صلاة الجنازة ، أو صلاة العيد لو اشتغل بالوضوء ، صلى بالتيمم مع وجود الماء ، ولم يجوزوا صلاة الجمعة بالتيمم مع وجود الماء وإن خاف فوتها مع كونها آكذ من صلاة الجنازة والعيد. ولا يجوز عند الشافعي أداء صلاة ما بالتيمم وهو يقدر على الوضوء ، فإن لم يجد في المصر ماء ، صلى بالتيمم ، وأعاد إذا قدر على الماء ، وبه قال عطاء : إنه يصلي بالتيمم ، وكذلك قال الشافعي إذا لم يجد ماء ولا ترابا ، صلى لحق الوقت ، ثم أعاد إذا قدر على أحد الطهورين. وقال الحسن في المريض عنده الماء ولا يجد من يناوله : تيمم ، وأوجب أصحاب الشافعي إعادة الصلاة إذا قدر على من يناوله الماء فأما من صلى بالتيمم في السفر لعدم وجود الماء ، أو تيمم لمرض مخوف في السفر أو الحضر ، ثم برأ ، أو قدر على استعمال الماء ، فلا قضاء عليه ، سواء كان جنبا أو محدثا ، وسواء كان الوقت باقيا أو فائتا ، وهو قول أكثر أهل العلم. روي عن ابن عمر أنه أقبل من الجرف ، حتى إذا كان بالمربد تيمم فمسح وجهه ويديه ، وصلى العصر ، ثم دخل المدينة والشمس مرتفعة ، ولم يعد الصلاة. وهذا قول سعيد بن المسيب ، والشعبي ، وإليه صفحة رقم 119 ذهب مالك ، وسفيان ، والشافعي ، وأحمد ، وإسحاق ، وأصحاب الرأي. وذهب قوم إلى أنه يعيد إن كان الوقت باقيا ، وهو قول عطاء وطاوس ، وابن سيرين ، ومكحول ، والزهري. فأما إذا وجد المتيمم الماء في خلال الصلاة يتمها عند بعض أهل العلم ، وهو قول مالك ، والشافعي. وذهب جماعة إلى أنه يستأنف الصلاة بالوضوء ، وهو قول أصحاب الرأي ، وذهب جماعة إلى أنه إذا دخل وقت الصلاة ولا ماء معه ، وكان على رجاء من وجود الماء ، يؤخر الصلاة عن أول الوقت ، وهو قول عطاء ، وبه قال مالك ، وسفيان ، وأحمد ، وأصحاب الرأي ، وهو قول الشافعي. وذهب قوم إلى أنه يعجل الصلاة بالتيمم ، روي عن ابن عمر أنه أقبل من الجرف ، حتى إذا كان بالمربد تيمم وصلى العصر ، ثم دخل المدينة والشمس مرتفعة ، ولم يعد الصلاة. فأما إذا كان لا يرجو وجود الماء ، فذهب قوم إلى أنه يؤخر أيضا ، قال الزهري : لا يتيمم حتى يخاف ذهاب الوقت. صفحة رقم 120 والجريح إذا قدر على غسل بعض أعضاء طهارته ، عليه أن يغسل الصحيح ، ويتيمم لأجل الجريح ، سواء كان أكثر أعضائه صحيحا أو جريحا ، لما.
