2986 - (9) [صحيح] وعن نافعٍ قال: كان ابنُ عُمَر يقتل الحيَّاتِ كلُّهُنَّ حتى حدَّثنا أبو لُبابَة: "أنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - نَهى عَنْ قَتْلِ جِنّانِ البيُوتِ"، فأمْسكَ. رواه مسلم. [صحيح] وفي رواية له [و] (2) لأبي داود: قال أبو لبابة: سمعتُ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "نهى عن قتْلِ الجِنَّانِ التي تكونُ في البيُوتِ، إلا الأبْترَ وذا الطُّفْيَتَيْنِ (3) فإنَّهما اللَّذان يخْطُفانِ البصَرَ، وُيتبعانِ ما في بطونِ النساءِ".

2987 - (10) [صحيح] وعن أبي السائب: أنَّه دخلَ على أبي سعيدٍ الخدْريِّ في بيْتِه، قال: فوجَدْتُه يصلِّي، فجلَسْتُ أنْتَظِرُه حتى يَقْضِيَ صلاتَهُ، فسمعْتُ تحريكاً في عَراجينَ (4) في ناحيَةِ البيْتِ، فالتفتُّ فإذا حيَّةٌ، فوثَبْتُ لأقْتُلَها، فأشارَ إليَّ أنِ اجْلِسْ فجلَسْتُ، فلمَّا انْصرَف أشارَ إلى بيْتٍ في الدارِ فقالَ: أترى هذا البيْتَ؟ فقلتُ: نعم. قال: كان فيهِ فتىً منَّا حديثُ عهد بعُرْسٍ، قال: فخرجْنا معَ رسولِ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - إلى الخَنْدَقِ، فكانَ ذلك الفتَى يسْتَأْذِنُ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - بأنْصافِ النهارِ فيرجعُ إلى أهْلِه، فاسْتأْذَنُه يَوْماً، فقالَ لَهُ: "خُذْ عليكَ سِلاحَكَ، فإنِّي أخْشَى عليك قرَيْظَةَ". فأخذَ الرجلُ سِلاحَهُ ثمَّ رَجَع، فإذا امْرأَتُه بينَ البابَيْن قائِمةً، فأهْوى إلَيْها بالرُّمْحِ لِيَطْعَنها به، وأصابَتْهُ غَيْرة، فقالَتْ له: اكفُفْ علَيْكَ رُمْحَك، وادْخُلِ البَيْتَ حتى تَنْظُرَ ما الَّذي أخْرَجَني، فدَخَل فإذا بحَيَّةٍ عَظيمَةٍ مَنْصوبَةٍ على الفراشِ، فأهْوى إليْها بالرُّمْحِ، فانْتَظمها بِهِ ثُمَّ خَرج، فَركزَهُ في الدارِ، فاضْطَربَتْ عليهِ، فما يُدْرى أيُّهمَا كانَ أسْرَع مَوْتاً الحيَّةُ أَمِ الفَتى. قال: فجئْنا رَسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - وذَكرْنا ذلك له، وقُلْنا: ادْعُ الله أنْ يُحْيِيَهُ لَنا. فقال: "اسْتَغْفِروا لِصاحِبِكُم". ثُمَّ قال: "إنَّ بالمدينَة جِنّاً قدْ أسْلَموا، فإذا رأيْتُم منهُمْ شَيْئاً فآذِنُوهُ ثَلاثَةَ أيَّامٍ، فإنْ بَدا لَكُمْ بعدَ ذلك فاقْتُلوه، فإنَّما هو شَيْطانٌ". وفي رواية نحوه وقال فيه: إنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "إنَّ لهذهِ البيوتِ عَوامِرَ، فإذا رأيْتُم مِنْها شَيْئاً فَحرِّجُوا عليها ثَلاثاً، فإنْ ذَهَب، وإلا فاقْتُلوهُ فإنَّهُ كافِرٌ". وقال لهم: "اذْهَبوا فادْفِنوا صاحِبَكُمْ". رواه مالك ومسلم وأبو داود. __________ (1) قلت: رواه أحمد بسند صحيح عنه موقوفاً، وقد صح عنه مرفوعاً. وهو مخرج في "الصحيحة" (1824). (2) سقطت من الأصل، ومع ظهوره لم يتنبه له المعلقون الثلاثة مع عزوهم الحديث لمسلم (2233) وأبي داود (5253) بالأرقام، مما يؤكد أنهم ينقلونها لإيهام القراء أنهم يحققون، ولا شيء منه البتة! هداهم الله. (3) يأتي تفسيره بعد حديث. (4) جمع (العرجون): وهو العود الأصفر الذي فيه شماريخ العذق. كما في "النهاية". وقال: أراد بها الأعواد التي في سقف البيت، شبهها بالعراجين.

2988 - (11) [صحيح] وعنِ ابْنِ عمر رضي الله عنهما: أنَّه سمعَ النبيَّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - يخطُبُ على المنبَرِ يقولُ: "اقْتلوا الحيَّاتِ، واقْتُلوا ذا الطُّفْيَتَيْنِ والأبْتَر، فإنَّهما يَطْمِسَان البَصَر، ويُسْقِطانِ الحَبَل". قال عبد الله: فبَيْنا أنا أُطارِدُ حَيَّةً أقْتُلها ناداني أبو لُبَابَة: لا تَقْتُلْها. فقلْتُ: "إنَّ رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - أمَرَ بقَتْلِ الحيّاتِ". قال: "إنَّه نَهى بعد ذلكَ عَنْ ذاوتِ البُيوتِ، وهُنَّ العَوامِرُ". رواه البخاري ومسلم. ورواه مالك وأبو داود والترمذي بألفاظ متقاربة. [صحيح] وفي رواية لمسلم قال: سمعتُ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - يأمُرُ بقَتْلِ الكِلاب يقول: "اقْتُلوا الحيَّاتِ والكِلابَ، واقْتلُوا ذا الطُّفْيَتَيْنِ والأبْتَر، فإنَّهما يَلْتَمسَان البَصَر، وَيَسْتَسْقِطان الحُبالى". -قال الزهري: ونُرى ذلك من سُمَّيْهِما والله أعلم- قال سالم: قال عبدُ الله بنُ عُمَرَ: فلبِثْتُ لا أتْركُ حيَّةً أراها إلا قتلْتُها، فبينا أنا أطارِدُ حَيَّةً يوماً مِنْ ذواتِ البيُوتِ مَرَّ بي زيدُ بْنُ الخطَّابِ أوْ أبو لُبابَةَ وأنا أطارِدُها، فقال: مَهْلاً يا عبد الله! فقلتُ: "إنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - أمَر بِقَتْلِهِنَّ". قال: "إنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - نَهى عنْ ذَواتِ البُيوتِ". [صحيح] وفي رواية لأبي داود قال: إنَّ ابْنَ عمر وَجَد بعد ما حدَّثَهُ أبو لُبابَة حيَّةً في دارِه، فأمَر بِها فأُخْرِجَتْ إلى البَقيع. قال نافعٌ: ثُمَّ رأيتُها بعدُ في بَيْتِهِ. (الطُّفْيَتَانِ) بضم الطاء المهملة وإسكان الفاء: هما الخطان الأسودان في ظهر الحية. وأصل (الطفية): خُوْصَةُ المُقْل (1)، شبه الخطين على ظهر الحية بخوصتي المُقل. وقال أبو عمر النمري: "يقال: إن ذا الطفيتين جنس يكون على ظهره خطان أبيضان". و (الأَبْتَرُ): هو الأفعى. وقيل: جنس أبتر كأنه مقطوع الذنب. وقيل: هو صنف من الحيات أزرق مقطوع الذنب إذا نظرت إليه الحامل ألقت. قال النضر بن شميل. وقوله: " (يلتمسان البصر) معناه: يطمسانه بمجرد نظرهما إليه بخاصية جعلها الله فيهما". (قال الحافظ): "قد ذهب طائفة من أهل العلم إلى قتل الحيات أجمع؛ في الصحارى والبيوت بالمدينة وغير المدينة، ولم يستثنوا في ذلك نوعاً ولا جنساً ولا موضعاً، واحتجوا في ذلك بأحاديث جاءت عامة كحديث ابن مسعود المتقدم وأبي هريرة وابن عباس. وقالت طائفة: تقتل الحيات أجمع إلا سواكن البيوت بالمدينة وغيرها، فإنهن لا يقتلن، لما جاء في حديث أبي لبابة وزيد بن الخطاب من النهي عن قتلهن بعد الأمر بقتل جميع الحيات. وقالت طائفة: تنذر سواكن البيوت في المدينة وغيرها، فإن بَديْنَ بعد الإنذار قُتِلْنَ، وما وجد منهن في غير البيوت يقتل من غير إنذار. وقال مالك: يقتل ما وجد منها في المساجد. واستدل هؤلاء بقوله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "إنَّ لهذه البُيوتِ عوامِرَ، فإذا رأيْتُم منها شَيْئاً فحرِّجوا عليها ثلاثاً فإنْ ذَهَب وإلا فَاقْتُلوهُ". واختار بعضهم أن يقول لها ما ورد في حديث أبي ليلى المتقدم (1). وقال مالك: يكفيه أن يقول: أُحرج عليك بالله واليوم الآخر أن لا تبدو لنا ولا تؤذينا. وقال غيره: يقول لها أنت في حرج إن عدت إلينا فلا تلومينا أن نضيق عليك بالطرد والتتبع. وقالت طائفة: لا تنذر إلا حيات المدينة فقط؛ لما جاء في حديث أبي سعيد المتقدم من إسلام طائفة من الجن بالمدينة، وأما حيات غير المدينة في جميع الأرض والبيوت فتقتل من غير إنذار، لأنا لا نتحقق وجود مسلمين من الجن ثَمَّ، ولقوله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "خَمسٌ مِنَ الفَواسِقِ تُقْتَلُ في الحِلِّ والحَرمِ". وذكر منهن الحية. وقالت طائفة: يقتل الأبتر وذو الطفيتين من غير إنذار، سواء كن بالمدينة وغيرها لحديث أبي لبابة: سمعتُ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "نَهى عنْ قتْلِ الجِنَّانِ التي تكون في البُيوتِ، إلا الأَبْتَر وذَا الطُّفْيَتَيْنِ". ولكل من هذه الأقوال وجه قوي، ودليل ظاهر. والله أعلم".

2989 - (12) [صحيح] وعن أبي هريرة رضي الله عنه عن رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "إنَّ نَملةً قرصَتْ نبيّاً مِنَ الأَنْبِياءِ، فأَمر بقَرْيةِ النَّمْلِ فأُحْرِقَتْ، فأَوْحَى الله إليه [أ] في أنْ قَرَصَتْكَ نَمْلةٌ أحْرَقْتَ أُمَّةً مِنَ الأمَمِ تُسَبِّحُ؟! ". (زاد في رواية:) "فَهَلا نَملَةً واحِدَةً؟ ". رواه البخاري ومسلم وأبو داود والنسائي وابن ماجه. وفي رواية لمسلم وأبي داود: قال: "نزَلَ نبيٌّ مِنَ الأَنْبياءِ تَحْتَ شَجرةٍ، فلَدغَتْهُ نَمْلةٌ، فأمر بِجِهَازِهِ فأُخْرِجَ مِنْ تَحْتِها، ثُمَّ أَمر فأُحْرِقَتْ، فأَوْحى الله إليهِ: هلا نَملةً واحِدةً؟ ". (قال الحافظ): "قد جاء من غير ما وجه أن هذا النبي هو عزير عليه السلام. وفي قوله: (فهلا نملة واحدة) دليل على أن التحريق كان جائزاً في شريعتهم، وقد جاء في خبر (1): "أنَّه مرَّ بِقَرْيَةٍ أوْ بمدينَةٍ أهْلكَها الله تعالى فقال: يا ربِّ كانَ فيهِمْ صِبْيانٌ ودَوابٌّ ومَنْ لَمْ يَقْتَرِفْ ذَنْباً، ثُمَّ إنَّهُ نَزلَ تحْتَ شَجَرةٍ، فجَرتْ بِهِ هذه القِصَّةُ التي قدَّرهَا الله على يَديْهِ، تَنْبيهاً له على اعتِراضِه على بَديعِ قُدْرَةِ الله وقَضائه في خَلْقِهِ، فقال: إنَّما قَرصَتْكَ واحِدَةٌ فهلا قَتلْتَ واحِدةً؟ ". وفي الحديث تنبيه على أن المنكر إذا وقع في بلد لا يؤمَن العقاب العام". __________ (1) قلت: هو في "الضعيف"، فراجعه في هذا الباب، فيكتفى بالتخريج المذكور في الحديث الصحيح رقم (10 - هنا).

2990 - (13) [صحيح] وعن ابن عباسٍ رضي الله عنهما: "أنَّ النبيَّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - نَهى عَنْ قتلِ أرْبعٍ مِنَ الدوابِّ: النملةِ، والنحْلَةِ، والهُدْهُدِ، والصُّرَدِ". رواه أبو داود وابن ماجه وابن حبان في "صحيحه". (الصُّرَدُ) بضم الصاد المهملة وفتح الراء: طائر معروف ضخم الرأس والمنقار، له ريش (2) عظيم نصمه أبيض ونصفه أسود. (قال الخطابي): "أما نهيه عن قتل النمل، فإنما أراد نوعاً منه خاصاً، وهو الكبار ذوات الأرجل الطوال؛ لأنها قليلة الأذى والضرر. وأما النحلة فلما فيها من المنفعة، وأما الهدهد والصرد، فإنما نهى عن قتلهما لتحريم لحمهما، وذلك أن الحيوان إذا نُهِيَ عن قتله ولم يكن ذلك لحرمة ولا لضرر فيه، كان ذلك لتحريم لحمه". __________ (1) قلت: ما أراه إلا من الإسرائيليات، وقد حكى الحافظ في "الفتح" (6/ 255) قولين في اسم المذكور، قيل هو العزير. وروى الحكيم الترمذي أنه موسى عليه السلام. قال الحافظ: وبذلك جزم الكلاباذي في "معاني الأخبار"، والقرطبي في "التفسير". قلت: ولا وجه للجزم بشيء من ذلك ما دام أنه غير مرفوع، فتنبه. ثم أشار الحافظ إلى تضعيف هذا الخبر بقوله: "ويقال: إن لهذه القصة سبباً، وهو أن النبي مر. . فذكره". (2) قال الناجي (201/ 2): "كذا وجد هنا، وكذا في "حواشي السنن" له، وهو تصحيف، وإنما هو: (له برثُن) بضم الموحدة والمثلثة بينهما مهملة ساكنة، وآخره نون. قال الأصمعي: (البراثن) من السباع والطير، وهي بمنزلة الأصابع من الإنسان، قال: و (المخلب): ظفر البرثن".

2991 - (14) [صحيح] وعن عبد الرحمن بن عثمان (1) رضي الله عنه: "أنَّ طبيباً سأل النبيَّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - عَنْ ضِفْدعٍ يَجْعَلُها في دَواءٍ؟ فَنهاهُ عَنْ قَتْلِها". رواه أبو داود والنسائي. (قال الحافظ): "الضفدع بكسر الضاد والدال؛ وفتح الدال ليس بجيد. والله أعلم". __________ (1) الأصل: (بن عبادة)، قال الناجي: "وهو تصحيف قبيح بلا شك، وإنما هو ابن عثمان ابن عبيد الله القرشي التيمي ابن أخي طلحة بن عبيد الله أحد العشرة".

2992 - (1) [صحيح لغيره] عن أنسٍ بن مالكٍ رضي الله عنه عنِ النبيِّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "تَقَبَّلُوا إليَّ ستّاً أتَقبَّلْ لكمُ بِالجَنَّةِ: إذا حدَّثَ أحدُكم فلا يكْذِبْ، وإذا وَعد فلا يُخْلِفْ، وإذا ائْتُمِنَ فلا يَخُنْ" الحديث. رواه أبو يعلى والحاكم والبيهقي. وتقدم في "الصدق" [هنا/ 24 - باب].

2993 - (2) [صحيح لغيره] وعن عبادة بن الصامت رضي الله عنه؛ أنَّ النبيَّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "اضْمَنوا لي ستّاً أَضْمَنْ لكُم الجَنَّةَ: اصدُقوا إذا حَدَّثْتُم، وأَوفوا إذا وَعَدتُم، وأدُّوا إذا ائْتُمِنْتُم" الحديث. رواه أحمد، وابن حبان في "صحيحه"، والحاكم والبيهقي. وتقدم [17 النكاح/ 1].

2994 - (3) [صحيح] وعن حذيفة قال: حدثنا رسولُ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "إنَّ الأمانَة نَزلَتْ في جَذْرِ قُلوبِ الرجَالِ، ثُمَّ نَزلَ القُرآنُ، فَعَلِموا مِنَ القُرآنِ، وَعَلِموا مِنَ السُنَّةِ". ثُمَّ حدَّثنا عنْ رَفْع الأمانَةِ؛ فقال: "ينامُ الرجَلُ النومَةَ، فَتقْبَضُ الأمانَة مِنْ قَلْبِهِ، فيظَلُّ أَثرُهَا مثلَ الوَكْتِ، ثمَّ ينامُ الرجل النَّومةَ، فتقبضُ الأمانةُ من قلبه، فيظلُّ أثرها مثل أثر المَجْل، كجَمْرٍ دَحْرَجْتَهُ على رجْلِكَ فنَفِطَ (1)، فتراه مُنْتَبِراً وليسَ فيهِ شيْءٌ، -ثُمَّ أخَذَ حَصاةً فَدَحْرَجَها على رِجْلِه -فيصْبِحُ الناسُ يَتبايَعونَ لا يَكادُ أحَدٌ يُؤَدِّي الأمَانَة، حتَّى يقالَ: إنَّ في بني فُلان رَجلاً أميناً، حتَّى يقالَ لِلرجُلِ: ما أظْرَفَهُ! ما أعْقَلَهُ! وما في قلبهِ مثقالُ حَبَّةٍ مِنْ خرْدَلٍ مِنْ إيمانٍ". رواه مسلم وغيره (1). (الجَذْرُ) بفتح الجيم وإسكان الذال المعجمة: هو أصل الشيء. و (الوَكْتُ) بفتح الواو وإسكان الكاف بعدها تاء مثناة: هو الأثر اليسير. و (المَجْلُ) بفتح الميم وإسكان الجيم: هو تنفط اليد من العمل وغيره. وقوله: (منتبراً) بالراء، أي: مرتفعاً. __________ (1) يقال: (نفطت يده -من باب تعب- نفطاً ونفيطاً): إذا صار بين الجلد واللحم ماء. وتذكير الفعل المسند إلى (الرِّجل) وكذا تذكير قوله: (فتراه منتبراً) مع أن (الرجل) مؤنثة باعتبار معنى العضو.

2995 - (4) [حسن] وعن ابن مسعود رضي الله عنه قال: "القتلُ في سبيلِ الله يكفّرُ الذنوبَ كلَّها، إلا الأمانة". قال: "يؤتى بالعبدِ يومَ القيامةِ وإن قُتِلَ في سبيل الله، فيقالُ: أدِّ أمانَتَك، فيقول: أيْ ربِّ! كيف وقد ذهبتِ الدنيا؟ فيقال: انطلقوا به إلى الهاوية، فيُنْطَلَقُ به إلى الهاويةِ، وتُمثَّلُ له أمانتُه كهيئتها يوم دُفِعَتْ إليه، فيراها فيعرفها، فيهوي في أثرها حتى يدركَها، فيحملها على منكبيه، حتى إذا ظنَّ أنه خارجٌ؛ زلت عن منكبيه، فهو يهوي في أثرها أبد الآبدين". ثم قال: "الصلاةُ أمانةٌ، والوضوءُ أمانةٌ، والوزنُ أمانةٌ، والكيلُ أمانةٌ -وأشياءُ عدَّدها-، وأشدُّ ذلك الودائع". قال -يعني زاذان-: فأتيت البراء بن عازب فقلت: ألا ترى إلى ما قال ابن مسعود؟ قال: كذا، قال: كذا. قال: صَدَق، أما سمعت الله يقول: {إِنَّ اللَّهَ يَأْمُرُكُمْ أَنْ تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا}؟! رواه أحمد والبيهقي موقوفاً. [مضى 16 - البيوع/ 19]. (1) وذكر عبد الله ابن الإمام أحمد في "كتاب الزهد"؛ أنه سأل أباه عنه؟ فقال: "إسناده جيد". __________ (1) قال الناجي: "وكذا البخاري، لكن ليس عنده دحرجة الحصاة". قلت: أخرجه كذلك في ثلاثة مواطن: "الرقاق" و"الفتن" و"الاعتصام"، وأخرجه الترمذي (2180) بتمامه وقال: "حديث حسن صحيح"، وأحمد (5/ 383)، وابن ماجه أيضاً (4053)؛ إلا أنه أوقف جملة الحصاة فقال: "ثم أخذ حذيفة كفاً من حصى فدحرجه على ساقه"، وإسناده صحيح.

2996 - (5) [صحيح] وعن عمران بن حصينٍ رضي الله عنهما عن النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "خَيْرُكم قَرْني، ثُمَّ الَّذينَ يَلُونَهُمْ، ثُمَّ الَّذينَ يَلُونَهُمْ، ثُمَّ يَكونُ بَعْدَهُم قومٌ يشْهَدُون ولا يُسْتَشْهَدونَ، وَيخُونُونَ ولا يُؤْتَمَنُونَ، وَينْذُرون ولا يُوفُونَ، وَيظْهَرُ فيهِمُ السِّمَنُ". رواه البخاري ومسلم.
