3069 - (6) [صحيح] وعن ابن عمر أيضاً قال: قال رسولُ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "لا يُقيمَنَّ أحَدُكم رجلاً مِنْ مَجْلِسه ثُمَّ يَجْلِسُ فيه، ولكنْ تَوسَّعُوا وتَفَسَّحوا؛ يَفْسَحِ الله لَكُمْ". وفي رواية: قال: وكان ابن عمر إذا قام له رجلٌ مِنْ مَجْلِسِه لَمْ يَجْلِسْ فيهِ. رواه البخاري ومسلم.

3070 - (7) [حسن لغيره] وعن جابر بن سمرة رضي الله عنهما قال: "كنا إذا أتينا النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - جلسَ أحدُنا حيث ينتهي". رواه أبو داود، والترمذي وحسنه، وابن حبان في "صحيحه". __________ (1) زيادة من (ابن حبان/ 5645 - الإحسان)، وسقطت من "الموارد" (1956) أيضاً، ولم أفهم لهذه الجملة هنا معنى، لأن ابن جريج هو الذي روى السياق الأول: "يدي اليسرى". فلعل الأصل: "وقال ابن جريج مرة. ."، والله أعلم. انظر التعليق على كتابي "صحيح الموارد" (32 - الأدب/ 15).

3075 - (12) [صحيح] وعن أبي سعيدٍ أيضاً؛ أن رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "إيَّاكمْ والجلوسَ بالطُّرقاتِ". قالوا: يا رسولَ الله! ما لَنا بُدّ مِنْ مَجالِسنا نتحدَّثُ فيها؟ فقال رسولُ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "إنْ أَبَيْتُمْ؛ فأَعْطوا الطريقَ حَقَّهُ". قالوا: وما حَقُّ الطريقِ يا رسولَ الله؟ قال: "غَضُّ البصَرِ، وكفُّ الأَذى، وردُّ السلامِ، والأَمْرُ بالمعروفِ، والنهيُ عَنِ المنكَرِ". رواه البخاري ومسلم وأبو داود.

3076 - (1) [صحيح لغيره] عن عبد الرحمن بن عليّ -يعني ابن شيبان- عن أبيه رضي الله عنه قال: قال رسولُ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "مَنْ باتَ على ظهْرِ بيْتٍ ليسَ له حِجارٌ، (1) فقدْ بَرِئَتْ منهُ الذِّمَّةُ". رواه أبو داود. (قال الحافظ): "هكذا وقع في روايتنا "حجار" بالراء بعد الألف. وفي بعض النسخ "حجاب" بالباء الموحدة، وهو بمعناه".

3078 - (3) [حسن] وروي عن أبي عمران الجَوْني قال: كنَّا بفارِس وعلينا أميرٌ يُقالُ له: (زُهَيْرُ بْنُ عَبْدِ الله)، فأبْصَر إنْساناً فوْقَ بَيْتٍ أوْ إجّارٍ ليسَ حوله شَيْءٌ، فقال لي: سمعتَ في هذا شيْئاً؟ قلتُ: لا. قال: حدَّثَني رجلٌ أنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "مَنْ باتَ فوْقَ إِجَّارٍ أو فوْقَ بيْتٍ ليسَ حوْلَهُ شيءٌ يرُدُّ رِجلَهُ؛ فقد بَرِئَتْ منهُ الذِّمَّةُ، ومَنْ رَكِبَ البَحْرَ بَعْدَ ما يَرتَجُّ؛ فقد بَرِئَتْ منه الذِمَّةُ". رواه أحمد مرفوعاً هكذا وموقوفاً، ورواتهما ثقات، والبيهقي مرفوعاً. [حسن لغيره] وفي رواية للبيهقي عن أبي عمران أيضاً قال: كنتُ مَع زُهَيْر الشَّنَوِي (1)، فأتَيْنا على رجلٍ نائمٍ على ظهْرِ جِدَارٍ، وليسَ لَهُ ما يَدْفَعُ رجْلَيْهِ، فضرَبَهُ بِرِجْلِه، ثُمَّ قال: قُمْ، ثُمَّ قال زهيرٌ: قالَ رسولُ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "مَنْ باتَ على ظَهْرِ جِدارٍ وليسَ لَهُ ما يَدْفَعُ رِجْلَيْه، فوقَعَ فَمات؛ فقد بَرِئَتْ منهُ الذِّمَّة، ومَنْ رَكِبَ البَحْرَ في ارْتِجَاجِهِ، فَغَرِقَ؛ فقد بَرِئَتْ منه الذِّمَّةُ". قال البيهقي: "ورواه شعبة عن أبي عمران عن محمد بن أبي زهير، وقيل: عن محمد بن زهير بن أبي علي، وقيل: عن زهير بن أبي جبل عن النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -. وقيل غير ذلك (2) ". (الإِجَّارُ) بكسر الهمزة وتشديد الجيم: هو السطح. و (ارتجاج البحر): هيجانه. __________ (1) أي: فوقع فمات كما يأتي في الحديث الآتي آخر الباب.

3079 - (1) [حسن صحيح] عن أبي هريرة رضي الله عنه قال: مَرَّ النبيُّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - برجلٍ مضْطَجعٍ على بطْنِهِ، فغَمزَهُ برِجْلهِ، وقال: "إنَّ هذه ضِجْعَةٌ لا يحِبّها الله عزَّ وجلَّ". رواه أحمد، وابن حبان في "صحيحه" واللفظ له (1). وقد تكلم البخاري في هذا الحديث.

3080 - (2) [حسن لغيره] وعن يعيش بن طخفة بن قيسٍ الغفاري قال: . . . كان أبي مِنْ أصحابِ الصُّفَّةِ. قال: فبينا أنا مُضْطَجعٌ مِنَ السَّحرِ على بَطْني إذ جاءَ رجلٌ يُحرِّكني بِرجْلِه، فقال: "إنَّ هذه ضِجْعَةٌ يُبْغِضُها الله". قال: فَنظرْتُ فإذا هو رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -. رواه أبو داود، واللفظ له. ورواه النسائي عن قيس بن طغفة (بالغين المعجمة) قال: حدثني أبي فذكره، وابن ماجه عن قيس بن طهفة (بالهاء) عن أبيه مختصراً. ورواه ابن حبان في "صحيحه" عن قيس بن طغفة (بالغين المعجمة) عن أبيه كالنسائي. قال أبو عمر النمري: "اختلف فيه اختلافاً كثيراً، واضطرب فيه اضطراباً شديداً. فقيل: طهفة بن قيس (بالهاء)، وقيل: طحفة (بالحاء). وقيل: طغفة (بالغين). وقيل: طقفة (بالقاف والفاء). وقيل: قيس بن طخفة. وقيل: عبد الله بن طخفة عن النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -. وقيل: طهفة عن أبي ذر رضي الله عنه عن النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -. وحديثهم كلهم واحد قال: كنتُ نائماً بالصُّفَّةِ فركَضَني رسولُ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - بِرجْلِه وقال: "هذه نوْمَةٌ يُبْغِضُها الله". وكانَ مِنْ أهْلِ الصُّفَّةِ. ومِنْ أَهْلِ العِلْمِ مَنْ يقولُ: إنَّ الصُّحْبَةَ لأبيه عبد الله، وإنهَ صاحبُ القِصَّةِ" انتهى. وذكر البخاري فيه اختلافاً كثيراً وقال: "طغفة (بالغين) خطأ. والله أعلم". __________ (1) قلت: وفاته أنه رواه الترمذي (2769) باللفظ المذكور، وكذا ابن أبي شيبة (9/ 115/ 6730)، والحاكم (4/ 271) وصححه، وأقره الذهبي، وأعله البخاري في "التاريخ" (2/ 2/ 366)، ثم البيهقي في "الشعب" (4/ 177/ 4720) بما لا يقدح؛ لأنه من رواية محمد بن عمرو عن أبي سلمة عن أبي هريرة، وقد صرح محمد بن عمرو بالتحديث في رواية لأحمد (2/ 287)، وهي رواية الترمذي، وأشار إلى مخالفة يحيى بن أبي كثير، فرواه عن أبي سلمة عن يعيش ابن طخفة، وهي الآتية بعده. لكن الحاكم دفع هذه المخالفة بأنه اختلف في إسناده على يحيى بن أبي كثير، ووافقه الذهبي.
