1865 - (1) [صحيح] عن عائشه رضي الله عنها؛ أنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "مَنْ ظَلم قِيْدَ شبرٍ مِنَ الأرْضِ؛ طُوِّقَه مِنْ سَبعِ أرَضينَ". رواه البخاري ومسلم.

1866 - (2) [صحيح] وعن أبي هريرة رضي الله عنه [عن النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -] (1) قال: "مَنْ أَخَذَ مِنَ الأرضِ شِبْراً بغيرِ حَقِّهِ طُوِّقَهُ مِنْ سبعِ أرَضِينَ". رواه أحمد بإسنادين (2) أحدهما صحيح، ومسلم؛ إلا أنَّه قال: "لا يأْخُذ أحدٌ شبراً مِن الأرضِ بغير حقِّهِ؛ إلا طَوَّقَهُ الله إلى سبعِ أَرَضين يومَ القيامَةِ". قوله: "طوقه من سبع أرضين" قيل: أراد طوق التكليف لا طوق التقليد. وهو أنْ يطوق حملها يوم القيامة. وقيل: إنَّه أراد أنه يخسف به الأرض فتصير البقعة المغصوبة في عنقه كالطوق. قال البغوي: "وهذا أصح".

1867 - (3) [صحيح] ثم روى [يعني البغوي] بإسناده عن سالم عن أبيه قال: قال النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "مَنْ أَخَذ مِنَ الأرضِ شِبْراً بغيرِ حقِّهِ؛ خُسِفَ به يومَ القِيامَةِ إلى سبعِ أرَضِينَ". وهذا الحديث رواه البخاري وغيره. __________ (1) سقطت من الأصل، واستدركتها من "المسند" و"مسلم" (5/ 58 - 59). (2) قلت: بل بثلاثة (2/ 387، 388 و432)، وأوسطها على شرط مسلم؛ وبه أخرجه في "صحيحه".

1868 - (4) [صحيح] وعن يعلى بن مرة رضي الله عنه قال: سمعت النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - يقول: "أيُّما رجلٍ ظَلَم شِبْراً مِنَ الأرضِ؛ كَلَّفهُ الله عزَّ وجلَّ أنْ يحفِرَهُ حتى يبلُغَ به سبْعَ أرَضينَ، ثم يُطَوِّقه يومَ القيامَةِ حتى يُقْضى بينَ الناسِ". رواه أحمد والطبراني، وابن حبان في "صحيحه"، وفي رواية لأحمد والطبراني عنه قال: سمعت رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - يقول: "مَنْ أخَذ أرضاً بغير حقِّها؛ كُلِّفَ أنْ يَحْمِلَ تُرابهَا إلى المَحْشَرِ".

1869 - (5) [حسن صحيح] وعن أبي مالكٍ الأشعري (1) رضي الله عنه عن النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "أعْظَمُ الغُلولِ عندَ الله عزَّ وجلَّ ذِراعٌ مِنَ الأرضِ، تجدون الرجلين جارَيْنِ في الأرضِ أو في الدارِ، فيقتطعُ أحَدُهُما مِنْ حَظِّ صاحِبهِ ذِراعاً، إذا اقْتَطَعَهُ؛ طُوِّقَهُ مِنْ سبعِ أرَضِينَ". رواه أحمد بإسناد حسن، والطبراني في "الكبير".

1870 - (6) [صحيح] وعن وائل بن حجر (2) رضي الله عنه قال: قال رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "من غصبَ رجلاً أرضاً ظلماً؛ لقيَ اللهَ وهو عليه غضبان". رواه الطبراني من رواية يحيى بن عبد الحميد الحمَّاني. __________ (1) هكذا وقع في ترجمة أبي مالك الأشعري من "المسند" (5/ 341 و344) من طريق زهير بن محمد وشريك، كلاهما عن عبد الله بن محمد بن عقيل عن عطاء عنه. ثم أورده في ترجمة أبي مالك الأشجعي (4/ 140) من طريق زهير وحده قال: "عن أبي مالك الأشجعي". وخفيت الرواية الأولى على الحافظ الناجي (167/ 1)، مع أن الهيثمي قد ذكرها مع الأخرى (4/ 175)، وصحح ابن الأثير في "أسد الغابة" (5/ 288) الأولى، وذكر شريك متابعين عليها، وقال: "وزهير كثير الخطأ". وحديث شريك أخرجه ابن أبي شيبة أيضاً (6/ 567/ 2060)، وحسَّن إسناده الحافظ في "الفتح" (5/ 105). (2) الأصل: "عبد الله"، وهو خطأ يبدو أنه من المؤلف رحمه الله، والصواب: "وائل"، وهو ابن حجر، لأنه في "المعجم الكبير" للطبراني (22/ 18/ 25) من طريق علقمة بن وائل عن أبيه. وكذلك ذكره على الصواب الحافظ ابن حجر في "التلخيص الحبير"، وكذلك الحافظ السيوطي في "الجامع الكبير".=

1871 - (7) [صحيح] وعن أبي حميدٍ الساعدي رضي الله عنه؛ أنَّ النبيَّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "لا يَحِلُّ لمسْلمٍ أنْ يأخُذَ عَصا [أخيه] بغيرِ طيبِ نفسٍ منهُ". قال ذلك لِشدَّةِ ما حرَّمَ الله (1) مِنْ مالِ المسلمِ على المسلمِ. رواه ابن حبان في "صحيحه". (قال الحافظ): "وسيأتي في "باب الظلم" إنْ شاء الله تعالى". (2) __________ = ثم إن غَمْزَ المؤلف بأنه من رواية الحماني فيه ذهول عن أنَّه متابَع من (محمد بن عيسى الطباع) في نفس رواية الطبراني. وتبعه فيه الهيثمي، وقلدهما في كل ذلك المعلقون الثلاثة كما هي العادة! وقد أودعت بيان ذلك كله وتحقيقه في "الصحيحة" (3365). (1) وكذا رواه أحمد (5/ 425). وفي رواية له صحيحة: "رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -". (2) ظاهر العبارة أنَّه يعني الحديث نفسه، ولم يُعدْه هناك، فلعل الصواب "باب في الظلم" كما في بعض النسخ، فانظر (20 - القضاء/ 5).

1872 - (1) [صحيح] عن عمر بن الخطاب رضي الله عنه قال: بينما نحن عندَ رسولِ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - ذاتَ يومٍ إذْ طلعَ علينا رجلٌ شديدُ بيَاضِ الثيابِ، شديدُ سوادِ الشَّعْرِ، لا يُرى عليه أثَرُ السَفرِ، ولا يَعرِفُه منَّا أحدٌ، حتَّى جَلَس إلى النبيِّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -، فأسْنَدَ رُكْبَتَيْهِ إلى رُكْبَتَيْهِ، ووَضَع كَفَّيهِ على فخِذَيْهِ، وقال: يا محمَّد! أخْبِرْني عنِ الإسْلامِ؟ فقال رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "الإسلامُ أنْ تَشْهدَ أن لا إله إلا الله، وأن محمَّداً رسولُ الله، وتقيمَ الصلاةَ، وتؤتي الزكاةَ، وتصومَ رمضانَ، وتحجَّ البيتَ إنِ اسْتَطَعْتَ إليه سبيلاً". قال: صدقْتَ، فَعجِبْنَا له يسْأَلُهُ ويُصَدِّقُهُ. قال: فأَخْبِرْني عنِ الإيمانِ؟ قال: "أنْ تُؤمِنَ بالله وملائِكتِهِ وكتُبِهِ ورسُلهِ واليوم الآخِرِ، وتُؤمِنَ بالقَدرِ خيرِه وشرِّه". قال: صدَقْتَ قال: فأخْبِرْني عنِ الإحْسانِ؟ قال: "أنْ تعبُدَ الله كأنَّك تراهُ، فإنْ لَمْ تكن ترَاه، فإنَّهُ يراكَ". قال: فأخْبِرْني عنِ الساعةِ؟ قال: "ما المسْؤولُ عنها بأعْلَمَ مِنَ السائِلِ". قال: فأخْبرْني عن أَماراتِها؟ قال: "أنْ تَلِدَ الأَمَةُ (1) ربَّتَها، وأنْ ترى الحُفاةَ العُراةَ العالَة رِعاءَ الشاءِ يتطاوَلونَ في البنيانِ". قال: ثمَّ انْطَلق، فلَبِثْتُ مَلِيّاً. ثم قال: "يا عمر! أتَدْري مَنِ السائل؟ ". قلتُ: الله ورسولُهُ أعْلَمُ. قال: "فإنَّه جبريلُ أتاكُم يعلِّمُكُم دينَكُم". رواه البخاري (2) ومسلم وغيرهما.

1873 - (2) [صحيح] وعن أبي هريرة رضي الله عنه قال: قال رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "سلوني". فهابوا أنْ يَسْأَلوه، فجاءَ رجلٌ فجلسَ عند ركبَتيْهِ؛ فقال: يا رسول الله! ما الإسْلام؟ قال: "لا تُشْرِكُ باللهِ شيئاً، وتقيمُ الصلاةَ، وتُؤتي الزكاةَ، وتصومُ رمضانَ". قال: صدَقْتَ. قال: يا رسولَ الله! ما الإيمانُ؟ قال: "أنْ تؤمِنَ بالله وملائكتِهِ وكتابه [ولقائه] ورسُلِهِ، وتؤمنَ بالبَعْثِ الآخِرِ، وتؤمنَ بالقدَر كلِّهِ". قال: صدَقْتَ. قال: يا رسولَ الله! ما الإحسانُ؟ قال: "أنْ تخشى الله، كأنَّك تراه، فإنَّك إنْ لا تكنْ تراه، فإنَّه يراك". قال: صدقتَ. قال: يا رسولَ الله! متى تقومُ الساعَةُ؟ قال: "ما المسؤولُ عنها بأعْلَمَ مِنَ السائلِ، وسأحَدِّثُكَ عَنْ أشْراطِها؛ إذا رأيْتَ المرْأَةَ تَلِدُ رَبَّها فذاكَ مِنْ أشراطِها، وإذا رأيتَ الحُفاةَ العُراةَ الصُّمَّ البُكْمَ ملوكَ الأرضِ، فذاكَ مِنْ أشْراطِها، وإذا رأيتَ رُعاءَ البَهْمِ (1) يتطاوَلُونَ في البُنيانِ فذاك مِنْ أشراطها" الحديث. رواه البخاري ومسلم، واللفظ له (2). وهذا الحديث له دلالات كثيرة، ولم نذكره إلا في هذا المكان حسبما اتفق في الإملاء. __________ (1) وفي رواية أبي هريرة الآتية: "المرأة"، وهذا يشمل الحرة والعبدة، وقد اختلفوا في المراد على أقوال حكاها الحافظ، ومال إلى أن المعنى: أن يكثر العقوق في الأولاد فيعامل الولد أمه معاملة أمته من الإهانة والسب والضرب والاستخدام، فأطلق عليه (ربها) مجازاً لذلك، أو المراد بـ (الرب): المربي، فيكون حقيقة. (2) قال الناجي (168/ 1): "ذِكر البخاري هنا وهم بلا شك؛ فإنَّه من أفراد مسلم عنه". وانظر تعليقنا المتقدم على الحديث (4 - الطهارة/ 7).

1874 - (3) [حسن صحيح] وعن أنس رضي الله عنه: أنَّ رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - خرج يوماً ونحن معه، فرأى قبةً مشرفةً، فقال: "ما هذه؟ ". قال أصحابُه: هذه لفلان -رجلٌ من الأنصار-، فسكتَ وحملها في نفسِهِ، حتى إذا جاءَ صاحبُها رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -، وسلَّمَ عليه في الناسِ، فأعرضَ عنه، صنعَ ذلك مراراً، حتى عرفَ الرجلُ الغضبَ فيه، والإعراض عنه، فشكا ذلك إلى أصحابه، فقال: والله إنِّي لأنكرُ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -. قالوا: خرج فرأى قبتَكَ، فرجع الرجل إلى قبته فهدمها حتى سواها بالأرضِ، فخرج رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - ذات يوم، فلم يرَها، قال: "ما فعلتِ القبةُ؟ ". قالوا: شكا إلينا صاحبُها إعراضَكَ عنه فأخبرناه، فهدمها، فقال: "أمَا إنَّ كلَّ بناءٍ وبالٌ على صاحبه إلا ما لا، إلا ما لا". رواه أبو داود -واللفظ له-، وابن ماجه أخصر منه، ولفظه: قال: مرَّ رسولُ اللهِ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - بقُبةٍ على باب رجل من الأنصار فقال: "ما هذه؟ ". قالوا: قبةٌ بناها فلان، فقال رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "كلُّ ما كال هكذا فهو وبالٌ على صاحبه يوم القيامةِ". فبلغ الانصاريَّ ذلك، فوضعها، فمرَّ النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: بعدُ فلم يرَها، فسأل عنها، فأُخبرَ أنَّه وضعها لما بَلَغَه، فقال: "يرحمُه الله، يرحمُه الله". [صحيح لغيره] ورواه الطبراني بإسناد جيد (1) مختصراً أيضاً: أن رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - مرَّ ببنيةِ قبةٍ لرجل من الأنصار، فقال: "ما هذه؟ ". قالوا: قبة. فقال النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "كلُّ بناءٍ -وأشار بيده على رأسه- أكثرُ من هذا؛ فهو وبالٌ على صاحِبِه يوم القيامةِ". قوله: "إلا ما لا" أي: إلا ما لا بدَّ للإنسان منه مما يستره من الحر والبرد والسباع، ونحو ذلك. __________ (1) جمع (بهمة) وهي ولد الضأن؛ الذكر والأنثى، وجمع (البهم): بهام كما في "النهاية". (2) قلت: وزاد في آخره: "هذا جبريل أراد أن تعلَّموا إذْ لم تسألوا". وما بين المعكوفتين زيادة منه، ولم يستدركها الثلاثة المعلقون المحققون زعموا!

1875 - (4) [صحيح] وعن حارثة بن مضرب قال: أتَيْنا خَبَاباً نعودُه، وقد اكْتوى سبعَ كَيَّاتٍ. فقال: لقد تطاوَل مَرضي، ولولا أنيَّ سمعتُ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - يقولُ: "لا تَتَمنَّوا الموتَ" لتَمنَّيْتُ. وقال: "يؤجَرُ الرجلُ في نَفَقتِه كلِّها؛ إلا الترابَ -أو قال: في البناءِ-". رواه الترمذي وقال: "حديث حسن صحيح" (1).

1876 - (5) [حسن لغيره] وعن الحسن قال: لمَّا بنَى رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - المسجدَ قال: "ابْنوهُ عَريشاً كعريشِ مُوسى". قيل للحسن: وما عريش موسى؟ قال: إذا رفع يده بلغ العريش يعني السقف. رواه ابن أبي الدنيا مرسلاً وفيه نظر. (2) __________ (1) لقد أبعد المصنف النجعة، فالحديث رواه البخاري أيضاً (كتاب المرضى وغيره)، وفي "الأدب المفرد" (447 و454 و455) إلا أنَّه صرح بأنَّ القائل: "يؤجر. . ." إنما هو خباب نفسه فهذا القدر منه موقوف، لكنه في حكم المرفوع، وقد جاء مرفوعاً من طرق ثلاث عند الطبراني في "الكبير" (4/ 64 و74 و82) وكلها ضعيفة، وأوهاها طريق عمر بن إسماعيل بن مجالد عن أبيه، ولم يذكر الحافظ في "الفتح" سواها! وسقط اسم (إسماعيل) من نقل الشيخ عبد الصمد في تعليقه على "التحفة"، فأوهم سلامتها مِن الوهن الشديد! (2) قلت: وقد جاء موصولاً، فانظر "الصحيحة" (616) إنْ شئت.
