حدثنا عيسى بن أحمد العسقلاني، قال: حدثنا يزيد بن هارون، قال: أخبرنا يزيد بن عياض، عن صفوان بن سليم، عن سليمان بن يسار، عن أبي هريرة رضي الله عنه، عن رسول الله صلى الله عليه وسلم: أنه قال: ((ما عبد الله بشيءٍ أفضل من فقهٍ في دينٍ، ولفقيهٌ واحدٌ أشد على الشيطان من ألف عابدٍ، ولكل شيءٍ عمادٌ، وعماد هذا الدين الفقه)).قال أبو عبد الله: والفقه: هو الفهم، وانكشاف الغطاء عن الأمور، فإذا عبدَ الله بما أمر ونهى بعد أن فهمه وعقله، وانكشف له الغطاء عن تدبيره فيما أمر ونهى، فهي العبادة الخالصة المحضة. وذلك أن الذي يؤمر بالشيء، فلا يرى زين ذلك الأمر، وينهى عن الشيء، فلا يرى شينه، فهو في عمىً من أمره، فإذا رأى زين ما أمر به، وشين ما نهي عنه، عمل على بصيرة، وكان قلبه بها أقوى، ونفسه لها أسخى، وحمد على ذلك وشكر، والذي يعمى عن ذلك؛ فهو جامد القلب، كسلان الجوارح، ثقيل النفس، بطيء التصرف.والفقه: مشتق من تفقؤ الشيء، يقال في اللغة: فقأ الشيء: إذا انفتح، وفقأ الجرح: إذا انفرج عما اندمل، فالاسم منه فقءٌ، والهاء والهمزة تتبدلان، تجزئ إحداهما عن الأخرى، فقيل: فقيء، وفقيه.والفهم: هو العارض الذي يعرض في القلب من النور، فإذا عرض، انفتح بصر القلب، فرأى صورة ذلك الشيء في صدره، حسناً كان أو سيئاً، فالانفتاح هو الفقه، والعارض هو الفهم.وقد ذكر الله تعالى في قوله الفقه، فقال: {لهم قلوبٌ لا يفقهون بها}، فأعلم أن الفقه من فعل القلب.وقال رسول الله صلى الله عليه وسلم للأعرابي حين قرأ عليه: {فمن يعمل مثقال ذرةٍ خيراً يره. ومن يعمل مثقال ذرةٍ شرًّا يره}، فولى وقال: حسبي حسبي، فقال رسول الله صلى الله عليه وسلم: ((فقه الرجل))؛ أي: فهم. وقول أبي الدرداء رضي الله عنه: إنك لن تتفقه حتى ترى للقرآن وجوهاً كثيرة.وأن الله -تبارك وتعالى- كلف العباد لما أعطاهم من العلم أن يعرفوه، ثم اقتضاهم بعد المعرفة أن يخضعوا له فيدينوا، فشرع لهم شريعة الحلال والحرام؛ ليتدينوا له بمباشرتهم الحلال، واجتنابهم الحرام، ويؤدوا إليه فرائضه، فذلك الدين، وهو الخضوع له، والدون: مشتق من ذلك، وكل شيء اتضع، فهو دون.فأمرت بأمور لتضع نفسك لمن اعترفت به ربًّا، فسمي ذلك الفعل، وتلك الأمور منك ديناً، فشرع الله لهم الدين، فقبلوه طائعين؛ أي: مطيعين أنفسهم له بذلاً وعبودة، فمن فقه أسباب هذه الأمور التي أمر ونهى، ولاحظ منه ماذا أمر، ورأى زينه وبهاءه، تعاظم ذلك عنده، وكبر في صدره شأنه، فكان أشد تسارعاً فيما أمر، وأشد هرباً وامتناعاً مما نهى، فالفقه في الدين جند عظيم يؤيد الله به أهل اليقين الذين عاينوا محاسن الأمور ومشاينها، وأقدار الأشياء، وحسن تدبير الله في ذلك لهم بنور يقينهم؛ ليعبدوه على يسر، ومن حرم ذلك، عبده على مكاره وعسر؛ لأن القلب، وإن أطاع وانقاد لأمر الله تعالى، فالنفس إنما تخف وتنقاد إذا رأت نفع شيءٍ، أو ضرر شيء، فالنفس جندها الشهوات، ويحتاج صاحبها إلى أضدادها من الجنود، حتى يقهرها، وتنقاد له وهو الفقه.قال له قائل: صف لنا واحداً من هذه الأمور نفهم بها غيرها؟قال: نعم، أحل الله النكاح، وحرم الزنا، فإنما هما إتيانٌ واحدٌ لامرأة واحدة، إلا أن هذا بنكاح، وذلك بزناً، فإذا كان بنكاح؛ فمن شأنه العفة والتحصين للفرج، فإذا جاءت بولد، ثبت النسب، وجاء العطف من الوالد بالنفقة والتربية والميراث، وإذا كان من زنا، ضاع الولد؛ لأنه لا يدري أحدٌ من الواطئين لمن هذا الولد، فهذا يحيله على ذلك، وذلك يحيله على هذا، وحرم الله الدماء، وأمر بالقصاص؛ ليتحاجزوا، وليحيوا، ولذلك قال في تنزيله: {ولكم في القصاص حياةٌ يا أولي الألباب لعلكم تتقون}.وأحرز الأموال، وأمر بقطع اليد السارقة؛ ليتمانعوا بما ملكت أيديهم، وكذلك قال في تنزيله: {فاقطعوا أيديهما جزاءً بما كسبا نكالاً من الله}.قال: فالنكل: الامتناع، فأمر بقطع يده؛ ليمتنع من ذلك، فإن عاد، فرجله، فلعل بما أمر ونهى تنبيهاً لأولي البصائر والعقول، ولمن رزق لبًّا.

حدثنا نصر بن عليٍّ الحداني، قال: أخبرنا هارون بن مسلم، قال: أخبرنا عبيد الله بن الأخنس، عن الوليد بن عبد الله بن أبي مغيثٍ مولى بني عبد الدار، عن يوسف بن ماهك، قال: كان معاوية قليل الحديث عن رسول الله صلى الله عليه وسلم، وقلما قام خطيباً إلا قال: سمعت رسول الله صلى الله عليه وسلم يقول: ((من يرد الله به خيراً، يفقهه في الدين))، يا أيها الناس! تفقهوا.
