حدثنا نصر بن علي الحداني، قال: أخبرني عكرمة بن خالد بن سلمة المخزومي، قال: سمعت أبي يقول: سمعت ابن عمر رضي الله عنه يقول: سمعت رسول الله صلى الله عليه وسلم يقول: ((لا تضربوا الرقيق؛ فإنكم لا تدرون ما توافقون)).قال أبو عبد الله -رحمة الله عليه-: فالضرب أصله تأديب، وقد ندب الله العباد إلى تأديب أهلهم، فقال: {قوا أنفسكم وأهليكم ناراً وقودها الناس والحجارة}، فوقايتك نفسك وأهلك: أن تعظها وتنصحها، وتزجرها عن عمل يوردها النار، وتقيم أودهم بأنواع الأدب، فمن الأدب: الموعظة، ومن الأدب: الوعيد، ومن الأدب: الضرب، وحبس المنافع، ومن الأدب: الرفق والعطية والنوال والبر، فإن ذلك ربما كان أدعى لهم من الوعيد والضرب، وبين النفوس تفاوت، فنفس تضرع وتخضع لك بالبر والعطية والرفق، فهي نفس كريمة، ونفس تضرع وتخضع بالغلظة والشدة والعنف عليها، فهي نفس لئيمة، فلو حملت هذا على تلك النفس، لأفسدتها، ولو حملت هذا على النفس الأخرى، لأفسدتها.وقد جعل الله الحدود أدباً لعباده، ومزجرةً للآخرين، وموعظة للمتقين، ومن دون الحدود تعزيراً على قدر ما يأتون من المنكر، فأدب الأحرار إلى السلطان، وأدب المماليك والعبيد والأولاد إلى السادات والآباء، هذا كله داخل في قوله: {قوا أنفسكم وأهليكم ناراً}، فإذا أدبه قومه، وإذا قومه، فقد وقاه النار؛ لأن في الأدب قمع النفس الأمارة بالسوء، والنار دار الأعداء، والجنة دار الأولياء، وهم الموحدون، وجعل ممر الموحدين إلى الجنة على النار، فقال: {وإن منكم إلا واردها كان على ربك حتماً مقضياً. ثم ننجي الذين اتقوا ونذر الظالمين فيها جثياً}، فوعد النجاة للمتقين، وحذر الموحدين، وجعل خبر ممرهم عليها وعيداً هائلاً، عظيماً شأنه، يذهل النفوس، ويخمد الشهوات، فالأدب غذاء النفوس وتربيتها للآخرة.وروي عن رسول الله صلى الله عليه وسلم: أنه قال: ((لأن يؤدب أحدكم ولده خيرٌ له من أن يتصدق كل يومٍ بنصف صاعٍ)).

وحدثنا نصر بن علي الحداني، ومحمد بن موسى الحرشي، قالا: حدثنا عامر بن أبي عامرٍ الخزاز، قال: حدثنا أيوب بن موسى الحرشي، عن أبيه، عن جده، قال: قال رسول الله صلى الله عليه وسلم: ((ما نحل والدٌ ولداً أفضل من أدبٍ حسنٍ)). وقد أشار رسول الله صلى الله عليه وسلم إلى ضرب الرقيق إذا زنوا فقال:((إذا زنت أمة أحدكم، فليجلدها، ثم إذا زنت، فليجلدها)).

حدثنا بذلك قتيبة بن سعيد، عن مالك بن أنسٍ، عن ابن شهاب، عن عبيد الله بن عبد الله بن عتبة، عن أبي هريرة رضي الله عنه، وزيد بن خالد الجهني، عن رسول الله صلى الله عليه وسلم، بمثله. فالحدود والتعزير بمكانهما على الأحرار والرقيق.وأما قول رسول الله صلى الله عليه وسلم: ((لا تضربوا الرقيق))، فخليق أن يكون إنما نهى عن ضربهم على غضب المولى لنفسه على نفعٍ أو ضر، لا لله، فأما إذا ضربه تأديباً ليقومه؛ لئلا يعصي الله في أموره، ولئلا يعصي المولى في أموره اللازمة له، فإن عصيانه وتضييع أموره معصيةٌ لله، فذلك مما يجب عليه، وهو داخل في قوله: {قوا أنفسكم وأهليكم ناراً}.(فالعبيد والإماء من الأهلين، وإنما حذرهم رسول الله صلى الله عليه وسلم -فيما نرى- أن يضرب في نفع أو ضر؛ فإن قليلاً من الناس من يتمالك هناك حتى يكون ضربه لله، لا لنفسه، إلا أهل اليقين الذين قد عروا عن خيانة النفوس، فهم في قبضة الله، به ينطقون، وبه يبطشون، فأدبهم شفاء للصدور بما فيها، ومن دونهم من الناس قلما يسلمون على ضرب المماليك في ضرٍّ أو نفعٍ إلا وغضبهم لأنفسهم، لا لله، فإذا ضربوا، فالقصاص قائم فيما بينهم يوم لا يجاوزه ظلم ظالم، ولا ظالمه، وهو بالمرصاد).

حدثنا محمد بن مقاتل، قال: حدثنا عيسى بن إبراهيم القرشي، عن داود بن قيس المديني، عن زيد بن أسلم، قال: قال رجل: يا رسول الله! ما تقول في ضرب المماليك؟ قال: ((إن كان ذلك في كنهةٍ، وإلا، أقيد منكم يوم القيامة))، قيل: يا رسول الله! ما تقول في سبهم! قال: مثل ذلك، قالوا: يا رسول الله! فإنا نعاقب أولادنا ونسبهم، قال: ((إنهم ليسوا مثل أولادكم، إنكم لا تتهمون على أولادكم)).

حدثنا عمر بن أبي عمر، قال: حدثنا أصبغ بن الفرج، قال: أخبرني ابن وهب، عن مخرمة، أخبره، عن أبيه، عن عبد الله بن رفاعة بن رافع الزرقي، عن أبيه، قال: قال رجل: يا رسول الله! كيف ترى في رقيقنا، أقوام مسلمون يصلون صلاتنا، ويصومون صيامنا، نضربهم؟ فقال رسول الله صلى الله عليه وسلم: ((يوزن ذنبهم وعقوبتكم إياهم، فإن كانت عقوبتكم أكثر من ذنبهم، أخذوا منكم))، قال: أفرأيت سبنا إياهم؟ قال: ((يوزن ذنبهم وأذاكم إياهم، فإن كان أذاكم أكثر، أخذوا منكم))، قال الرجل: ما أسمع عدواً أقرب إلي منهم، فتلا رسول الله صلى الله عليه وسلم: {وجعلنا بعضكم لبعضٍ فتنةً أتصبرون وكان ربك بصيراً}، فقال الرجل: أرأيت يا رسول الله ولدي، أضربهم؟ قال: ((إنك لا تتهم في ولدك، لا تطيب نفساً تشبع ويجوع، وتكتسي ويعرى)).

حدثنا صالح بن محمد، قال: حدثنا زافر بن سليمان، عن إسماعيل بن عياشٍ، عن عمر مولى غفرة، عن زياد بن أبي زيادٍ، قال: جاء رجل فقال: يا رسول الله! إن لي مالاً، وإن لي خدماً، وإني أغضب، فأعزم وأشتم وأضرب، فقال رسول الله صلى الله عليه وسلم: ((توزن ذنوبه بعقوبتك، فإن كانت سواءً، فلا لك ولا عليك، وإن كانت العقوبة أكثر، فإنما هو شيءٌ يؤخذ من حسناتك يوم القيامة))، فقال الرجل: أوه، أوه، يؤخذ من حسناتي؟ أشهدك يا رسول الله أن مماليكي أحرار، أنا لا أمسك شيئاً يأخذ من حسناتي، قال: ((فحسبت ماذا؟ ألم تسمع إلى قول الله تعالى: {ونضع الموازين القسط ليوم القيامة} الآية؟!)). قال أبو عبد الله: فقد كشفت هذه الأحاديث عن الوجهين جميعاً، فكل ضربٍ للماليك مما هو لله حد، أو تعزير، أو تقويمٌ للمماليك يؤدبه لله، فهو مأجور، وقد قال صلى الله عليه وسلم: ((كلكم راعٍ، وكلكم مسؤولٌ عن رعيته))، وكل ضرب إنما ضربه تشهياً لشيء غاظه، فالقصاص قائم، فإن كان في ذلك تعد، أخذ بالعدوان من حسناته على ما جاء في التنزيل، فذكره رسول الله صلى الله عليه وسلم.فحديث ابن عمر: ((لا تضربوا الرقيق)) محمولٌ على أن لا يضربه للتشفي لغيظه، فإنه لا يدري ما يوافق الضربة من أعضائه، فربما وقت على عينٍ ففقأها، وربما وقعت على عضوٍ فكسر، وربما وقع على صدرٍ أو خاصرةٍ فقتل، فحذرهم أن يضربوا مماليكهم، فيحدث منهم حدثٌ يشرك في دمه ومن أدب لله، فمات في ذلك الأدب، لم يؤاخذ به إذا كان ذلك حداً معلوماً، فضربه، فلم يجاوز، ولم يتعد فيه. وروي عن رسول الله صلى الله عليه وسلم أنه قال: ((من لاءمكم من رقيقكم، فأطعموهم مما تطعمون، واكسوهم مما تكتسون، ومن لا، فبيعوهم، ولا تعذبوا خلق الله)). فالضرب المحمود: ما كان لله، والضرب المهجور: ما كان للنفس.والناس في هذا على طبقات: فمن كان قلبه لله، أمكنه أن يؤدبه في أمر الدنيا والآخرة لله، ومن لم يكن قلبه لله، فكان الغالب عليه هواه ونفسه، لم يمكنه أن يضربه إلا في أمر الدين فقط، حتى يكون لله، فأما في أمر الدنيا من ضر أو نفع، فلا قوام له في تأديبه؛ لأنه إنما يغضب لنفسه، ألا ترى أنه لما ارتفعت التهمة في شأن الولد، ذهب القصاص؛ لأن ذلك لله، وذهب نصيب النفس، وكذلك اليتيم.
